Filing a case against ebay and Paisapay

Hello guys,
Please help me with my problem. I sold a mobile phone on ebay.co.in. Since the buyer was based in Chennai, I delivered the phone in person to him. He also confirmed that the receipt of the item on Paisapay on his tab in front of me. This happened two days ago. Today , I got a call from ebay stating that they need a physical receipt to release the funds held in Paisapay. I have told them that the item was hand delivered and have asked them to contact the buyer to confirm. They are refusing to accept this and have frozen my account. What are my options here? The buyer has agreed to confirm the receipt of the item. But ebay are refusing to call him and confirm. Do i have any grounds to file a case against ebay? The item is very high value. Please help me with this matter.
 
i was into the same situation & 2 times, faced too much of problems, but cut to the chase, always have a physical proof to show to eBay, its not that hard to do like get a receipt signed between buyer & seller when a sum is involved when both are strangers. both the times i was into problem a sum of around 50k was involved both combined.

eBay is very particular about documentations, go through their rules & regulations, you can go to court or cops or lawyers but you could not get a simple document signed, since this matter is already up with eBay & all the calls gets recorded & then producing a forged document later will put you in more problem, no matter you go to highest courts or hire top most lawyers, waste of time & energy.

the only person who is going to solve the problem is yourself, buyer got the product & he paid the money, so no where the buyer is in picture, its you & eBay Only
 
If the buyer cooperates, ask him to pay you direct (or return your product) and get his refund from ebay.

Also check the paisapay sellers T&C carefully before considering legal action.

why do you think buyer would want to pay twice & if it was direct dealing, why was eBay chosen in between ???

Thanks for all your replies. I entered a default number 0000000 in the courier details. I did not know that, you should always use a courier for all ebay deals. I thought confirmation of receipt from the buyer is enough. The buyer has agreed to ship the box to himself using my name and send me the tracking details. He has been quite helpful. Will that be ok. Will ebay accept that? Or will they create more hoops for me to jump. The buyer likes the product very much. He does not want to return the product. He wanted to use paisapay since he was using his credit card and wanted to get the ebay gifts. Please reply.

Ebay are very adamant about the courier receipt. They have refused to call the buyer to confirm. Are they trying to swindle the money for themselves?

On the contrary, Ebay is trying to make sure that you are not swindling them. No offense, but it has happened so many times that someone lists his product on ebay, and buys it himself using another proxy account; in the process, he ends up gaining more çoz he has applied discount coupons or coupons for free gifts. Not sure how the courier receipt is gonna help them, but they just want to play by the rules. Hopefully, the courier receipt that the buyer arranges in your case, should solve the problem. Talk to them. LEgally, I don't think you stand a case.
 
I agree with malhotraraul.

But I have seen and also dealt with people selling non tangible goods where no receipt can be provided on trade-tang, ebay.com, etc. I myself was once seller of such stuff on ebay, if you are selling in bulk, there can be a problem providing fake number of number generated by shipping to oneself as they will ask for multiple tracking codes, but yes if its an isolated case, as is yours I don't think there should be any problem. Instead of buyer shipping to himself, why don't you ship him a box or something and provide those details? But its always good to be safe and I would advice to stick with what malhotraraul said.

Thanks for your reply. The same argument was put forward by their customer care team. But i pay 4.5% Paisapay fees and 1% ebay fees, which adds upto Rs1,500. Surely the gift is not worth that much.

They are being adamant coz payment was by paisapay. That covers the buyer under eBay guarantee for 30 days.

Yeah, but gifts like a 500GB HDD which are free with proper coupons, are for 2.5k. So its understandable as to why people would want to send stuff to themselves!

5.5% of ebay fees is around 1500 means the item was around 30k, With the 30k item the buyer gets a 1tb 2.5" external hdd that costs around 3.5k-4k AFAIK.

Can some one share in some info,what if the deal was when there was no offer from ebay........
 
Update: Royally screwed by ebay. They have refunded the money to the buyer. I have requested the buyer to pay in cash, after he gets the refund to his credit card. He has agreed to help on this. Must be quite honest and straightforward. I am so angry with them.
 
^ You must have got a good buyer. There are some absolute moron buyers too. I have had multiple cases where the receipt was 'auto confirmed' after the buyer didn't bother confirming it. This, when the item was delivered within 2 days of purchase. It isn't like these guys don't communicate, they do it only per their convenience. Before buying they have hundreds of questions, but after that, they can't click a simple button to confirm receipt.

Thankfully, eBay sets a deadline beyond which it can auto confirm, else it would be a complete disaster for sellers.
 
Did send a box containing card board boxes by Dtdc. Its useless now. Anyone trying to steal it is in for a nasty surprise.
 
Did not cost that much. I did not want ebay checking the weight.

Update: Customer support from Paisapay have called me. They have reinstated the account and credited my money. Guess, thowing some big names will help with ebay as well.
