Would someone clarify, how is this called “the deal was finalised” when the seller immediately walked back after agreeing to a sum? This revision doesn’t sit consistent with my understanding of how a deal is considered finalised.

Wouldn’t such practice snowball into proxy biddings, which I think is not allowed here?

I was under the impression that once I agree to a price with the buyer, I must follow it through. But I am willing to learn.

You mean its wrong to honestly negotiate without giving other reasons and escaping from the deal ? whats wrong in it

Summary: Buyer complained of actual condition (Scratched) vs described condition (pristine).. Seller offered a refund if the device is returned.. This should end the dispute.
Now even after seeing the actual condition (which neither the buyer or the end user are okay with basis the issue raised in the thread) if buyer has handed the phone over to some third party.. seller shouldnt be blamed here.

Just my 2 cents looking at both the buyer's & seller's responses.

Sticking to a committment once token money is accepted would be most ideal, we are far from that.. there are cases when either of the parties would backout with various reasons... As long as there is no cheating/fraud involved we should be able to move past it... The affected party has to bear the inconvinience.

I have done 50+ deals on TE and never faced this situation.. I am currently driving and I will reply back with my version of the story

- The deal was finalised for 57k and @rkkaranrk made a token payment, during that period I received offers from other TE members for 59 & 60k (one was a local deal)
- I immediately reached out to @rkkaranrk and asked if we can close the deal at higher price i.e 60k, we had discussion and he agreed to pay additional 2k once he receives the phone, for which I agreed. I was very open about what I was asking and it was my choice and my device, I could have given him many other reasons and backed out of the deal, which I never did.

- Once the phone was delivered buyer told me that condition is not as expected since I had mentioned the word "Pristine" for which I agreed that it was my mistake to use the word "Pristine" as I expected the buyer to understand what a 10 months phone would look like after day to day usage, no where in the deal I have mentioned condition is 10/10
The photos what I have uploaded is very clear about the condition.. has very minimal scratches and those are expected on a stainless steel device.

- As soon as the buyer sent me photos, without any hesitation I offered him refund so that he can ship the device back to me as I had other potential buyers, he then asked for time since his friend needed to check the device and decide, he also told me that returning the device is not the solution, I then asked what it the solution expected here, for which I never got any answer.

- Today morning @rkkaranrk sent me the following msg on whatsapp



- I clearly told I am not willing to wait for 10-12 days, pls ship the phone back to me and I will refund but he did not agree and straight away posted in this thread.

- I was also willing to let go of the remaining 2k if he would have discussed with me since there was mistake from my end for using the word "Pristine"
even after reading his post in this thread I reached out to him and again insisted on sending the device back to me which he is not ready.

I am surprised and shocked the people expect a 10/10 condition for a 10 months old iPhone which is made of Stainless steel.
I am also surprised some of the members are commenting and judging without reading both sides of the story.


This changes the context and balances the topic - having offered to refund the amount and take back the device was the most @MarioBros could do..

Once phone is received not as per the condition mentioned and the buyer doesn't want to return, they either look to accept it as-is knowing they won't get a similar device for similar or better price, or they expect a monetary compensation for the difference they deem fit, which is subjective.

Many sellers here offer 2-3 days' testing warranty, but very few would go up to 2 weeks or so.

Buyer could have and should have returned the device in case seller offered the same, or accepted a compensation which would be acceptable - 2k as mentioned by the seller.

Why should this be one sided benefit only?
Yes it would be nice if deal are honoured but that is personal choice and as long as buyer is getting his money refunded immediately there should not be an issue.

you can mention you're getting a better deal and move out, or you could accept the lower price, or negotiate for something more - it's again very subjective.

once you receive full payment and then do the same, that is wrong.. again, buyer has the option to opt out of the deal than be held to a ransom.

Your stated case is very different from the natural corollary of this situation.

Here the seller asked for higher price after negotiating at a sum and receiving a token amount.

Its corollary would be a buyer bargaining for a lower price after agreeing to and paying the token amount. No seller would like that.

IMO agreement and token should mean something. Else back out.

Like I mentioned if honoured it is nice but again each is looking for the best deal for themselves and there is nothing wrong with that for both the parties as long as no one is getting cheated.
 
What is clear here is there have been mistakes and inconveniences involved but there is no malicious intent and fraud here from Mariobros part.

I was also interested in this deal and am probably the interested local person that Mariobros mentioned. But truth be told, I would probably not have bought it after physical inspection based on the scuff marks in rkkaranrk's photos as it will be harder to sell. It is just best to exchange more photos is the learning for everyone as the definitions of 5/5,4/5 etc vary from person to person.

Fwiw, Mariobros was very upfront with me about everything. I appreciate his honesty.

I made the full payment of 57k by 6:31PM, You messaged me at 8:20PM stating u have a offer of 59k/60k and started bargaining with me.

Check the sale tamplate it states item condition as 5/5, Pristine condition means in its original state what else one will look for.

Not a single photo u have shared shows anything on what's app u even said it's in superb condition stating only the display have 1 small mark though there are minimum 4.. Maybe more.

The reason he cannot return the device is he sold his phone the same day he boght this from u I think I clearly told u this. As for the solution I don't want anything from u I'm not greedy as you who was still hunting for buyers after getting the full payment from the me. That to just 2k

I think I did tell u will update the thread as this is the medium I got the phone from.

Yes dude I paid u in full check your what’s app or do u want me to share the screen shots here ? After receiving the money u were negotiating.

The guy who bought the phone had sold his phone the same day as he already paid for a new phone reason behind that was he did not have that much amount for the new one also as for the extra 2k which @MarioBros asked for after taking the full amount was to be paid by me. Which I haven’t paid till now but will.

My 2 cents: The entire decision premise of buying a used item depends on the condition of the item.. because it plays a big role in deciding the price.. it is a must that the actual state of the item is described accurately. In general, honesty is expected from every seller and buyers should always be vigilant.

if you guys have a look at all the photos of the 13 pro what I have posted, it looks fine to me at least to my eyes. Yes I agree they will be minor scratches because of the usage for the last 10 months but there is drastic difference in my photos and what he has posted

I am now starting to think did my phone have so many scratches really

huge lesson learnt, when dealing with expensive phones especially iPhones

@rkkaranrk 5/5 condition mentioned is not for the 13 pro. I had even iPhone 14 for sale and also steam deck. They are in 5/5 condition because they are brand new.
 
What about lighting?
could be a factor since its stainless steel.. its prone for scratches and even a minute one will look bad because of lighting, why would someone scratch across the power button corners and edges, that phone was always used with the case.

I still don’t understand what is the buyers intention of blowing up this issue he could’ve just simply the very same day or the next day shipped the phone back to me and I would have refunded since was not happy the condition, that would’ve closed the matter once for all.

A simple uncut unboxing video by @rkkaranrk can resolve all this confusion.
 
never in my life will use the word Pristine again, even if its brand new, better to use simpler English words :(

Update. - SteamDeck is SOLD via olx.

As you have mentioned, that people can't expect 10/10 condition for a 10 months old phone .. Similarly, after completing lot of previous deals you can't just mention 5/5 for Excellent Pristine Condition for 10 months old phone too if it have scuffs & marks and you are aware of it.. It is not always possible to Click and show Scratches and Small scuffs in photos ..That's why Trust & Feedbacks of Previous deals comes into factor for smooth completion of a deal.

As far my understanding goes and after Selling stuffs for Years, Once you have committed to sell something for a Decided price there should be no more bargaining and demand on the basis on Selling Ethics and Commitment. You have got full payment of 57k from the buyer which is not any token money or anything..It's a Full Payment and the device is belongs to the buyer once he made the payment.. Demanding extra money since you have better offers is unethical atleast for me unless the full payment Is not done and buyer keeps wasting time which a lot of people does in this forum (i don't care about others opinion and i have sold things to the buyer who paid first even i have a better offer)
