Will an Iphone 3GS from the USA get unlocked and work in India?

My friend is in the USA and I was thinking of getting an Iphone through him. Some queries:

1. Will the 99$ 8GB 3GS be available for him to buy at a store even though its under contract?

2. Will it be able to get unlocked in India?

3. What makes more sense, Iphone 3GS or Iphone 4?

PS: I need details about whether the phone will be available for him to buy without getting into formalities and documentation as such and will he be able to bring it over here without any issues. And if he manages to do so, then will it be able to get unlocked here?

1. Yes, but it will still be under contract, so he has to pay monthly charges.

2. The ones available in the store would be 4.0.2 OOTB and NOT unlockable at the moment.

3. Definitely iPhone 4!
 
Umm where can I ask him to look for an Iphone that is locked but he can just buy it or something? I mean aren't there phones which are under contract but can be still bought and then used whenever wanted or something?
