I had dispute regarding this following sale thread.

I had confirmed the seller that i am buying it,in the mean time i make payment he says its sold to another person.

how can he give a/c details to persons at same time.

that too i confirmed 100% that i will surely take it.

following is the abstract of the discussion between me and the seller.



Me(TECH HUNTER):I am interested in this.

700 is bit high for the one out of warranty.

I have bought same PSU from another member and it failed in just a week.

so i again need to invest for a PSU.

so low balling.

Seller(Ganesh_2218):My PSu does have 3 year warranty and i can give you the bill. So still 2 years warranty left for it.

Yes my dealer said it comes with three year warranty and im sure.I can less 50 bucks less. MY Psu has been working for 1 year without problems.

I have quoted you 650 with shipping including two types of power connector.

Me: Ok PM a/c details i will make payment.

{seller PM'ed a/c details}

OK payment will be done right now and will be sending a screen shot as proof.

ship it today.

you will receive money tomorrow probably.

Seller: Anyway if you send the Screen shot of the transfer, the transfer can be canceled;only if i see credit i can send it.

Seller:Ur the person who wanted it first. So i will ship it to you after u make payment or i get the credit.

Me:thanks.

funds are low in my a/c.

if i transfer the money i will incur fine.

so will personally add funds and transfer the money at any cost by tomorrow.

Me: Payment done.{yesterday iteself}

should reflect in your a/c tomorrow.

Ship to the following address.

Seller: Sold out to XXXX

cancel your payment.

Me::I said that i will take it and asked you to keep on hold.

i asked many times to just hold for 1 day.

i confirmed the item too.only payment was pending.

you said that it was mine as i first PMed you.

atleast how can you give a/c details at same time to two members.

this is not fair.

Seller: See i ship it who makes me an fast payment i cant go on waiting for to receive payment so why i had sold it There's no mistake in my part.

Me:but i promised the payment,

requested for 1 day time,explaining cause.

you should have put him on hold for atleast 12hrs..

i had hassle of going to bank for adding funds and NEFT you the money overnight.{my pc was dead}

i need it at any cost.

i am in bad need of it.

Seller: sold is sold.

Me: I agree with you that you need not wait or keep on hold but i accepted to pay and taken a/c details.

you can expect to receive the funds by today.

i said if you don't get funds today i have no objection giving to others.

you didn't give me atleast that time gap and didn't trust me.

you can't agree for both at same time.

above things apart,you said you receive payment yesterday noon from him.

i made payment at 9pm.

you had a lot of time to intimate me on PM.

so i would have stopped payment.

you didn't do that.

isn't that mistake from your side?

how can you blame me?

Seller: sold is sold,Item shipped to XXXX.

PM your address i will send MO.

Me: When you PM'ed me that other person is interested,I clearly mention not to give it to anyone.

I am confirming the sale.

I also said ship it if you can,and payment will be surely done.

you played double game and acting immorally.

{many useless PMs between;it's too lengthy now}

I am requesting you with hell lot of PMs since morning,didn't even care for one word atleast ;shipped the item meanwhile to other person.

what are you upto?
 
Holding is the sellers prerogative. Until he acknowledges and gives your a confirmation to deposit money, he is not obliged to hold.

If he has explicitly asked you to deposit money and gives out the product to someone else, it's a gross violation.

He should either be given a negative iTrust Rating or ask for your forgiveness.

Let us not bring that e bay thread in here.

Ebay and techenclave are two diff things in nature and importance.

the way i see it, the seller had mentioned abt the hold and awaiting payment status.

Now until and unless there was any serious problem which arose in this hiatus, the sale to another buyer cannot be justified.

True, the product belongs to the seller and he has the right to sell it to anybody he wants and prefers, but if he had any sch intentions, there are other threads which have explicitly mentioned that its a no hold policy for the trade and from there on in there is an understanding with everybody.

Tech hunter wasnt communicated anything of that sorts and in a way has the right to be miffed.
 
based on ur PMs the seller indeed seems to be wrong. When he first agreed to wait for your payment then he has no reason to ask another guy to make the payment. I do feel that you have been cheated. no rules can guide this. there is something called moral, ethics and trust
 
I have positive dealing will all buyers and sellers till now.

all were smooth deals.

FYI, i usually ship first and accept payment for my sales

still,

I am much insisting particularly for this one because i have very less money,pc is dead,burnt 3HDDs,needs good PSU.

i am investing for PSU 2nd time in just matter of week.

I need to make my PC alive.
 
^cmmon dude a seller can sell it to anyone......its their choice. Unless there is no cash transaction everything is fine.

Please ensure that you get your money back. Also we would like to hear the seller's side of the story before debating what is right and how to deal with it.
 
Yeah, we are missing one side here. From what is known, appears to be a miscommunication of sorts.
 
Lesson for all you out there :

use telephonic conversation once the deal is confirmed and then post a PM as a proof of agreement " Item XXX is being sold to ABC for Rs. 123 - Agreed! "

This avoids the communication gap incase one is offline and brings better understanding between the buyer and seller.

Currently i agree with TechHunter's side of the story if true. And also agree to renegade.

Suggestion:

Incase the seller agrees his mistake, then he owes techhunter 650 + 100 (penalty)

If the seller is old enought to understand that NEFT transfer may take upto 24hrs to credit then he shouldnt have did this. Usually sellers wait till the money is reflected in their accnt even when the scr shot is send. thats just part of good will the BUYER is giving to seller. Not the other way around.

The moment buyer hit transfer the money is gone instantly to seller. no option to cancel it. and thereby the seller is not the owner of the sale-product. He is just holding someone else's property. and he have NO RIGHT to sell it to anyone else. even if it means a guy comes to his house and pick it up. Just coz its not the sellers call anymore.

The seller deserves a NEGATIVE feedback no matter what.

Lol....This thing hppnd to me, wt should i do?
In my case....we had a deal...buyer sent accnt details....i paid in cash calling him after i made the deposit...payment confirmation. Then i got a call later its sold. He sold it to some1 else.....and i got refunded.
 
Few more clarifications:

Seller is well aware that NEFT takes time.

He has given state bank a/c details,I said it will take 1 day and asked if he has CITI bank or ICICI for instant transfer.

But he said he doesn't bank with private bankers

After making payment and giving him confirmation on PM,he says item sold to other.

If that was the case why didn't he intimate me?

I would have not made payment.

he has got atleast 6hrs time(according to his version).

waste of NEFT charges,Waste of time, hassles of rushing to bank immediately.

I understand seller version is missing.

I expected he wouldn't turn up,

so i have copied the PMs instead of narrating.

Not even 1 PM from him past 24hrs.

I suggest mods and admin to look into my Inbox for more clarifications.

I haven't deleted them.

I feel -ve feedback is useless tool.
if one leaves -ve feedback for a person,the other will also do the same.

In sites like ebay the Authorities will look into the issue if wrong feedback is left without proper reasons.
thus -ve can be converted to positive feedback.
I can't see any rules regarding this on TE.

errr if its unfair, maybe in your case if he -ve feedbacks you, can get it reversed by contacting mods :)

Dude seriously.....U havent done any transaction on ebay in a while.

On Ebay

A seller cannot leave -ve feedback whatsoever to a buyer even if buyer gives u a feedback and seller is geniune.

Ebay will not remove the feedback even if its untrue(-ve or otherwise) unless there are links to other sites:S, abusive language.

ANd of course if u havent noticed......ppl bid on their own item to increase prices etc......Creating a fake ID is not tht gr8........ebay precaution is a waste.;)

And ya they will bill u outright if u list a item in auctions and say buy it now price is XXX on the listing. and other endless rules if u have card to read.

And have u called tht "free customer support"-I have for 7 days continiously and no one picked up.

And chat-tht is for decorative purpose.

And email- they will get back to u in a formatted text saying tht they will ask their seniors to look into matter.

Dont beleive me? plz do some research.:D
 
Step 1: Ensure money is refunded

Step 2: If money not refunded, contact mods & leave -ve rating

How hard is that?

I think you had contacted one of the mods and he had asked you to ensure you get your refund as well.

Edit: In the meantime, I would suggest other members to refrain from delivering opinions.
 
Where has the seller disappeared to? I dont see a trace of him around! Perhaps one of the mods should give him an insight into this thread!
 
btw, its a good thing you didnt buy the zebby platinum PSU. they are crap, and I've lost a hard disk and a motherboard due to two of them dying. buy an iball PSU or something. Zebby platinums are just crap psu's with a bling paintjob and fan. In fact, worse than crap, because they will kill other parts of your PC too

get your money back, and get something else. And as long as you get that done, he's done you a favor, really :P
