Bizarre twist in Mumbai pothole death, FIR filed against dead woman

There has been a bizarre twist in the death case of a 48-year-old woman in an accident while trying to avoid a pothole in Mumbai. The police have now now filed an FIR against the deceased and in its FIR the police have cited death due to negligence citing the fact that the woman was not wearing a helmet.
The 48-year-old woman died in Mumbai after falling from a two-wheeler while trying to avoid a pothole on a road in Vasai. The incident took place on Friday near the Vasai rail bridge. She succumbed to her injuries on Sunday. The woman who had her daughter pillion riding with her, died after suffering head injuries.

It might be bizarre and potholes might be a cause but i cannot understand why most people riding bikes / scooties neglect wearing helmets. They never understand that a simple helmet can make a difference between life and death. I would strongly say the pillion should also wear a helmet, even if it kid. But then here in India, where overpopulated families go for rides on bikes with 3-4 children. That simple is stupid.
I really appreciate when i see both people on bike wearing helmet on the road.

I wear helmet even when I ride a bicycle; wouldn't think of riding without it.

Also, when I bought my motorbike, I immediately got a helmet which was worth 8k+. All my friends were making fun of me at that time for "wasting" my money.

People are ready to invest 1L+ in getting a motorcycle, but can't invest in a decent helmet and body protection gear? Idiots. They also think it's kind of cool. The only way to tackle this is to shame them for being idiots and take away the "cool" factor.
 
The police are just following the law. How it is interpreted is up to the judge if and when this goes to court.

This will probably be used in case any insurance/compensation etc is involved. A helmet would have increased her chances of survival by a lot, but the root cause is still the pothole.

I feel sad for the family as this could have been handled a bit more sensitively.
 
In Pune i have seen people "remove" the rear view mirrors from motorcycles because it is cool. Worst people IMO.
 
OK, not wearing helmet is an offense and that woman paid it with her life. What about injuries or death after hitting /avoiding a pothole not due to injuries to head ?

So, when those potholes are going to be filled up ? Is there a chance for a legal approach for filling potholes or warn about them within a stipulated period of time. Rather than blaming individuals alone, it would be better to have a framework to avoid such cases in future.
 
IMO the bizzare factor maybe due to the timing and also may be due to slow pace of police action in many other cases. But yes, for insurance part this may be necessary.
Also, not sure, but does police has to file FIR for every accidental death if the rider is not wearing helmet ?
 
Same here . When I bought my maruti 800 in 1996 . People made fun of me for wearing seat belts . Now its compulsory . Even the sales man back then did not know how to put on the belt. I opened the car manual and followed instructions . Way back in 96 . Don't regret it till today . Even when I would take my daughter to school she would be in the back seat strapped to the child car seat . Even my latest car now has Abs and airbags . Safety first .:)
 
The place where i stand every morning for my office bus, there is a school nearby, i see several parents taking their child(ren) in car and in most cases, the child is not strapped and is doing random things in the car (not being seated).
