Review EBay Seller Not responding [Kolkata]

I had purchased a brand new HTC One X phone from a very reputed seller on ebay.in (1000+ feedback), who goes by the name of "onebazaar" :http://myworld.ebay.in/onebazaar/?_trksid=p4340.l2559

He is based in Kolkata, his physical address is :

Onelife Digital,
CITY CENTER 2, STORE NO C0013, GROUND FLOOR,
Plot no. AA-2D/5, AA-2D NEW TOWN,
KOLKATTA- 700157

Below is what i how i have suffered at his hands. .

1. Firstly the seller shipped the item after 20 days which was a violation of the ebay policy itself so i had lodged a complaint for it which was closed later . .
2. Once i got the phone, it was broken and the seller had to take it back from me.
3. I got the replacement phone after 10 more days passed, seeing which i did the seller receipt and his payment got processed.
4. After only 3-4 days of usage the phone started giving problems and was turning off again and again. On contacting the seller, he said that he will repair it as it was under warranty from him. (1 year seller warranty)
5. He promised to arrange a pickup but did not, even after 7 days of waiting.
6. I sent the phone to him on my own cost.
7. It has been 45+ days since then, and the seller has not returned my phone, he does not answer his mobile number (i have 2), the contact numbers i got from ebay are wrong numbers, he has blocked me whatsapp and does not answer his messages.
Whenever I am able to contact him , he will give some excuse of festivals or engineer not being there. .
8. I cant even leave a feedback for this deal as 60 days had passed in this whole transaction. .

This seller has sold me a product of 20,000 rupees and i havent been able to use it for more than 90 days now.

What options do I have

Can someone who stays in new town help me out ? He still has my phone and does not answer my calls. .
 
It was your mistake. Ebay would not do anything for you.
Every one knows here: Seller warranty=Gray Market item=No Warranty.
You are now trapped, now wish everything goes well, you don't have any other way left.
 
I know that shopping mall - City Center 2.
All you can do ask someone (any friend or someone here from TE) living near that area to pay a visit to that shop to try to resolve the matter.
Ebay won't help I suppose.
 
Different city seller warranty is as good as no warranty. Try people who live in that area to personally visit the shop and resolve the issue.
 
This why u don't buy items on seller warranty.

Especially atleast don't send items back.

Ebay is helpless, whom to believe.
 
I took a risk.. First time an online sale has gone wrong.. Usually I am carefully about these things..
I'll try and find a contact in kolkata.. If anyone here knows someone, that'll be great ..

Yes seller warranty means, no warranty can be claimed from the company. Seller on his own risk is providing warranty, which probably has no meaning. Because there's no legal case in these type of cases.

Seller will simply say, I didn't gave any word to the buyer.

You can claim damages with interest from the day of your purchase in a Consumer Court by providing all the relevant details and bills that you have been duped into buying a fake phone. Kindly tell me where are you located. Please contact any good young advocate if possible.OK.
 
That might be the final resort.. however the phone was not fake.. it had a manufacturing defect only..

I stay in pune.. i have contacted a few people to go and talk to the guy at his shop.. lets see..
 
You can't go to Consumer Court because it was a gray market item and I don't think seller would have provided a proper Tax paid invoice.
 
Why don't u file eBay guarantee. As its past 30 days, go to purchase history and on right hand side of the item purchased, click resolve a problem and write your complaint there.

Most times complaints there are converted to eBay guarantee claims, even if its past 30 days.

This is why I never buy from ebay . Even if it's cheaper than elsewhere . Flipkart and ws retail work well for me . At least I know when something goes wrong they won't wash their hands off me . They have a reputation to defend .
