They don't have to. Buying and selling currencies would come under trading and one has to pay appropriate gains tax on profit made through such transactions.

the currency is not a "legal" tender, the currency itself is not illegal. Try to read b/w the words, as what words govt's uses is like they are siding both public and crypto at the same time. When they say its not legal tender that means no one can accept bitcoin in India for buying goods or services.
Respect the technical side of bitcoin, but not how it is generated.
