Market Feedback Will I be getting my money back?

I got this 1GB DD2 667Mhz ram from our TE member called Kevin Lanehttp://www.techenclave.com/users/kevin-lane-30109/
I paid him money via cheque deposit in his account, Got it delivered by Last Thursday 21.06.2012. I checked it that day it self, It was DOA ( Dead on Arrival ) Since then this guys number is coming wrong, not responding to my PM's ( Clearly his intention was to get rid of it and get money which he did through me ) He must be smiling looking at this that how he sold dead product to me and got 500rs for it :)
I checked at our very active TE members house too, Its not working. I pm'd entire issue to mod, He is telling me to wait which is okay but I need to understand that this guys is coming daily and I'm leaving pm before he comes ( I check time of his last activity ) He is brave not replying knowing its safe and probably easy to rip someone off here? Bumping his thread daily too but no answer. What am I suppose to do? Its a small amount, I know some wouldn't bother. But I need my money back.
 
@Mods, kindly move this thread to market feedback.

@OP I think the seller lives in Gujrat, near Rajkot I believe, as he had mentioned that he needed to RMA his Seagate HDD.
@Kevin Lane Kindly respond.

1 - He intentionally did it to eat candies worth 500 bucks (Pretty cheap price tag for someone, shame)
OR
2 - You missed reading the entire thread (as said by vivek krishnan he needed to RMA it?)

I'm pretty sure you have his phone number, give him a call an check?
Also in future, deal with reputed members who have a good feedback, that way you have backup in hand :)

Why not take the benefit of the lifetime warranty (as claimed by the seller?)
 
Have patience and wait a bit longer. May be he was in a hurry and couldn't check the notifications?
@Gannu: What would be the next logical step if the seller fails to respond for a prolonged period?

I have asked Pranay to get the warranty checked from Transcend's website, but would it be possible for him to obtain warranty without a proof of purchase?

Also, the seller had distinctly mentioned 3 days testing warranty, thus implying, his own responsibility towards it, or so I assume. Since it turned out to be DOA, the least he could do is show up and reply in this thread, or answer his calls.

Even if there was no testing warranty provided, pranayjd is entitled to a full refund as the product was DOA.
About the next logical step, as I said in my PM to pranayjd, if there is no response from Kevin Lane even after a reasonable amount of time, pranayjd can try to track the seller down with the help of the members here and possibly get his money back. Also, we will blacklist Kevin Lane.

As I'm sure Mephistopheles would agree Black listing is not solution. Someone else will replace him. Either it can be highlighted in bold under Terms and condition that Website is just a place or platform for buyer and seller to meet and deal. It is not held responsible under any circumstances or liable for any deal to be dishonored what any condition what so ever. This will make pretty clear that buyers are on their own and would rather chose to buy from reputed dealer only. Kevin Lane was online last night at 11.30 pm. He's got guts to come on regular basis and check thread and me pm. Bet he must be laughing now of how helpless I'm and we are. Sorry to say this but Ethan would understand what condition I'm in. And losing single penny is pain to me.

As I said in my PM, our terms and conditions explicitly say that TE will not be held responsible and that the members using the market section be wary of the risks associated with it.
I can also understand what condition you are in, but please dont make up your mind that you have lost your money. Kindly be a bit more patient and first of all wait a few more days, the members here will help you track him down.

Also, see if you can get the RAM replaced.

Agreed. He is liable to return back the stick and refund the money back as per his T&C.

This guy has written something on it, Not sure if i'll get warranty.

2 Options (As the RAM has some writing on it and Transcend won't accept it)
1 - Wait for the guy to respond.
OR
2 - Assume you donated 500 bucks to charity, move on.

I read the 'working perfectly' comment after i made the post, so added an edit note.

Could you check if you can get a replacement?

What the service center implied was, the sticker with the serial number and bar code shouldn't be tampered with. There's no way they can cross-check the warranty of the stick then.

Is there any member from Rajkot who can visit his address and confirm what exactly is the reason for his "absconding" TE?

Probably a bug after we switched back to vBSEO but don't let that rule fool you rather! 5 posts do not guarantee anything about the seller's credibility - he could be good or bad. Some members have been regulars in the Market section more than the other sections and have a good iTrust score as well. Some others probably have a 0 iTrust score and yet are oldies in the forums.

Was just pointing out something which is improper.
