Section 378 of the IPC only deals with theft. It does not make a distinction between theft of Cellphones/Computer Hardware and theft of other articles.

So, if your Cellphone is stolen, it is beyond the purview of Cyber Laws. It is a routine theft that has to be handled by the police station that has jurisdiction in the area where the theft was committed.

But, if you have some personal content on the cellphone (like videos, photos etc.) and you notice that the same has been or is being misused by someone for committing cyber crimes say like posting your data online with or without blackmailing you, then you may approach the Cyber Crime agencies.

Remember, even then, it is not their duty to find your cellphone. They can only take measures to catch and punish the offender who misuses your data. In that course, if they find your cellphone, you are lucky!
 
Oh nehal thanks, you remember my last case - where a guy from E cheated me. Now i am thinking of logging a complaint in their kolkata site, i mean here "Cyber Awareness Campaign :: Kolkata Police".
Is there any chance that it will work?

Hi... Sorry... I am not aware of the exact case facts... :ashamed:

Cyber Crime cases (or any cases for that matter) are not easy to crack down in India. Especially due to the reluctance of the Investigating Agencies if the matters pertain to small amounts or are of a seemingly negligible nature.

You need to keep pestering the authorities to get your work done if they go slow due to it being a trivial matter according to them. :(

If the amount involved is worth the efforts, you should definitely go ahead with it.

@ Others: I am not discouraging CA50 from seeking justice. Nor am I promoting cheats. I am just laying down the facts as they are. :|
