Hey,
I noticed that many of the pics on the gallery are taken from deviantART. I just wanted to ask whether TE has got permission to use these images here. dA images are copyrighted by the makers so I don't think it's entirely legal to put them up on the gallery without permission.

Admins please reply promptly.

Hi Deathdart,
Its possible that either the uploader has permissions or he/she is unaware of the copyright status of the image as he/she has downloaded the image from some site etc.

So, it is requested that you could post the links to the copyrighted images in the feedback section or PM the GMods with the links.

Those images will be removed or permissions will be acquired asap.
 
having said that, our policy is that if requested by the copyright holder that he wants his images removed, we will do so.

So you will continue to use the images illegally if the copyright holder is not informed of this?

Redistributing Artwork
All artwork, photography and literature displayed on deviantART is copyrighted to the artist that submitted it, and therefore, if you desire to redistribute the art you will need to contact each individual artist that you are interested in distributing art from, and gain their expressed and written permission to do so.

Direct Reuse With Explicit Permission

Direct reuse of another artist's work is permissible only when you can provide written and verifiable proof that you have been given permission to reuse that piece in the manner you intend to. Explicit permission is a statement made directly to you by the legal owner of the work in question granting you permission to use the work in a particular manner.

An open statement in an anime artbook, for example, that gives anyone who purchase it the permission to use its contents in fanart is implicit permission, and does not satisfy deviantART's copyright and plagarism policy.

An example of valid explicit permission would be asking an artist via email if you may make a wallpaper featuring some of the artwork he or she has presented in brick & mortar art galleries, and that he or she has displayed on his or her website. If he or she replies granting you permission, please follow our official guidelines for providing this written permission for staff verification.

I'll try to find all the images taken from deviantART and posted in the gallery and post the links here.

EDIT: Image full-views have stopped working and I can't go to any page other than the first in a gallery. Clicking on a page link sends me back to the TE Forums index... Is this some bug?
 
what do you mean illegally?
Members can submit images and its expected that they will submit images in public domain. As such TechEnclave takes no responsibility whatsoever of what they submit. However we are bound by our forum rules and privacy policy.

We however will remove any posts/material which is brough to our notice with proof.. and proof is important. that the material is copyright and the author does not wish to have it here. In such case we will remove that material.

You are welcome to try and help us in this and removing any material that is copyright.

Btw gallery works fine for me.
 
Well, the main thing is, its quite difficult to spot copyrighted stuff amidst the images in the gallery. So, unless a person viewing the image has actually seen it before and knows it copyrighted, its hard to detect.
Eg: An image i get from a friend, and upload to the gallery not knowing what the exact source of the image is and if it is bound by copyright.
Same thing happens with anyone who views the image for the first time, unless there is a copyright message displayed with the image at a website where you are getting your images, it is hard to determine the actual owner of the image. Besides, what might be uploaded here can be a renamed copy of the image. Making it harder to search for the original author and image source.
Thus, only if someone manages to get hold of the owner, the original source or a solid proof that the image is copyrighted, it stays here. Besides, the member who is uploading the image here may/maynot be aware of the copyright status of the image. Thus there is no question of TE taking responsibility for the images uploaded in the gallery as Safin clearly stated above.

However, if any copyright material is bought to our notice, we will remove it asap provided the proof is solid and not fabricated.

Help in such a matter will be thoroughly appreciated.

I understand. There's really no way to know whether an image is copyrighted I guess. I did find a few images on the gallery from Digital Blasphemy and other sites (e.g. the Fluorescent Mushrooms wallpaper in the 3d and abstract gallery), but I guess it's not that big a deal anyway.

I'd like to make a suggestion though - please ask forum members to post the source of the images they post on the gallery along with the pic.
