There is nothing wrong in making a profit of a personal sale. You buy something may be even two or three, you feel you don't need it , you sell it off maybe for a profit and you are done.
When you buy 10 items to make a profit, advertise them online, sell them off as is in the same condition, buy another 10 to make a profit and advertise and sell them off, pay 10 people to buy for you and then sell them for for a profit, you are not making "personal sales" any more. you are running a business and when you don't have the authorization of the brand owner, you can be sued because your unauthorized sales for lower or higher prices can effect the reputation and ability of a company to make legitimate sales.
Parallel imports are (apparently) legal in India though they are not in many other countries, so import the same phones from china and sell them for 500% profit and nobody needs to care.
Flipkart made a deal with Xiaomi to sell their products officially in India and Xiaomi authorized them to be the sole reseller in India.
Anybody else who procures retail units meant for the Indian market and advertises and sells them though public channels to make a profit is in the wrong and these companies can initiate action for that. In fact Xiaomi can probably even sue Flipkart for allowing the products to leak to unauthorized resellers and the subsequent brand tarnishing that they received due to it. Its just that companies don't often go to all that trouble. They make do by denying warranty for any items that they deem to be resales though unauthorized channels.
In fact several online market places and retailers have been lately getting flagged for either indulging in or allowing unauthorized resales to happen through them. ebay.in has removed offending sales by individuals running repeated unauthorized resales when notices were sent to them.
Flipkart themselves have indulged in unauthorized selling of their own and have been flagged. Certain brands announced that they will deny warranty and support for products bought through unauthorized channels like flipkart while there are also others who have even initiated legal proceedings against them.There are cases pending against them
Just because no action was taken for wrong doing doesn't make it cease to be one. A traffic police might turn a blind eye to you jumping a signal couple of times or more, but that doesn't mean that suddenly it ceases being a serious traffic violation that endangers self and others.
At the end of the day, no where have I said anything against the forum allowing such unauthorized resales for profits or even for sale above MRP, what I am suggesting that if people who don't like them, they have the option of bringing such sales to the attention of the right channels and if they can do anything about it, let them do it.
