i have been to the Local police station - B 11, Sai baba Colony, and they have asked me to have the matter settled, if possible with the help of mods. Failing which they will take a written complain from me , and then forward to Cyber crime dept. Lets hope this guy gets some sense and settles the issue before proving to be an embarrassment to his family and mohalla.

Cos AFIK they dont treat cyber crimes lightly

It depends on the case also. They asked u to settle the matter as the case is very loose. You already received the goods for paid amount. you accepted it on your free will.

He even replaced a faulty item for you. Its the matter of 3 months warranty. Police may not be able to do much abt it. Max will be few phone calls.

even that could be refuted by the seller, if he is ok versed in dealing with police. Its not some harassment/sex video case/ID theft/Robbery/stolen or illeagal goods that will

create the magnitude you expect. If it does create the magnitude this be a new ground for online trading. The lawyers in this forum may be able to tell if i am very wrong.

My advice is also to solve the matter amicably. Reach some middle ground. Maybe couple of hundreds to you. Its been long enough dragging this.
 
The lawyers here will point out to few facts

1) when i purchase the cpu and CM TX, under his words that they have 2 yrs 9 mts warranty left. - later it turned out to be lesser than stated - So it is misrepresentation of facts, with intent to cheat.

2) i wanted a refund for the CM tx-2 alone - 1k, which he agreed to first then asks me to take tx-3, which i did hoping to close the issue.

3) it was after all this done, i notice on the packing of the CPU - Date is July, so i ask him exact date of purchase, only after much pressure from all of us he agrees that he purchase in Jan 2010.

4) The mods can only explain to him ( which i am thankful to many members here for trying to explain to him). But you can take a horse to water but cannot make it drink.

So the matter is left with Bunny- Bhullar Boys as to what he wants to do now.
 
i am sorry to know that simply things got piled up for no good reasons, Someone shame, someones frustration, could have been avoided..

^^^ I used HDFC cash deposit facility for clearing Horoscope's amount (that I owed him) 4 days ago. No problems at all. And I'm not an A/c holder in HDFC.

Also, the date on the bill has been overwritten/tampered. As the bill has no Serial no. of the Proccy, it might as well be the bill of another proccy..... ambiguity cannot be an excuse for ascertaining genuineness.

I believe a complete refund & cancellation of the deal is the most reasonable thing to do as the deal has been flawed ab initio.

The Cyber Crime cell is not gonna be much help in this case. They do not tackle such cases simply coz such cases are beyond the purview of Indian Cyber Laws.
In case the refund goes bad, I suggest the following procedure.....

U make a cognizable complaint with the nearest police station. Thereafter, bunny would be booked under S 415 of the Indian Penal Code for Cheating. He may face imprisonment for 1 year or fine or both.

I dont know much abt law. but i thght cognizable is for offensive stuff like murder and what nots?.

and how do u differentiate NC and this one?. so i can just file any case under this?. then why such a category as NC? i am asking coz waiting for the court warrant and all is

like meh. police can take action right away. Or does that come under police brutality or something.

I know its OT.. but curious. cant ask family lawyers abt this. :S.

Let me explain:

N.C. means Non Cognizable Offence: It is just like a record kept by the police. So, when u file a NC complaint, it is recorded & the job of the Police practically ends there. Thereafter, if u go to court with the matter & the court issues orders to that effect, only then, the Police may arrest the person against whom u have lodged the complaint. Thus, in case of N.C. the Police cannot arrest a person without orders of the court, i.e. without a Court warrant and can investigate into the case only on the express directions of the court to that effect.



Cognizable Offence: In case of a cognizable offence, the Police need to take cognizance of the offence by themselves. They need not wait for the complainant to approach the court & the court to issue a warrant to that effect.

All offences under IPC are cognizable except the following:

Section 323: Voluntarily causing hurt.

Section 504: Intentional insult with intent to provoke breach of the peace.



Section 506: Criminal Intimidation.

Generally, the Police try to take any complaint in the form of a NC so as to avoid immediate action on their part. But if u have reason to believe that any offence committed against you is of a nature that needs immediate cognizance, u can insist on a cognizable complaint. It's your right.

So, u see, Cheating under Section 415 is also a cognizable offence.

P.S.: There is no such thing as Police Brutality. I Respect & Trust the IPS (& that is where I am headed). I expect u to do the same! :)

I know all this is OT but I thought it best to shed some basic legal knowledge here so that it may benefit the common junta.

Mods may please feel free to delete this post if they find it irrelevant.

Hmmm... I was talking abt police brutality coz there are simply too many instances that police disregards procedures

and just treat people like shit. and there is a very famous case in kerala about police brutality. forgot the name and all.. happened many years ago. :(.

the guys father who ran the case died few years ago and the case kinda dies i guess.

ps. A family member is IPS.. :).. top ranking one. so no trust issues. lol.

Back from meeting my lawyer and, whosever account details he gave - JASPINDER SINGH, will be involved in the proceedings too.

Just bcos he wants + rating, he gives me positive ratings first, after i give him negative ratings for his intent to cheat, he gives me negative. nice joke
