Any Laws/Regulations against Industries disturbing residential areas at night?

Well as the title says - any laws/regulations on the same?

There's this L&T factory/headquarters/whatever thats just over the boundary wall of our apartment complex, and for the past few weeks they've been carrying out some non-stop construction just adjacent to the building throughout the night. If the noise of trucks/bulldozers wasn't bad enough, they've suddenly decided to pull out floodlights across the area as well.

Quite a few residents have already politely told them to keep it down during the night, but L&T has replied in the negative saying they have a deadline to meet! Isn't there any way to get them to comply?

I am not aware of any rules or regulations, but you could try to get the residents of the entire area to get together and make a request to the concerned authorities from L and T. then try going to the police and speak to them, about the issues and see if nything can be done....Normally here no loudspeakers, concerts etc are allowed to run after 10:00 pm, so most probably you can get them to stop the work at night.....

if you feel nothing going nowhere, try kidnapping few workers or the manager!!!

Thats certainly bad and unethical. Their deadlines are none of others' concern. If the construction happens close to a residential area, there should be some timing they should abide by.

I say, go ahead and do the needful whatever it may take. Seek help of Mano as well. He should be able to guide you with regard to some law that may relate to this.

IINM all these construction works are related to the L&T ECC wing. Call Mano along and speak to the site manager. (A friend of mine works for L&T ECC at Madras; shall ask him the phone nos. of some of the relevant heads).

On a serious note, If you have any friends in the media or something, try to highlight the issue or atleast have your complaint letter or some sort of grievance letter published in a daily newspaper or something. This has worked previously for people I know, although in this case it might be quite difficult to get it to work considering its L&T you are up against.
 
Ask your society to talk to the local police station. I'm sure that you can call the police when people have parties after midnight so there should be something regarding this too

Also catch hold of some local MLA/MP and ask him/her to help you'll.

If where you stay is a proper residential zone, then causing nuisance to the residents in their proper enjoyment of normal living and bla bla is not allowed. You can enquire whether they have the permissions and crap, but even with permissions, the stuff they are doing at the night could surely not have been permitted.

You don't need to go all the way by suing them and stuff, but if you could consult a lawyer and lay out the facts to the L&T manager about where all they are stepping over the line, they would have no option but to stop or face the legal action ;) Sounds more complex than it is.

I think this is the best option. It will work 100%.

Give a police complaint.

Issue a legal notice to stop the work in nights. Write to Local bodies and CMDA asking them to regulate the construction activities.

If all the above fails, file an injunction suit and get an interim injunction restraining the company from carrying on the construction activity.

this frikin ghatkopar-versova metro is being constructed right outside my window!
been goin on for a year now.. i have no idea how i managed giving my BE in those conditions..
but they did send an apology letter to the neighboring buildings.. but i dont really care bout that..
 
First give a written complaint to the site manager, make sure all the residents are together and of the same opinion..Then file a WRITTEN complaint in the corporation office..that shud solve your problem..

Else a notice should serve the purpose..Just calmly threaten dont overreact with police complains and like..A written complaint in the corporation office can do wonders..also follow up..

A couple of residents from our block had already complained to the building secretary and asked him to approach them on their behalf. Not sure who he met, but he was the one who came back saying they have a deadline to meet and nothing can be done.

Don't want to make it a media thing or anything, since its not really a big deal.

Filing a complaint, the only issue is if anyone around here will have the time to run around for it and who knows the work may finish by then :lol:. As asliladka said, just wanted to know our legal options so we can lay it out to the L&T people to let them know they're stepping over the line, or atleast an option thats not too much of a hassle.
