Ebay.com Query on Claims

So I had ordered couple of items from US Ebay.com and it didnt show for 2 months.
I asked the seller what to do now, they said the package was fully insured and I can claim that I never received the item and get full refund on my Paypal/CC through I which I had paid them.
So I sent them a signed claim form and they reversed the payment to my Paypal/CC.

Now in case if I get the items in future, should I accept the package or refuse. Its not a moral question, its for legal purpose. Please see the claim form attached.

Refusing the item means it will never go back to US, and will be taken by Indian posts as USPS mails are delivered by Indian Posts. So, better accept it. If you want to be morally correct, msg the seller after the product receipt and pay him outside ebay.

But in case you pay outside ebay keep a record of your payment.
 
I had bought from ebay of cost $150 (some 3 years I suppose). Similar thing happened. I got my money back and later I received the item. Paid him off ebay (via PayPal) and he was very happy saying Indians are very honest lol

So accept the item and pay him via PayPal etc. and also not sure legal rules of US would apply here too.
