Market Feedback What to do if you get scammed (by God knows who) but seller says "shipping at buyer's risk" on the sale thread?

Don’t buy from them. Although if you file a case in consumer court you will definitely win as it is the seller’s responsibility to make sure the item reaches you safely. How much energy do you have to deal with this is upto you. The seller has no legal standing for selling you a broken item.

It is ridiculous that even new people put this in their sales threads now after the champions have perfected it.

I am very busy.
Be patient.
I don’t know when I will ship.
It’s not my responsibility after I ship.

But what if it's been already bought? Which group should I file the complaint against?
Will FIR do anything at all?

I'm genuinely in a dilemma.

Buy from trusted sellers, or get it picked up locally from them from a reputed person, or try to collect in person.

Was visiting BLR got the 3d printer and xbox locally picked up - albeit i have still not had time to set them up :bag:

Yes.
My second one gone bad.
I don't know if you have such a service in your district in manipur (if you're outside imphal), but is there someone in your community who runs their own private courier? Like as in you can send the item to their home in a metro city (bangalore, delhi etc) then they ship it to manipur via cargo at the airport, then their employees/relatives will personally collect it from imf airport and then deliver it your address in manipur or at their office where you can pick it up. Atleast that's how they ship it to my district in manipur, however now they just ship it to aizawl and then to our hometown (due to events nearly a year back if you know). I suggest you to use such service if you have it instead of these couriers, yes you'll be spending alot on shipping but atleast there's some peace of mind.

No one in my family or my friends in my hometown would ever ship and receive anything important or expensive through indiapost or any other big private courier for that matter. The last time I ever used indiapost to ship stuff to manipur was like 20kg+ worth of books and we only did that because it was cheaper and none of the workers would (most probably) try and steal books. If it's some worthless documents, nothing likely to happen. Parcels? They'll take whatever they can. I don't know how your experience has been with couriers for you in your district but this is how it was for me.

I'm not giving any conclusions as to what happened in your case, but shipping a phone, especially an iphone. I would assume it would get stolen immediately once it reaches manipur. Just my thoughts, not saying that you or the seller is guilty or at fault.

Buy from trusted sellers
This doesn't mean anything, one can be a trusted seller and still have this issue. I've had my 10k package from a reputed known seller switched to a 100rs doll and I had to buy another item from the same seller since he felt bad and gave the second one at a good discount.

He and I both filed a complaint in consumer court against shiprocket and Amazon shipping but nothing happened. I learnt it the hard way to use reputed couriers like bluedart or deal locally and to never deal with people posting shipping risk on buyer in any platform.

From what i think this is happening now a days. When shipping using Shiprocket on the paper which has the details of buyer and seller there are details of the consignment also and with amount specified in there. It maybe very well that a seller doesn't checks this as it is a very miniscule detail but those courier workers can use this detail and take out the original item and replace it. I myself started to hide that detail when shipping via shiprocket as if u ship directly via the courier the item details are usually not mentioned or if mentioned then not that clearly. As they put those details in there system. But i guess from now onwards i will be making packing videos whenever selling and because of this very issue people here started putting shipping risk on buyer as shiprocket doesn't honors the insurance for used or resold electronics items but sometimes do also.
A very valid and good points raised.

I did not know the context here, its been quite sometime I have seen courier fraud.
Depends on what proof you have (an unboxing video etc) before you can decide which party to pursue.

Pls add a link to the concerned sale thread in OP for context.

Thanks to @vishal_k for tagging me to the thread.. would have appreciated the buyer to have done it himself while creating it..

I see judgements or opinions outside of buyer’s questions already being posted..

To all who have questions on “Shipping at buyers risk” - It means that if you foresee any risk or don't want to take any chances, please opt for insured shipping (paid with a partner of your choice) at your own cost. Almost everyone requests for shipping free or included in sale price.. courier insurances are a hit or a miss and in most cases require purchase invoices too to prove item value. I do realise that this statement might attract negative sentiments but thats the reality…

All my past 2+ year shipments on TE or otherwise personally have been sent via Delhivery standard and everyone has received them safely.. some of the items even 5x the value of this one and never faced any issues. As @vivek.krishnan mentioned, its been way too long even for me to have come across a shipping fraud…

Coming back to the main topic.. here are the facts of this sale:
1. Buyer enquired for the phone and details battery change related topic, asked for details including a 100 to 50% battery drain test while playing youtube (5+ hours), all of it was complied

2. We arrived at a price (incl. shipping) shipping partner and mode (Delhivery Standard) was communicated to the buyer for the agreed price

3. Payment was credited to me the next day 13th March and shipment was booked with Delhivery(Express), shipping label with address details and shipment value(1000/-) were shared with the buyer

4. Package was an Amazon cardboard box with contents including two cases kept next to a bubble wrapped and brown taped iPhone 11 box (iPhone 11 itself, apple 5W brick, black sleeved third party lightning cable and apple booklet). There was no pre - existing brown tape on the box except the standard Black Amazon tape.

5. Shipment history(the ones that i felt are important):

A. Shipment was picked up on 14th March 2:48PM from my home(Thane)
——> delay of 1 day in next scan at Bhiwandi which is on 15th March 7:21 PM

B. Shipment was received at destination delhivery centre on 18th March 12:16 PM
——> next instance of delay of 2 days as it was physically picked up by buyers relative/friend on 20th March 9:25 AM from the delhivery centre.
During this time the buyer also tried to pickup the parcel on 19th March but the delhivery centre didn't handover to him.

Note: Buyer’s unboxing video is in 4 parts and not a single E2E video. I am myself not convinced on the whole unboxing video capture tbh.

Assuming nothing went wrong on the buyers side, Theft in transit while it was with Delhivery is the only possible situation here and my recommendation is for the buyer to pursue the possibility of something that might have gone wrong in point B and i will do the same for point A.
We both will have to take necessary steps to do all thats possible towards recovering the phone.

@iPwnz please feel free to clarify or correct any details if i have missed or misrepresented.

Note: i am typing this from my phone sitting in a remote location today and tomorrow. I will only be able to take any steps on Friday or Saturday after i return to Mumbai.

Also as i took the time to type details of this message, upon checking imei checker websites, the devices activation lock is ON which means that someone has already started using the device with their apple id.

I have unboxing videos but I'm afraid that it's not going to prove anything. And I don't want to throw accusations either.
I usually take great care when buying. And it so happened that the seller in this case had high positive feedback hence.

@vriship like I've said on WA, the unboxing videos while not ideal, are all clean and package untampered from my side. The box was picked up by relative since it's closer to the office and when I was informed about it I immediately left for their place specifically to do the unboxing. I did this with my other purchases just in case and they all went well without any issue.

If there's any way to check the activity of the phone digitally online (like track it's location using tower signal and IMEI) it would be splendid and it would also prove my innocence here. My heart sunk when I opened the main box and didn't see what I was hoping for. That was when I texted you on WA.

If any crime was committed then I believe that it would be at Mumbai office or in my state, one of the two.
Also I'm honestly not sure what to do about this or how to even proceed since I can't pinpoint the exact source of the crime. Hence the thread here and I didn't want to mention you as the seller out of goodwill.

If I could have a wish granted here it would be for the phone to return to me as I believe I'm in my fair right as the new owner being the buyer.

Yes there was such a service but as you know the L&O.
Anyway I think that incident like this can happen anywhere regardless unless it's personally inspected and brought by friends/relatives directly to you.

Mate, just to be clear, i am not raising any fingers either… as i mentioned, i am really not sure if that kind of an unboxing video will help in any way. There will be obvious contradictory questions raised by any third party. Hope you would agree?

We are on a public forum and details of the sale, device, seller, etc could hardly be kept in isolated. Nevermind..

@iPwnz; if you pressurise the local center which received the bag to show their cctv footage from the time the bag was received and until it was handed over to you today, it should help clarify if it was that office where the theft occurred. A complaint in this regards should help drive the pressure for them to investigate.

Personally I have sent laptops worth couple of lakhs to other metro cities through Delhivery multiple times. I now get it why people don't ship packages to North East. Not pointing any fingers on OP but I think the courier guys who delivered the package are responsible.

Does anyone have any known reasonable service to determine the logged in apple id via a device serial number?

I wish i would have forgotten to remove the apple id and left the find my iphone enabled.
