Dell refunds Vista and Works license fee - Odds and ends

people in UK, Germany and the Netherlands have managed to get refunds from dell so far.
what i basically need is for someone who purchased a dell lappie recently/is about to take delivery of one in the near future, to tell me something,
just after you turn ur lappie on for the first time after taking delivery, are you faced with a Microsoft EULA screen? Yes or No? that is the question. Coz, if the answer is Yes, and
a. you use an alternate OS and dont require MS Windows
b. you already have a retail copy of Windows and dont need another copy of Windows,
you can legally ask dell to provide you wiht a refund for the software.
this needs a little bit more of clarifications though. me and a collegue of mine just spent a few mins with dell on the fone, and they were like this used to be an option earlier but as of now, there is not eula screen which a customer needs to accept.
now that sounds like FUD to me. they legally CANNOT thrust the OS on us without showing the licensing agreement(or so i assume )
so if anyone can clarify on this. would be awesome
