Market Feedback Misrepresentation ?

Have noticed this a lot of times.

Members advertise their RMAed merchandise as Brand New, As good as New, Practically Brand New even though it may have half the warranty term, lost bill etc etc.

How ethical is it to advertise it that way?
Can they confirm that the replacement merchandise is brand new?
is it hard for the manufacturer to pack the replacement merchandise just like they pack Brand new merchandise? (best example is sealed HDDs)

Isn't is a case of misrepresentation if they can not be certain about this?

imo if the Warranty terms are not like Brand new then it is foul to advertise the merchandise as 'Brand New'.

can this be incorporated in the market guidelines?
 
Its been happening for some time now. Though not all, majority have it mentioned that way. RMAed product might be "Recertified" or "Repaired" but description carries words like "Brand New" n all.

When all that needs to be said is : RMAed Product with "xy" Months of warranty left.

Buyers should press for details as i dont think this can be included in guidelines, as warranty details are already mandatory in the Sale Thread. Its a question of ethics, not necessity.
