you can actually update it to the latest firmware and then jailbreak it. Spirit jailbreak is out for all versions of Iphone OS (except for the beta 4.0) Also, I am not quite sure if you can use yellowsn0w to unlock it because it worked on 3.0, but not quite sure for the 3.1.2 or 3.1.3

I havent played BC2 myself yet, but have MW2 and have been playing it since it came out. The whole gameplay is really nice. The graphics improved quite a lot on MW2 vs MW. There are a lot of new guns and some new kill streaks (which I think are a pain in the arse) Took me quite a long time...
