I've seen a lot of people rating their products for sale 5/5, even though they are a year old, and hence cant technically be 5/5.

Maybe there should be action taken against such people?

I think any product which is not sealed pack should not be rated 5/5.
Many a times people say opened for checking and such but still it is technically not sealed anymore.

If there are no scratches/smudges and the product is in pristine condition(used for 1-2 days and never used again) why should it not be rated at 5/5? It is brand new to say the least.

1 year old products should not be rated 5/5 but in my opinion, rarely used products can be rated like that.

You see most people perceive that once opened a package is no longer new per se. Probably you are comfortable with people doing that and also buying a product but most people i believe aren't. At the most such people can rate less than 5 and state clearly it was used for couple of days and whatever else they want.
At the end it is psychological.

I think they state in their post that they have used it for a few days.
If they do not mention it, that is unethical and I do not support that.

Sorry to bump an old thread but can't the number rating system be changed to something like this:

Product Condition - Choose One (Brand New and Sealed / Opened but unused / Used / Minor Defects - Please specify / Major Defects - Please specify) : BRAND NEW AND SEALED

This could be formatted better, but you probably get the idea. I feel like this makes a lot more sense than people going with decimal points here. What does a 4.75 / 5 even mean?

Opened but unused is a term that is abused a lot in the market. People claim their products have been unused for months, i understand there might be a few cases for which this is true but not all. (Just my opinion, feel free to disagree)

Yes. Unethical people will always find a way to abuse the system. However, in this case, you still have the actual purchase date of the product to go by. For example, a product that's been lying unused for 6 months vs something that was delivered recently and opened for checking.

In any case, the most important thing for a buyer is to look at clear photographs from as many angles as possible.

Yeah and some people think that because it has no scratches it should be 5/5 . How dumb is that. How is your battery life degradation compared to when it was new. How has the product survived the upgrade i.e. ios 6 to ios 7. Is it as smooth as before as after the upgrade? Is the Micro usb port as tight as it used to be? IS there any looseness with respect to the port or the back cover etc .If you say not to some or all of these qs , how dare you rate it 5 on 5.

5/5 is related with the condition of the item.
So even if used it can be so if it is just as he/she would have got.
I will not say putting 5/5 as condition for an item that has been opened to check is an issue. (if it is clearly mentioned as opened).
If an item even after 1 year is in same condition as an item you receive from market right now, it should be able to give 5/5.
So giving an item 5/5 is valid in any situation if the seller feels its justified. (Doesn't mean every seller should just blatantly lie and mark every item 5/5).
As ashrr mentioned, its upto the buyer to make sure the seller is truthful in it by checking it through photographs and any benchmarks.

My dads desk has that perpetual motion pendulum thingy which has been there for quite sometime.
It looks the same as the day i first saw it ... maybe because it just sits there and noone notices it.
Still its out of box and "used" .. but it can be said 5/5 ... well some dust maybe there which can be polished off.
Maybe other things like this.

Looks like this.

The things that the members sell here are mostly mobile phones/laptops/tablets etc. These are items which are handled regularly and hence is not similar to the one which you posted above.
