^ after all this do not pay any thing. tell him you wont pay a single rupee since he cheated you on the comp. best is to ignore him and do not even go near his shop or take his calls.
i don't think he will go to the police, since even he is a big liar and thief. you have to keep enough proof on your side though if that situation arises.
 
As pointed out, please try to calm down and edit a coherent post.

1. I can't understand part about giving blank cheques (the payee's name and date may be left bank but was the amount left blank?!).

2. Is this post about purchase of shop or purchase of PC; how are the two things connected?

3. For consumer court, you have to approach the court within two years when the dispute first arose. Since I can't make out your post, you figure it out if the dispute goes beyond two years.

4. There is police complaint for cheating and other stuff, but since you have stated that the guy is connected, that creates a difficulty.
 
so what proof should i keep ....?

i have bank passbook and the reciving component list...

he is asking me to pay 5600 rs and is the interest on it and thats a total of 20k ....
+ our police are so dame corrupt the f******a**h*** that they r giving me back and r on this side.

i am not fared of facing the police or him but the thing is about my fathers reputation....

when i got to know that he is in search of me and when we invited him to talk.... he brought men force with him and tried to toucher my father in public.... that time i was at college , if i was their i would have broke this head and spinal cord for shore.
on our side we could also show him the real one men force not like him 'sala chakka' need 5 extra men to face my father.

if next time he trys something like this my father would deffently slice him up.. and thats what i dont want....

i want a solution on this LEGALLY and noth wuth 'blood shead'

please if some one knows how to tacal this situation , tell me .
 
Please tell us what exactly you wrote on those cheques, coz I don't think anyone here has any idea how he can use invalid+cancelled+outdated cheques as leverage for a transaction which has no record of ever having taken place.
 
i wrote the name of the shop and amount and their were my fathers signatures......

as i told that what the current situation is , that time he took advantage of my age and my eger / feeling to buy an pc and stole 4 checks

he is using those cancelled checks like an proof that we gave him the checks and r refusing to pay and have cancelled out the checks.

what should i do???

if he pull and police complaint and as police is his d**s whats is the worse
thing that can happend with us....?
 
Do you ever mentioned on check that the checks are for Purchase of computer/ or computer parts?

Do the bill contains check number & your father's or your signature?

Is there any thing with the seller which can prove that the system or any hardware with you is from his shop or supplied by him?

If you answer for above 3 question is NO, than declare that the deal was for another pc/product but as he didn't supply you so you foke the deal hence now the seller requires to give your money back. I know it isn't that simple but it's last sort i think

You did not reply to my earlier post. Have you fully paid up what is owed as yet or not ?

Trying to guess what you have said from your earlier posts it seems you have paid Rs.29, 600 already

Is this correct ?

If so what balance is remaining ?

Oh and the most important advice given you in this thread so far is to be silent, remain calm and not lose your cool. Let him say anything, threathen, say he knows all the big shots, even if he physically roughs you up. The key part is to remain cool and NOT give consent. that is what he is after.

yes i have paid him, first 10000 cash and second were the 14 checks of 1400

So you paid 10k + 19.6k = 29.6k and you confirmed no balance is remaining.

What is his compaint then ?

a re mene jis aadmi say computer kharida na to woh pc 28800 ka tha.

mujhe installment per lena tha.

usne/ he mujhe bataya ki 14 moths ke installment ke lie 14 cheques 1400 ke lagege.. or 10000 advance cash payment jisame woska agent fee bhi he.

me re papa ke pas jho cheque book tha wosme 23 check the.14 papa ne sign kie or kaha ye cheque shop owner ko dene se pehile wusper cheque kisko deda he wuska naam likhanaa. me ne naam bi likha or amount bhi .

when mene shopowner ko cheques die tab who ek minita ke lie office me gayaa or me shop me tha.. jese he woh bahar aaya , wusne cheques wapus kie or bola ye cheques nhi chalege to new 14 cheques le aao.

ye sonathe hi mere paao tale janiin phisal gaeee. i tried to convence him to take the cheques and that was se thing for 30-40 miniutes but he didnt agreed.

me re maan me me ye sochraha tha ki papa meri kya halat karege or computer ka kya.

es chakar me, me cheques ginanaa bhol gayaa. mene papa ko phone lagaya or sari bath batai onlyabout cheques rejection...thing.

papa was very angry and feeling their anger i went to depression and the above story.

my papa came in mid of their job and started bething me.

my bad time of that year.... :(

then he took the cheques and cheque book to shop.

14 cheques to woh lene ko taiyar nahi that to papa ne cheque book dekha the wusme sirf 9 cheques the. 23 -14=9 cheques...

papa ne owner se baat ki or shop owner bolla thikhe mujhe 9 new blank cheques do or rejected me se 5 chlega.

papa ne mujase 5 rejected cheques maage or ower ko de diya ....

muje dathme bole beta aagar firse kohi galati ki to to marra. and left to job.

me whahape / shop me tab tak raha jab tak pc ready ne hi ho jata...
bad me me akela pc ghar le aya .......

14 months we paid him 1400 per month and the me woske paas gayaa bill lene. woh bolaa abtak pathasaantha ke kiyarens ke paper nahi aaye he , jab aaye ge woh khud phone harega.

we waited and in between that period my dvd rom got boomed and also my mobo...
i asked for RMA but he told go to service station and when i got to service station the asked for bill.
i showed them the reciving recept but he told ja ke bill laao.

then i again went to the shop and ask for bill, the owner of shop told i cant help...

since that time i stoped visiting his shop.

like this also in the first year of my buying he gave an pethetic service that S**k** .

esi doran i change my rental roon and shift in an far area from that place and my father akso changed the job.

i use to go to school and father to work and eventually both didnt got chance to visit him back neither he called me .

in 2010 i got chance to visit my old friend and to whom i told not to but from that shop told me that the owner of the shop is searching you and told me the u have an balance which u didnt paid and gave me the number of contact...
till that time i mave shift from cdma to gsm i.e. changed my mobile no.

humne shop owner ko phone lagaya std se taking wose mera mobile no. na mile or muje pareshaan kare about money .
we invited him to meet at home and as my farther u to work down to same building we use to stay we desided to meet at parking.

then all that thing of manforce "slal chkaaka" And in the act he told that he has 4 cheques sign by my father and r my balance to be paid.he also told that we dont have to pay the cheques but also intrest on it and that as an total of 20000 rs.

that time we though that he might have taken out 2800 on one of the nine blank cheques as the other were amount filled by me.and he did it 4 times so that four cheques should remain but when my father went to the bank the same day and brought that bank statment . it was clear that there were 14 withdraw on his shop name of 1400 and he was have 4 extra cheques which he must have stolen by taking the advantage for age and mental status.......

now did every one understand?
man my hand is in pain with writing all this and that also on mobile. :/

agaar perbi na samaj me aaya ho to jo para nahi samaj me aaya woh pucho...

plz help....
 
i really do not understand.. if he has en-cashed the cheques, why is he asking for money again.. and since u say u had put the dates on the cheques ( the ones which u say he has "stolen"), don't they become invalid after 6 months?? I am confused :S
 
I think he might have issued post dated cheques.

Your pc , how old is it?
Also was there any written agreement of any sort with regards to the money lending?
If yes, what was mentioned there?
Why did he refused to accept the earlier cheques?
If cheques were not accepted by the shopkeeper why did you father beat you up? :S
There are many questions unanswered so we cannot guide you until you answer those.
 
@ kauzy : no date were entered on the cheques and only name of the shop and amount was written with my fathers signature...

and i bought pc on 19-12-2007 thats bring it to 2 yrs and 8 months and now i only have the lg lcd monitor,
key/mouse iball combo, creative 2.1 speakers and cabinat from iball with wd hdd 160 gb.

@ ggt : i insist my father to buy pc from him as he promised me that with in 4 days my loan for pathsaanstha will be pased and on 5 th day my pc will come home.
my father didnt want to buy pc and also told me that time if something goes wrong as he is wasting time behind the buy and as it went worng he beat me.
and about the cheques, the shop owner told the the cheques r as the security and the r to be blank (he told that it is the rule of pathsaanstha)and only signature should be their.

i dont think so that my father had any governmental stamp paper agreement as per i remeber he only asked for photo, bank statement, light bill and agreement of rent house + salary slip.
 
I think this is a matter of misunderstanding, shop owner just don't care to check your 14 check status which as per you is already paid.

Just visit him with all 14 checks statement from your bank & advance paid amount proof (take xerox with you- NOT original), tell him that the 4 check lying with him is no way to present in bank as the amount is already paid to him by other checks. :)

Another thing, now there is no advantage of blaming him for product or quality or configuration, forget that part, even do not utter single word which provoked him. :)

Just don't enter in his office like DON but like Munna Bhai MBBS, I'm sure he will understand that the mistake is at his part. :)

he his not a good man like us.... bads** and is trying to take advantage of the opportunity so in this situation i want to know 2 things:

1) what he can do with the cancelled cheques legally ?

2) what can i do to answer him legally on his acts ?

i can wait till 2012 to come and take him to his end ....

1. Dont think much other than cause pain and mental distress

2. You can furnish ur bank statements and all that prove u made all the payments in time.
 
if i can do to finish his fear and threating becoz i dont want my father to pay for my sinse for buying from that* ........ *and if police gets involve in this case then they will take his side and not my as the area in which the case is , he as many police as his friend.
 
just out of curiosity...

where are u from... to think this much corruption exists. :S..

and he is a computer dealer r8??.. what could be the highest level police he know?? H.C, S.I ..??? or maybe C.I..???.. complain to the top if u are being mistreated.

just show the acknowledgement from the bank, make a complaint telling he denying you the bill and trying to extort money.

BTW no terms of loans are supposed to be put on blank cheques.
even as security it is meant to be named and the amount mentioned beforehand. no pathsanstha can force you to accept the terms.
next time apply some logic to the dealing.
