Apple Tries To Ban Ice Cream Sandwich

Apple has filed a lawsuit with US District Court , California, claiming that the new Samsung Galaxy Nexus infringes on its four patents , demanding preliminary injunction against the device . Since this is the showcase of Android 4.0 from Google and other devices will have the same base features of ICS , ban on Galaxy Nexus would Indirectly be a ban on Android 4.0 if Apple wins .

The patents that Apple wants to defend include slide to unlock , word suggestion while typing text on touchscreen keyboard , detection of phone numbers in email and ability to call them by clicking and unified search patent which involves voice assisted searching on web . Earlier this month Apple had demanded a ban on Samsung Galaxy Tab and Nexus in German court saying they infringed upon its patent which was rejected by the court .

Windows 8 On ARM Will Not Run Windows 7 Stuff

win8tabw.jpg

Microsoft has finally cleared up the confusion about Windows 8 on ARM (WOA) leading to conclusion that it will be not the same experience as Windows 8 on Intel/AMD . Microsoft's Steven Sinofsky said on MSDN blog that WOA will launch at same time with x86 version and the ARM version will run desktop version of Office 15 . But ARM version will have major differences , including the inability to run legacy apps , so apps designed for Windows 7 wont run on WOA as both are different architectures and running x86 apps on ARM would require virtualization . Apart from this there will be several other differences ( read more at source ) .

Google has acquired motorola , now is the time for them to use all the patents Moto has and sue Apple back in such a way that they should shiver on hearing the word patent.

For me its 6hrs of internet and 2hours of TV.

There are no quality portable touch media players like iPod . Some one has to change that , google has a chance with their huge app library they only can fight back against the iCraze . Android powered portable media player.

This lawsuit thingy has gone too far, first HTC, then samsung android devices and now direct war against ice cream sandwich, Now either google should grow a spine and defend atleast the nexus range or admit defeat and agree that its a stolen OS.

Google should screw Apple right back. Infact, the US PTO should itself accept that by being self funded, it accepts patents blindly without having a proper look.

This patent war is going too far. I hope apple doesn't win. I will not be happy with Apple defining how i should do things

and TV, whats that

Though I am no fan of Apple, I don't see anything wrong in them protecting their IP rights, if they are genuinely claims that is. If someone has invested time and money to come up with something new or different, and wants to file a patent to ensure licensed use of that invention, there is nothing wrong in it.

At least Apple is better than Motorola/Google who want to ban iDevices for using GSM/3G and other essential standards related patent! Imagine if this is granted, Motorola/Google could possibly collect (extort) money for every single device sold in the world (just like MS is currently extorting money for Android-based devices). This is a very fascinating phase and I really look forward to what happens in this war!

Over the weekend: http://www.appleinsider.com/articles/12/02/11/apple_attacks_motorolas_efforts_to_block_iphone_4s_using_standards_patents_asks_for_huge_damages.html

^ MS is NOT extorting money, nor are the patent holders for mobile technology. They invested money in coming up with those technologies, just like Apple did for all the stuff that they are claiming rights on.

f%%k the two faced apple company. it does not like paying licensing money for features it uses in its phones (read 3G and 4G in Europe) and goes on suing others saying they are stealing its inventions.

I'm sure apple will win these cases cause the us govt and patent office requries it money and they have lots of it. Europe is in decline industrially so it will take money from apple and shut up. In fact EU takes money from almost all major companies. Its been reduced to such a bad state.

all companies should just stop releasing their products in USA. they can earn more by reducing the prices a bit and making it available in developing countries. let usa people suffer cause of apple. In the coming years there will be no competition in usa. only apple computer, and iphone and ipad and other icrap like itunes. rest all stuff will be sold outside usa.

I don't disagree. I was speaking from a Android fanboy stand-point because that is how the Android blogs term it!

Never expected a TE moderator to post such a comment without reading up about the actual discussion. Apple is already paying licensing money to Qualcomm (which has licensed the technology from Motorola) when they buy chips from them. Why should Apple have to pay it to Motorola again?

Also, there is a difference between what Motorola is doing and what Apple is. Motorola agreed to provide the license on Fair, Reasonable and non-discriminatory terms to everyone because the patent in question is a standards related patent.

However, this is what Motorola has done:

Qualcomm, the company building the baseband chips in Apple's iPhone 4S, reports in the complaint that "On January 11, 2011, Mr. Kirk Dailey, Motorola's Corporate Vice President, Intellectual Property, sent a letter to Qualcomm, copying Apple, purporting 'to terminate any and all license and covenant rights with respect to Apple, effective February 10, 2011 (30 days from the date of this letter).'"

The complaint further notes, "On April 25, 2011, Mr. Derek Aberle, Executive Vice President of Qualcomm and President of Qualcomm Technology Licensing responded to Motorola’s letter of January 11, 2011. Mr. Aberle disagreed with Motorola’s contention that it could invoke the Defensive Suspension Provision with respect to Apple. He noted that the Defensive Suspension provision did not entitle Motorola to terminate rights based on suits brought by Apple."

Motorola is demanding 2.25% of the actual end user price of the iPhone. That is totally unfair. Even if they were to ask for licensing cost, it should be 2.25% of the cost of the actual baseband chip, not the entire freaking phone!

#Pat,

Motorola is demanding 2.25% of cost price to carriers, not the end user price. There's a difference between the two. The cost to carriers will be higher than cost to end user since most people buy their phones on a 2 year contract. So end user would get the phone subsidized from carrier for $100-150 whereas the carrier would be actually paying full amount of $500+ bucks for the phone from Apple.

Sticker price is set by Apple. Google is only asking what is fair. Other phone companies are already paying that amount to Motorola for the license, and they're not complaining. Only Apple is.

Microsoft is doing the same thing to android phone btw. And is already earning around 15 bucks per android device sold.

Care to back that claim with a valid source?

i dont think such license agreements can be found on android blogs or macrumors due to NDA, so its not possible to provide a source.

BTW apple lost a lawsuit against nokia last year and are already paying around 1% of the sale price for all the past sales and the future payments will continue in tune of billions of dollars.

http://www.guardian.co.uk/technology/2011/jun/14/apple-nokia-patent-case

So, the only solution in this case is that apple should pay motorola for gsm patents and samsung should pay apple for os related patents.
