Windows 10 can be activated using both Windows 7 and Windows 8 product keys.
When you are upgrading your EXISTING ORIGINAL KEY is activating Windows 10.
If you have fake KMS keys, it will get activated with FAKE KMS keys.
But your Windows DOES NOT become original.Your fake key stays and it will get deactivated after 180 days(like it happens in previous windows) unless you install autokms.

Similarly people who were using build 240 and got Windows activated by the tech preview keys,it will get DEACTIVATED after a few months. Dont think you got free Windows!
 
I think Microsoft had explicitly stated Non-genuine windows' users won't be getting free Windows 10 on their blog in May

Pirates will stay pirates, even after Windows 10 upgrade
"With Windows 10, although non-genuine PCs may be able to upgrade to Windows 10, the upgrade will not change the genuine state of the license," a Microsoft spokesperson said in a reply to questions.

"If a device was considered non-genuine or mislicensed prior to the upgrade, that device will continue to be considered non-genuine or mislicensed afterthe upgrade," the spokesperson added (emphasis added).
That explanation followed an announcement yesterday that Microsoft wouldoffer Windows 10 upgrades to PCs running pirated copies of Windows 7 and later. "Anyone with a qualified device can upgrade to Window 10, including those with pirated copies of Windows," the company said Wednesday.
However, another line in yesterday's announcement -- "We believe customers over time will realize the value of properly licensing Windows and we will make it easy for them to move to legitimate copies" -- implied that the Windows 10 upgrades for pirates would not magically transform the license into a "genuine" state.
