Looking to buy 8-16 TB HDD for NAS. CMR is a must. Enterprise HDDs preferred.

Yes. Will be imported from various sources, you will receive gst bill and 3 year seller warranty

Avoid seller warranty - its as good as useless. Take the item, but consider it without warranty.

Why what is wrong with it? Seller provides replacement for the remaining part of the warranty. So what’s the draw back ?
These drives will be imported from server parts or go hard drive,.warranty replacement will be taken care of locally.
The choice is buyers, either buy drives from unknown sources, evading tax or duties, or buy legit tax paid gst bill drives.

Unless these HDDs come with a BIS label, it’s illegal to sell them in India. BIS certification is mandatory for any imported electronic item being commercially sold in India. That plus a DGFT license if it’s refurbished/used.

The seller is likely committing fraud, knowingly or otherwise.

Of course all the license are in place , paper work done. You mean to say the market where we see thin clients, desktops etc all imported and resold are illegal ?

If they have “seller” warranty instead of manufacturer, and don’t have a BIS label, then yes. Which is why they are termed as grey area. You can’t build a business out of it, let alone provide GST bills.

PS. I had to read through the rules back in the day when @anmolbhard004’s parcel was seized by customs. We went to Delhi customs, spoke to the customs inspector, offered to pay all the tax liability incurred, but none of it was of any use. They wouldn’t release it without proper licences. And that wasn’t even for reselling but personal use.

Without proper paper work it cannot pass customs stage. And i am not talking about GANDHI paper.
A lobby is there which is preventing import and resale of refurbs. recently i read in news that some refurb medical devices were to allowed to be imported , then as usual a lobby came out and it got stopped.

It’s simple really - if the drives themselves don’t have a BIS label (yes each individual one), the seller doesn’t have a license and simply relying on luck/Gandhi ji. Providing GST on such items is committing fraud.
BIS maintains a database. You can check their registration for a valid license.

Either way, kindly do not mislead buyers by recommending such sellers.

How is it a fraud when GST has been paid at time of import ?

You can declare the items for personal use, and then pay IGST. But in order to resell, you must get BIS certification amongst others.

But GST fraud ? how is it a GST fraud ?

I’m no taxation expert. But if I provide GST bills on selling cocaine, will that be considered GST fraud? If yes, then Yes. If no, then No.

It does for medicinal uses. You just need an approval from Central Bureau of Narcotics and a form 8-A licence from CDSCO (or so google says). Doesn’t mean you start reselling it in the open market.

Reselling is within the framework of the laws then yes it is allowed.

I might be wrong but I dont find internal hard drives listed under products requiring compulsory registration under CRS. Only external hard drives require compulsory registration

That’s because internal hard drives carry the BIS certification of products they’re shipped in, say inside a laptop. But if you’re explicitly importing hard drives (internal or external), it’s classified as external hard drive and you need a BIS.
