Ebay scam, please help me fight against them. (Bangalore people please peek in)

I listed an item eBay India: Transcend JetFlash 64 gb USB Pen Drive (item 250752856173 end time 16-Jan-2011 04:51:47 IST) on 06 Jan, 2011 04:51:47 IST. As you can see I've have mistakenly putted wrong title but right description. And luckily 3 buyers bought the same on 6th Jan. I messaged all of them that I mistakenly wrote that title, so if they want refund then I'm ready for that. Out of which one buyer said that he was specifically looking for 64gb pen drive not a 32gb one. So I created a special listing for him eBay India: Transcend JetFlash 64 gb USB Pen Drive (item 250753127967 end time 16-Jan-2011 21:49:47 IST) on 06 Jan, 2011 21:49:47 IST. I initiated refund for him too. On 13th Jan, I shipped all three orders, and provided shipping details for same on ebay. Details for shipment to the buyer "smmc909" were as under :

As you all can see that this item was received by buyer on 17th Jan which was under ebay's timelines. Now on receiving buyer called me up and told me he got an empty packet. So I thought may be courier guys have done something with it. I asked buyer to send me the pics of package he received. On receiving the pics I asked him that the newspaper packing that I did over it was tampered or untampered. He said that it was untampered. Which clearly states that buyer made a false claim. Now he has asked ebay that he has not received the item so he initiated refund for himself. I called ebay on the spot saying that I've already shipped it. They told me that they'll appoint a claim adjuster who will listen to both the parties and will take the decision. I waited for the claim adjuster's call for more than 10 days. In the meantime I kept on calling ebay customer care asking them for claim adjuster's contact number so that this issue can be resolved asap. But they denied and said that they'll set a reminder for claim adjuster. I set that reminder numerous times. Instead I got message from ebay stating that they want POD(proof of delivery) latest by 29th Jan. So I rushed to DTDC office and asked them for the same. They told me that they'll get POD after around 15 days. So I've to wait for 15 days. I told them that its urgent. So they said that I can show online tracking as a proof and that online tracking can also be used in court if necessary. So I kept on calling ebay about making the claim adjuster call me. But all in vain. Today I called them atleast 3 times telling that its urgent. After that claim adjuster called me. He straight away said on my first call that buyer has initiated a refund since he didn't received the product. So we are approving his refund. I was like :(. I mean how can they even say that without knowing my point of view. When I told him that why he didn't listen to me before even saying that, then he calmly listened my points. I told him complete matter with nothing hidden. He said that according to ebay's terms and conditions they have to refund the money. I again and again told him that I've sent the product then why claim. I told that buyer has also signed the POD. So they said give us the POD. On which I told them what DTDC told me. So he said that under ebay's terms and conditions they can use online tracking as the POD. They want specifically scanned copy of it. Later on during talks, claim adjuster said that was it a genuine pen drive. I was like : WTF. I told him yes. He said he can arrange a 128gb pen drive too(fake one). I told him that that I too can arrange(fake one) from palika market in Delhi. I said I even can arrange a fake 500gb pen drive too. Then he said that no 64gb pen drive exists till now. :S After this my words were, "I think sir you are a noob. You lacks technical knowledge to much extent. For your information, 128gb pen drive(genuine one) also exists in market." He asked me for the purchase proof from merchandise and proof of dispatch. In my whole conversation of 30mins with him, he stated 10 times that he gonna approve buyer's claim. To which I repeatedly asked him that to prove my point I can show you the documents you asked from me, but can buyer provide me a single evidence that he didn't got the product. I told him that according to rules and regulations of shipping company, buyer or receiver needs to verify the contents of package before signing on the POD. To which claim adjuster said that courier guys don't wait till we open the package. To which I said that if you ask them then they have to wait, they can't go away until you sign the POD. After saying all this he still was taking buyer's stand. At the end he told me to submit the bill and proof of dispatch and they'll look what can be done. But the tone they were using was clearly saying that buyer will receive his money.

Request form you guys:
Please help me to win this claim on ebay and tell me all possible things that I can do to prove my point. I can't loose this amount else I would be under heavy debt. :(
And also tell me if any bangalore guys can help me in this regard. I can share buyer's details with them. Please please help me come out of this mess.
 
Well..

What the claim adjuster said is true(a. fake drives are there b. no one opens pack before signing c. buyer will receive the money). :(. And i think ebay is pro buyer nowadays so no surprise there.

There is no peer pressure in ebay like in TE market feedback section.

Actually ur part of who took the drive is not clear for me. Courier or buyer?. And what abt the newspaper. that part is also vague. u mean the paper was used to cover the drive?

And ps. for people being cheap/asshole/jerk/prick/douche like ur buyer dont think much can be done mate.:(.

first it is a pretty grave mistake to give wrong specs in the title. that sets the first impression of doubt towards you as a seller though it's a different listing. secondly, you were bad at negotiating this matter with the claim adjuster on phone. thirdly, it's pure rotten luck that you are not able to arrange the POD hard copy in time.

I can understand how much loss and frustration you may be suffering from but the benefit of doubt is always given to the buyer in these cases unless you give the proof they ask for i.e. bill and pod copy.

only one thing you can do now, as they say submit the bill and pod. I think it's the courier guys who have stolen the drive.

I know that there are loads of fake drives available but that claim adjuster was saying that no genuine 64gb pen drive exists.

According to me, its clear that buyer took the pen drive since he confirmed that the packing that I myself did was untampered.

Please give me some tips then, that how should I negotiate with claim adjuster. I would be really thankful.

Secondly, I can undoubtedly say that buyer has stolen the pen drive as he has confirmed that packing was untampered.

They are not accepting online POD as a proof. :(
 
if the buyer is lying about the pen drive why do you think he will tell truth about the packing. and how you can be so sure that the package can be easily recognised as tampered with or not ? the courier guys are pros in stealing.

regarding negotiating, you don't be rude and call the other guy a noob and point out his lack of tech awareness though it may be a fact. you should have said that you also understand that there are fake products available but it was not the case here and you can provide bill and pod, then you should have asked time extension for submitting pod copy as dtdc takes 15 days to give the pod. and how do you think that the buyer can prove the absence of a product ???

IF the buyer were really guilty, why would he claim that the packaging looked untampered. That would the last thing any cheater with even a bit of common sense would do do. Why would he complicate this own situation. To me the statement of that fact is an indication of innocence. I hope you do realize that it would be quite possible for a courier guy to open the packing and redo it again in such a fashion that it looks untampered to anyone but the originL person who did the packaging.
 
^ That's one of the main reasons , I sign the package on all the corners where it is sealed with tape and also inform the buyer not to accept the package if the sign /seal is tampered with :).
 
Well first you try to find out who is culprit here. As per above posts buyer may be innocent or he may be purposely complicating things telling it's untampered and so that everyone can think it's courier guys fault.

Well I don't know much about ebay rules, if I were you, I'd have called the buyer (or courier guy), telling him that "I am going to Police filing case of theft against courier guy (or buyer) as I am in business from many years and I know people quite well. And you have to support me suing against them." They will be surely scared IMO. Okay I may be idiot giving this suggestion
 
In all this, did you get in touch with the courier guys? Tell them what has happened and also drop a hint that since you don't know who's speaking the truth, you propose to file police complaint against both the courier and the buyer.

Arrange proof of dispatch, declaration letter to courier company with stamp and CN, merchandised bill and POD if possible, send scanned copies ASAP. Otherwise be ready anytime to receive mail that the refund claim has been approved in the favor of buyer. THE END

thats what i was always afraid of on ebay, what if the buyer says " i have not received the item :( "

thats one scary thing.

Sorry OP ,

the only thing you can do is show the claim adjuster the POD, original bill of purchase and the receipt of dispatch.
 
The exact same thing happened with me when I sold a cellphone one ebay , I didnt provide the bill with the cellphone because I dont own a shop , I got that from grey market , the buyer decided to take revenge in me and said he has not received the courier , and ebay CC asked for proof of delivery .

I went to dtdc office , dtdc guy told it takes more than 1 month , I said WTF in front of him :)

and he cald the head office in bangalore and asked for scan copy from them, they received the scan copy from MUMBAI within 2 days .

you can try this method ..........

This is the one and only way to get the Proof of delivery within deadline and one more thing dude , if you are having less feedback they always trust the buyers only :(

just call dtdc head office and tell if they cant provide the POD within time you gonna lose some money and force them by asking for at least scan copy

Actually reverse happened to me.. A seller from Pune sold me a local mp3 player with 4gb memory...formatted to only 256mb. That time ebay effed me up, too many delays and even after 1 mth of haggling insistence on mutual agreement.

Lost 4k buck + a negative rating..next thing I know the seller was nowhere to be seen on Ebay.

The bad rating part made that guy look genuine. Messed up my profile rating, something which can never be reversed. For that I never bought anything on Flea-bay for 4 yrs until recently.

I wud say do what they ask and Hope for the best. :)
