Market Feedback Got a product from pratikb not as described

I had put up a WTB thread on TE recently asking for a screen protector & case for Motorola Atrix. Mr.Pratik (pratikb) sent me a PM saying he had the original Motorola rubberised battery cover "unused" for the Atrix. After negotoating we agreed on the price as Rs.400.

I asked him to send me a mail with the picture of the cover to which he sent only one pic that too of the inside of the cover. I trusted him & believed the back should have the motorola logo.For all my dealings on TE, I've never had issues. People are generally honest. I agreed to buy & paid him via NEFT.

When I received tha package 2 days back. I saw that this is not the rubberised battery door, in fact this is a snap-on case whish I would never use. Also 2 of the locks were broken on this. This thing is useless for anyone now.

Now when I ask for a refund pratik says all sales are final & no refund will be give. He has a scratch guard for the Atrix & to cut my loss I asked him to compensate by sending the screen protector. Now his mails even sound rude to me.

Some points to note here:

1. Sale was for a battery cover & what was provided to me was a snap-on case which is available cheap. This is how an original looks like http://www.mycellworld.com/Motorola-OEM-Rubberized-Battery-Door-Green-P124527295-P90600.htm. Attached is the lone picture provided to me by pratik.

2. Product was supposed to be unused, on mail Pratik says later it was used one or two times & is in mint condition.

3. Sent me only picture of the inside. I really should have asked for more pics but see what faith does at times.

4. I don't have his cell no just his email id.

5. When I ask him for the screen guard since he doesn't want to refund money, he says you are trying to extort scratch guard for free.

I still maintain I saw only one photo and trusted you without seeing the back photo that it was original Motorola. If I had seen the back I would have never taken it. I believe people are generally honest and that's how I make a lot of my day to day decisions.

Also what makes you think I will try to extort a scratch guard from you. I'm an old member on TE and this is the first time I've had issues with a member.

You clearly had an intent to deceive when you sent me only one photo. I don't even have your phone no, we clearly see who is more trustworthy.

It's original AT&T bought scratch guard which is far better in quality than amzer and it's just one scratch guard as I have already put one on my phone.



You seems to have damaged the case. As I have sent case on bubble wrap and properly packed which rules out any damage in transit. I had packed it well and more than that I have confirmed that case had no damage



You can not compare amzer scratch guard to anti glare and anti fingerprint screen protector which is made my case mate and sold by AT&T which takes far better quality control on what stuff they brand and sell with AT&T name on it.



Be rational and solve this amicably.

I did use it for one or two days.



and to be honest with you, you had almost 4-6 days with you till I sent it to you.



I had sent you picture and after 6 days or so I mailed it off due to my busy schedule.



also when I packed it and sent it you ,I clearly checked it for any damages and found it in mint condition.

i shipped after almost 4-5 days of sending him picture.

and on another note,i had sent him cover in bubble wrap and i thoroughly took care of any in trasnit damage.

i have sent the case after I confirmed it has no damage and it was absoltely as it came to me.

i wont take case which is damaged.

last but not least I have my own hospital to run and i reply as quickly as i can.,that does not mean i sound rude and if i reply in short is not rudeness.

whatever senior members decide we will finalise.

and OP---MAKE ALL EMAILS IN EQUAL FONT AND NOT SMALL FONT.

pratik, it was never about the time. from the one picture i received it looks ok. you said it's an original battery cover & it clearly is a snap-on case & not even original motorola, hope you understand the difference. this is my biggest grudge, the product is not original & it is not a battery cover.

the packing was fine, but the fine locks were damaged looks like from previous use which was not mentioned by you before sale. you clearly stated it's unused.

i can understand you being busy with your own hospital but that doesn't stop you from being courteous. in your mails after selling the product you mention all sales are final, no returns will be accepted. this is not the kind of environment i'm used to on TE.

regarding the font size, i have copied & pasted mails from my mail account. difference in font size is not on purpose.

I have nothing against both of you but had my couple of questions and my own opinion about this -

#yogeshtulsiani - why dint u ask for anything pic which clearly shows you the back side?? The current situation would have been easily avoided if u have been patient to ask for the second pic.

#pratikb - I dont see any answer from you on the question posed about the quality of the back cover after the buyer received it. When asked about if it is original, your initial post was that "yes it is". But when the buyer received it, he finds that it is not and when questioned u only excused saying you cannot transfer the money back and will compensate by giving away the scratch guard. I think its not the right way to deal in TE.

BTW, whats with the font, if the font is small, we TE users are still sane enough to zoom our pages.

Well, from the pic it looks like a snap on cover, and not like a battery door cover. If the buyer bought it after seeing that pic, then he clearly didnt bother to check what the product was.

Also the seller has also taken advantage of this fact and has clearly stated in the PM that it is "original", its a battery cover and its "unused". Well, all three are untrue...sad...

Anyway I hope pratik/yogesh realise that TE or any other forum is a place for like minded people to come and share their experiences and thoughts on a common topic. The market place is there to benefit one and all and deals like this is what hurts the reputation of the forum as well as online dealings as a whole.

Anyway, bottom line is that the seller is completely wrong and on top of that to turn around and say that all deals are final, with no refunds???? Thats just not fair and to top it off its highly unethical/unreasonable. Its not like you are running a business/shop to have such strict policies....come on man, this is one on one dealing in a community market place. I have taken back lots of stuff at my cost from people who never understood what they bought...never complained anywhere, other than to make it clear that I would return the money, but would leave a negative feedback.

But in this specific case, you have obviously mislead the buyer (if the PM's are true) and thats not done buddy.

#pratikb the number of pics is not the concern here. I am afraid the way NOT ORIGINAL stuff has been sold after tagging it as ORIGINAL is what people are bothered about. Besides, its not the buyer who asked for the scratch guard as a compensation, instead u offered it and the guy was too plane to take it and cover his losses which of course you dint eventually manage to ship.

PS:: ORIGINAL might just be a word, but its easy to find out if it is or not irrespective of the item. So be careful while using it.

no hard feelings anyone.. but #pratikb, dont you accept that the only reason you might have posted only 1 pic from the backside might be due to the fact that you realized the product that you have is similar to the one which was demanded but in all understanding, not original as the buyer had emphasized???

if you realize this, then there should be no reason for you to argue. you should play fair. you are arguing that the buyer saw the pic and bought it, but as you posted 1 pic, the buyer put his faith in you just because of the reason that we are all members on TE and definitely not looking for this kind of attitude. please dont highlight again and again as if you've done the buyer a favour and been grateful to him that you took time off your busy schedule.

Both of you had mutual interest in the transaction. so please dont try to sell that kind of crap about you taking time out of your busy routine.

the reason people trust each other on TE and make one on one selling and buying like this possible and a pleasant experience is the very attitude of all the members towards each other that we all mutually like.

this kind of attitude of yours makes us feel as we are purchasing from some grey market dealer in mumbai or palika bazaar in delhi.

if you do realize in the back of your mind, that in all sanity the product was not like the one the buyer had demanded but only similar, and bought it because he put faith in you, because we are members of a common forum, please be a gentleman and accept. noone holds any grudges against each other, but please show fair treatment to the one you've wronged. it might even be that you may not have fully understood what the buyer demanded, but then if even that is the case, its not for the buyer to suffer the loss.

no one here can force you if you dont want to play fair.. but one thing that can be promised to you is no matter how old you are on this forum (and not too old, you just joined last year), this kind of behaviour will reflect heavily in a negative manner and you definitely wont have any transactions on this forum. all the members who are aware of this, they see one more classified from you and there will be dozens of comments and posts warning all the potential buyers.
