USPS item lost in transit?

I had bought cellphone from ebay on 21st Jun 2011 and the seller has shipped the item same day using USPS Express Mail International. Usually i get all the stuff i order from US within 3 weeks max but it has been almost 5 weeks and i am still awaiting the delivery.
When i contacted the local custom clearance dept. they said the item has not reached India. Should i proceed and open an case with Ebay or should i wait for few more days?
The seller says the possible reason is that the USPS/Indian Post people forgot to scan the shipment but i want to act before the 45 days time frame of filing Ebay claim passes.

Yup right time to raise a dispute.Seller would move his lazy @$$ and contact USPS and fix the issue.Did you pay via paypal ??
 
That has happened to me once. Item was sent on 06/10/2010, left US on 09/10/2010 and did not have any updates. It took about 45 days to show up suddenly at Delhi when I had given up hope and I finally got it on 27/11/2010. But, in your case, do raise a dispute.
 
Thanks for the valuable input guys, just made a transaction dispute on Paypal as well as Ebay. Although i really wish i got the item instead of the refund because it was a killer deal. In any case i do hope to receive the item soon, will keep you people updated.

Never never never let the ebay last date item receipt date pass.The payment is processed the very next day to the seller and after that ebay literally does nothing.I have lost 15K on ebay due to their so called buyer protection gurantee .
 
Little update, got this response from the seller:

"Hello We called the International Consumer Affairs department, they opened an investigation on your package. They need 5 business days to contact us back with all the information Thank you "
No idea how does International Consumer Affairs Dept. work, lets hope it is not managed by babu's.

Isnt it seller receives money only after item is received?
 
Nope, that's only for Ebay.in. The American Ebay.com uses paypal, so money is instantly transferred to the seller unlike paisapay here.
