i am in great need of legal advice......

in 2007 when i was an book worm of 14 years i got crays of computer games and wished to but one .......

eventually my familly desided to give me my own pc for study and gaming as i use to spend hundreds of rupees on cyber cafe......

i was noob about how to buy pc and what do we need to know before buying it....

my father is an 12 - 14 hours working guy and so i was tolled to find an shop and we shall buy thorught them ...
i got one near my place and we started the deal .... my father being and salary depended person , so decided to buy on installment.
we of our own didn't have an house and stayed in an rent house ...
the own of shop told me that he know an 'pathasanstha' which can help me with 0% finance.. he told he will take care of every thing just need to submit so id and stay document with "bank blank checks". we had an deal of 1400 per month and it was for 14 months... i was an noob and nearly known to whats going on as all i wished was an pc.
my father sign 14 checks in is near by ending checkbook in morring on 19-12-2007 and gave to me and told not to give checks without writing the name of to whom to give...
i went to shop and started talking to the own about the deal and A.S.S.
in mean will i started writing name on and amount what was dealed but forgot that i was only told to write name...
when i gave check to him he took it and got in his office . i was waiting in the store . he returned in few minites and told he cant except the checks as their we the amount entered . it was some thing like the whole earth below my feet were been pulled away by him. i felt in to sooo deep depration that didnt reacted for a while... i tried to convence him but fail ... in mean will i lost 4 *1400 checks god knows where and it didnt even came neither my father mind nor my as my father was sssooooo angry that for a while i felt like commeting suside and even tried it but one guy saved me and explained my father about my mental status... we then together when to the shop and asked for suggetions as my father only what 9 new checks..
he told that he will except 5 check from the rejected one and 9 new one . as my father were on dutie and just came runing in anger, he gaved checks this time and told me that now he dont want any mistakes in the buying ....
the pc was assmebuled and i was told that my self will have to pay the cost of transportation and my self will have to take the pc to my house...
they said their engeneeir was busy...

on other hand my father was been told that they have delievered the pc to my house and they will come tommorow to start it....
never came for 2 days or gave me any free gifts like pc table or printer and not even the one year service which every shop gives .....
they were such an a****le for me that eventaully one of my friend needed to buy pc from him and asked about their service and i told not to buy from him... he told the the owner of the shop was a good freind of his father and forced him to buy from him...

eventually i shifted my rent house as it was for 11 months agree ment.
now in 2010 the same friend of mine called me and told that the ower of my pc buyed shop?is searching me and spreading that my father didnt paid him 4 checks and cheated him a call him in anger and asked him about it to him and he told that he has 4 check of my father signstured and wants me to pay him the money or he would draag my father to police station...
the check is of 1400 and r 4 checks but he is asking for 20000 rupess and saying it is the intrest on the 5600rs for nearlly 2-3years and is Blackmailling me and my familly...
he also has political support on his site ...
till now we were able to figure out the check number anf have stop payment ...... what should i do ???

any thing legally can i do ????

he didt even gave me an bill after i paid him all 14 checks and also had an fight on it...
he also cheated me with the components like
i buyed an c2d intel and original 945 mobo but in instant he gave me an jet way mobo.

i buyed an lg tft but he gave me lg lcd.

same for ram and other things....

today i am able to recognise the things but that time i was an noob and he took the benifts of it

please help me.....

at persent i have lg lcd monitor,ram,cabinat and hdd rest of all got damaged and as i didnt haved the bill i didmt got RMA and the Shop owner also rejected to replaced it
i only had an paper of reciving the things and i have signed is ... what should i do in this situation?
 
Take some time and correct the english dude.
Hardly anything could be understood from your posts.
For the check payments you can have the acknowledgements from the bank from which the cheques were issued.
And then a complaint for denial of bill, service etc.
As for the lcd still not clear what you've said but as far as i know all lcds regular ones are tft screens.
The things you need to do is get your bills first.
Show him the bank's acknowledgements
To prove that the cheques were issued by you.
This inference from what i have got from your posts.
 
I don't get the part where the OP was supposed to have given the cheque with only name and no amount entered.
 
yep i tried reading it again , still didnot make sense

except that the shopkeeper is searching for him and asking for 20k but there was no bill?

Small co-operative type bank, not big, where few people come together, issue shares & form a small bank, most of time I found such Patsanstha were fully controlled by political person or a person who has very good contact with politicians.

@op if nothing of your pc works go face to face to him and give him your pc back.
And curse him in front of others for selling you crap.
 
Right, the main issue here seems to be how to get the loan collector of his back.

The politcal connections give them the muscle to collect on their loans

And sue him for maintaining the crap for 2-3 years......
 
is the computer guy and blade guy, the same guy?

blade is the loan shark. its what they are called in kerala. :)
 
the thing i want to tell is that the 4 check which i lost r with the shop owner and he his forcing me to pay 20000 thousand and the 4 checks r of total 5600 thousand....

on other hand he is not giving me my bill.

what should i do.....?

14 checks at 1400 per works out to 19,600

You lost 4 checks, so he wants interest on the missing ones.

He only got 14k and wants 5.6k more + intrest.

What is the problem ?

You cancelled those lost 4 checks alaready haven't you ?

i assume that the 4 checks are the ones with the amnts. didnt he said that its not enough and u took the cheques back?..

If not why didnt you .. anyways.

didnt u already paid for 1400 * 14. then why does he need another 20k? and why didnt u take the cheques back again?
 
Can't you just cancel those cheques? Are they even valid now? Didn't you get the name or something wrong in the those cheques in the first place?
 
i have cancelled the checks .....

i have paid the whole 14 checks and + 10000 rs. cash as my pc was of some near 28800 i think so and he also took agent fee from my father.....

as i said the first 14 checks were rejected and as per my age that time i got totally depressed about what my father would do to me ...

he asked for new 14 checks that time and gave me the old checks but as the condition is, he took 4 checks from that old 14 checks and as i was in other thoughts it didnt came to my mind and neither of my father as he was in anger....

now the checks which we though were lost r with him and he is asking for 20000 rs......

I don't get this bit, you've already paid up haven't you.

So how can he ask for Rs.20k on top :huh:
