Bank manager not giving TDS certificate :(

This bank manager in Canara bank is not giving my dad TDS certificate ....it was for a deposit made in 2008 for a 3 yr period and they deducted TDS and this guy is telling one reason or the other for not giving TDS certificate ....till now the only thing we have done is give a letter asking for the certificate thats all....and we need the certificate before 31st to file the claim...he said last week he will surely give the certificate today but as expected he is saying some bs reason again :bleh:....so what else can be done to make the guy give us the certificate ?
 
As said above..First check your dads 26As form online. If tax is deducted by bank and reciprocated in the form than easily you can get certificate number from there and you can proceed for refund or whatever cause you need.If its cut but not reciprocated than i guess ombudsmen is an option to get original or duplicate certificate.

But on top of that you go there tell straight i want it now anyhow or i am going to ombudsmen.But first verify via 26AS.
 
You have two option to get a TDS certificate from canara bank.

1. Write to the commissioner of IT having jurisdiction over the bank's IT assessment that the assessee has failed to furnish the certificate as per statutory requirement.

2. File a civil suit/ complaint to ombudsmen, that the bank having deducted tax failed to issue certificate and hence the witheld payment be reimbursed.

Hope it will help you to get your TDS certificate back and you can claim on time.

I will go to the incometax office to find out the info on option 1 and how to file a complaint with the ombudsman ? i have no idea where to go can you explain it step by step ? thanks.

i have seen the form 26AS in this site :

it says no transaction for all the 3 yrs concerned....so he has not sent the TDS amount that he deducted to incometax department right ?

Ok so they might have deducted the tds but not filled it. Ask them to show you TDS deposit receipt of the bank and the computation list for the same. If he doesnt, go to the income tax department, find their pan and tan number, and give a letter to the assessing officer saying that the bak is collecting tax but not depositing it. It amounts to theft as the money stays with bank.

yes that could also be the reason ....but he is being evasive all this time....i have visited the branch more then 10 times for this and he says there are no staff or he has outsourced the work to some guy and only he is delaying etc....i have been running behind him for the past 12 months or so :(.

thats a serious charge no ? :scared14: ok will go to the incometax office in the next town and talk to them about this....the incometax guys already told me to file a RTI is that a good option as well ?
 
Go to the next higher level office, check the bank website for the same ~ Grievance Redressel, would suggest to go to the ombudsman as a final call.

BTW, is it possible that he might be asking for chai paani? Dunno, but its been long since i visited a bank :p

Nah its not that i am sure and i have seen him treat village people who cant read and write very badly....if i have to explain why he does this then this documentary explains it all i think :

there is simply no other explanation as to why he is giving us so much trouble ...he has no reason to hate us :sleep:.
 
Thanks guys got the certificate today ....told him i would go to ombudsman if he doesnt give the certificate :D.
