Hello guys,

I know most of you guys don't know me but those who are frequent in the market thread might have seen me or have made a deal with me. I have a decent past and feedbacks. Until recently when a guy named nish_higher cheats me, puts the blame on me, doesn't accept his mistake even when I have the proof and then gives me negative rating because I gave him one. :( I won't say much. Please read this and you all will know.

He is not going to refund I know, and will keep defending his ass despite of me having all the proofs against him but I am just expecting others to beware while dealing with him also I want you guys if the negative rating he gave is justified?

Details:

I bought a phone from him last month and he shipped it on 13th and it was received by my gf on 16th and I went to attend my brothers wedding on 16th dec and returned on 9th of this month and on my way back I collected that phone from my gf as she bought iPhone 4 very next day after getting this one.

Now the problems, I hadn't used this phone neither did I see it and my gf didn't knew anything about phone including if seller told me about its condition and all. She conveyed about a few problems about the phone to me including creaking sound while phone is on speaker phone, a dead pixel and bad sound quality. It was her first touchscreen/android phone as she hate touchscreen phones so I thought maybe she has mistaken or not able to take the fact.

I got phone on 9th of this month and I started using it after reaching back home and found some problems, exactly the ones she stated + a few more.

The phone has deep scuffs on top left and right corner, you can see the pics below:

There is a dead white pixel ( which some call stuck pixel ) on the phone as well pics below:

Nish_higher is agreeing that dents and scuffs exited and that he FORGOT to add that detail, whereas it defines cosmetic condition of the phone and often working condition as these dents appear to have been caused by dropping of the phone.

But he is saying its not a Dead/stuck pixel but some dust particle. Where as that proof clearly shows it exited when he was selling the phone to me.

Now, this is not the only problem I removed the zagg screen from the screen of the phone and found a scratch and water drops which are not visible with screen guard on and I am putting forward this thing as well and again that guy is denying to it.

For hiding these important details I asked a refund to which he just has to say that I did it and not his cousin ( to whom the phone actually belonged according to him ), I dropped the phone, I opened the phone, I made those water marks and scratch so he won't refund. Great.

Now for leaving a negative feedback for him for hiding stuff and lying he leaves a negative feedback for me as well saying I am doing all that to phone and blaming it on him.

Clearly he is the one at fault here.

I was pointing out the following argument that he is bringing up on the feedback details page:

I have made 100s of deals so far online but as a buyer I never faced such a situation ever where the seller provides incomplete info about bad cosmetic/working condition of the item and later blaming it on buyer that I did it. I know it took a while for me to write this and thats cause I hadn't used the item yet.

The phone is in 6/10 condition and he claims it to be 8-8.5/10 condition.

When I ask him it has deep rough dent/scuffs on its top left and right edges, he said " OH I FORGOT TO ADD THAT INFORMATION ". Its clear proof that phone was dropped and the scuffs are on both the sides which means it might have been dropped twice from a good height.

He puts a THICK screenguard so that the scratch on the inner side of the screen is not visible and so are the watermarks on the screen.

He will erase all the date from the thread so that I cannot point anything out from the thread, this is not the usual culture.

He didn't mention anything about a weeks warranty and all, but now is saying you didn't talk about it when I gave you warranty. He didn't ask for how the phone is right now, neither did he ask any proof or images, just keeps putting the blame on me.

Also despite giving a proof to him, he said " OH THERE ARE MANY LIKE THAT ".

ANYONE BUYING A CELLPHONE FROM THIS GUY, BEWARE, UNLESS YOU MEET HIM IN PERSON AND MAKE A DEAL WHERE YOU GET TO CHECK EVERYTHING IN ADVANCE, AVOID HIM.

i sold the phone one month ago. The phone was delivered, used and he didn't say a word.
Exactly one month later he's complaining of water marks and screen flickering and bad pixels.how is that my fault?
I never ever mentioned weeks of testing warranty. But its obvious if the phone was faulty he'd have returned it or atleast opened a thread.

This is ridiculous. How am i responsible for this?clearly he opened the phone and broke it.

Moreover I delete all selling info from every single thread so ppl don't bug me about the product.this is After the sale.

Screen was always protected with zagg and there was nothing wrong with it.

As I said before the phone was just not used, when it was used problems were figured out and was talked with the seller about but he didn't seem to care.

Oh and best part dear seller, you didn't tell that the phone had fell and had dents, is the my fault? And I am pretty sure the scratch came up at the same time.

Also I have shown you the proof in the photo that " YOU " had uploaded about the dead pixel but you are not ready to accept its a dead pixel, well thanks for that.

Its screen cannot be opened and still it has a scratch ( which ofcousre is related to that fall ) what about that? And the dead pixel exists in the pics that you uploaded for listing the phone and it still is in the same location and I CAN PROVE THIS, what about that?

You Cheated by not telling it had fallen from hands - YES

You applied thick film on its body so that the inner scratch are not visible and ofcourse my gf would miss it as even I couldnt figure it out when I saw it first - YES

I have shown you the DEAD PIXEL in the PHOTO YOU had CLICKED - YES

I CAN SHOW YOU DEAD PIXEL ON THE SAME SPOT RIGHT NOW, OFCOURSE IT WOULD BE A COINCIDENCE, WILL IT BE? - NO

Clearly you are responsible for it.

You don't want to take it back and refund fine I know you are such a guy now, its cool but stop defending yourself like a fool when I can prove that you are wrong. Thanks.

Let me put it this way-
1. She used the phone.
2. She broke it.probably got wet coz you mention water marks
3. Phone was opened and thats how the scratch got over there.
4. It didn't work and you thought hey , why not claim a refund ?

Even with Zagg invisible shield on , you can always see scratches. And it ain't just some stupid fat screen protector.it was a zagg which was on the phone since day ONE.

There was a 1mm scratch on top right which i didn't notice.nothing more than that and nothing that would occur when you drop a phone. And the phone was never ever dropped or mishandled.

Also i'd so love to know how to put scratches INSIDE the screen.earlier this guy accused me of opening it.now he's saying it cannot be opened.awesome.wtf..

About the pics- i can myself encircle a hundred dirt marks and claim them as dead pixels.

Now don't you say she even missed a friggin dead pixel or thought its used and all that crap.moreover everyone knows whats good functioning and flickering no matter if the phone is used for the first time..that is just so lame excuse.
What about the speaker issue you came up with 2 days ago? Don't you tell me she didn't even notice that if the phone was broken.

Zagg is good for the body, but for the Screen, it sucks balls. I know many premium branded much better screen guards like SGP or simply scratchgard.

After I saw you saying you didn't open it I searched on the net and found this link , and I couldn't see screen opened so now I am saying it doesn't seemed open and must be due to falling of the phone.

Abey, tujhe kaise bataau ab? K I will put the pics you posted here and current condition of the phone, it will be height of coincidence if there was dust particle exactly where now there is a Dead Pixel. Oh and had you been a lil genuine you would have asked to put up the pics and show, but hey I will do that favor to your bs conscience.

Yes my dear she missed it, WHY? coz there was friggin wallpaper on that part which was of the same colour, still she noticed and asked me I thought maybe she missed something or has mistaken so took it lightly. You know I used to trust your words as I have dealt with you before, but this is so bs of you Nishant Pawar.

Abey ab likhe k du tujhe? Yes theres a speaker issue as well, phone sounds as if kisi dabbey main baith k baat kar rahe ho. Not just that on speaker phone it makes creaking sound.
Dekh, Deal is over as you Nishant Pawar the great are not going to refund knowing that you missed some IMPORTANT INFORMATION and to some of which you agree and rest you don't want to accept, your bad. Trust me those Rs. 16,000 hardly matters. Your denying and shit have proven a lot. If you were this very desperate for 16k you could have told me, I might have helped you.

This is my last reply as you won't get tired of defending your ass and I have given enough proofs also I have got a life to live and as for your BS negative rating, Moderators will take care of it.

Yes, thats what I asked him, he replied that people keep posting if its available so he erased it. But I doubt if he always does that and rather merely writing down that its been SOLD does the job one doesn't have to erase everything for that.

Yes you can read the detailed argument on that ratings page and you will know the story almost completely.

@Freaky, I have dealt with him before on another website about 2 year back but as a seller and I trusted his words based on his good ratings and past deal, but I guess he tried to use it for his benefit.

So to make things simpler for all of us, tell us what happened. From that negative rating I assume its the mobile phone deal gone bad?

^^ Did a dipstick and it seems the seller does that to his previous market threads so its possible its a normal practice for him.

Hopefully the data is still available to present to the mods.

If the seller is innocent he should repost all the photos from that thread.

Read the 1st post fully. not giving detailed info on the item is seriously guilty. I think i'm with chaz in this one. This is reason enough to claim refund.

Both the parties are at fault here:

Nish_higher: For not disclosing complete details, and deleting the sale details. Why would you want to delete it? and dont give reasons that you always do. There is no reason to delete any thing after a deal is done.

Chatzin: Reporting the issue after some time. Mate your excuse for being busy is not valid, its your job to verify the goods as soon as you receive it. If you wanted some testing warranty, you should have asked for it before.

This feedback is about selling a lemon while knowing it is a lemon.

The buyer has no business accusing on the basis of lack of information as he blindly trusted the seller. It is buyers responsibility to ask. And i'm not advocating the seller here.

You stand a chance of refund if you prove that the seller was aware of the issues and he still decided to cone you.

But no chance with a reason that 'Seller did not mention'. (Caveat Emptor)

Bro he posted 5 images, on another forum he has erased all data but let the images be there ( thanks to him ), and they are clicked in such a manner that one can't figure out any of such problems. And I have bought phones before as well, and its logic that you have to describe what you are selling, I can't as every detail.

Yea, rather I think I should have got the phone shipped to me instead. But didn't had time for it. :(.

im still trying to spot a dead pixel in the pix he provided.

that settings>about page is the only thing which is close but after you have drawn a circle around it.

does the phone have any warranty left?

@chaztin: you are making claim after exactly a month later the deal took off. Also your conversation and evidence are not much clear and seems confusing.

lets see what nish_higher has to say on this.

& as said both the parties are at fault here.

and IMHO buyer should ask each and every possible detail regarding the deal and seller should reveal each and every fact no matter what and be honest to the parties.
