Jail for drunk driving?

Is jail compulsory for drunk driving now? one of my friends got caught for drunk driving last week and was fined 3k and case was registered against him.
(he was caught just after he drank a glass or two of beer and drove for 5 mins from the pub)

One policeman told him to say he accepts the charges and will be let off with a fine. Another says he will be charged for 15 days to police custody if he accepts the charges. Even his lawyer friend says he will go to jail if he accepts the charges. His friend advised him to say that he was not driving under the influence of alcohol, and the case will proceed to the small court from the sessions court. i think if he does this he will be in more trouble than what he is at present.

i find it weird that he will be jailed for 15 days. is this true? will he be jailed for drunk driving if he says he was driving under the influence of alcohol?
any lawyers here can throw light on this?
 
its usually 2 or 6 months in jail, according to real rules and 1000rs fine, since they bribed 3000rs i guess they compensated the jailing period LOL
 
even two months in prison could make a criminal out of a good person!

Well, there is something you can do.... Not Drive Drunk! I do not want to be the guy run over by your friend who was just driving home form the bar after 'a beer or two'.
 
even i wouldn't want to be run over by a drunk, but jailing is too much imo. a warning for first time offenders with a fine of 5k would be enough and maybe suspend the license for a month or two.

That is usually what happens. The law says up to 6 months and any reasonable judge will let a first offence go with just a fine. Maybe it's just the cops scaring your friend to get more money out of him.
 
I understand your feeling 6pack... as your friend had just couple a glasses for beer and that's not something like drinking down half the bar and drive like maniac. But one glass or one bottle, alcohol is alcohol. And that's what cops would say, as long as he was given breathalyzer test and he failed.

I, for one would never support drunken driving even if it's one peg or one glass of beer. If it's not right, you should very well know that it's not right. That's why I make sure that at least one driver in our group is not drinking or if that's not the case then I don't drink on such occasions. Not even a single small peg no matter how much I would like to. Responsibility has it's price. Once you know that it's okay to drive after one glass, you get overconfident and one glass starts turning into two and three and so on. So it's better to avoid temptation.

As for your feelings about the whole Jail and fine for drunk driving incident goes, your compassion for your friend is understandable. It's also possible that he might be getting dragged in for more than he deserved, but he should have known better that drunken driving is something cops have taken very seriously and authorities have been very strict over this matter. Now, if he gets more than what he deserves it's his fault to have commited the mistake in first place.
 
^^agreed. Lets suppose that someone else downs half a bottle and runs someone over. This was his first time.

What do you think should happen to the guy ?
