I think the OP is being a tad childish about his refund expectations. I know it hurts to incur a loss this way, but please be realistic. You already got what any reasonable seller could do for you in your scenario. No seller is obligated to refund money for indirect losses. If you buy a stabilizer for your TV and it turns out to be defective because of which your TV is damaged, would the manufacturer of stabilizer cover your loss for TV? His obligation would be limited to replacing the stabilizer. Even a consumer courts would not entertain your complaint. As for the refund, the seller is not obligated to make a refund after such a long period of time and its pretty standard even with chains like Newegg to charge restocking fee when making a refund.
 
I think the OP was just cashing in on "community", "peer pressure", "face value".

U need to be reasonable enough to him, then i think he may entertain ur refund request
 
issue that is ALSO to be debates is whether a buyer is entitled to get a used one when ordered and paid for new one.

many people have received used/returned one's and im not being specific to cases where some member demanded a replacement. Has there been any cases where a member ordered and paid for new one and received used/returned one?

Dealer reserves the right to either replace OR refund. The decision does not concern the buyer while referring to standard terms and conditions of warranty for any other products in the market so as to avoid frauds.

Seller can deny you refund and insist on replacement whether the buyer likes it or not.

As a gesture, the Seller has proposed usage charge deduction from refund and you have taken it. So what is the issue now on that? Isn't it bargaining after accepting to a condition?

Full refund does not include what you spent on BSNL, Courier etc. Be reasonable.

And you will have to bourne 6% ebay fees if you are demanding refund outside of ebay. (seller has to price products higher on ebay as ebay charges 6% fees)
 
Lets me clear some things . If this is not DOA.But he sent me a used modem which had problems which some else returned it to him .I know this becos ,he repeated this to 2 other TE Members here .

1.This is not DOA , but a defective piece sent intentionally .

2.He says it works at his place , which is whole lie ,bcos it does not work at pune also as confirmed from one of the TE member who got my modem .

3.I did put the 3 A4 sheets of prints outs inside the box , it was out .ANyways it woudnt fit .You should have got it if you HAD OPENED THE PACKAGE. Even if I had put the papers inside the box , you need to remove the box to get the modem ,then would have got it .There is no way you have miss those 3 A4 papers .You are saying you missed them .A clear lie and he just sent the package as it is EVEN WITHOUT TESTING to the other TE Member. Even Varkey's modem was sent to some one else . Is this not lie ? .

4.He says the modem is fine on his testing .When onlyravi tested , he also found that it was getting hot , SIM Not detected and only 40 % strength .Same as mine . So what kind if testing he does . Is this not lie ?. Even varkey had the same problem ,he lied to him also saying every thing works fine at his end for his modem also. Again lie .

It is not 2 months , I got the modem on Nov-16-2010 and I wrote a mail to him on Jan 2 -2010 ,asking him whether I can send the modem back.That is around 40 days . .I can give DTDC Screenshots and tracking numbers .And the sent mail also to MODS /ADMIN.

a.The reason was the it was working very slowly , but very intermittently(bcos it was getting hot) .

b.It corrupted my SIM .I lost 4-5 days to get SIM replacement.

c.It was again working very slowly .

d.Again the SIM got corrupted .This happenned on dec end .Since it was new year/holidays was able to mail him only on Jan 2nd .

My mistake was : I should have put up this thread when the modem was getting hot or when the first time SIM corrupted .I trusted the dealer and thought it was SIM Problem and went for second SIM.This was like 15 days when I received the modem

So it not 2 months as it was made out .more like 40 days.

Don't give me ebay rules . Since you deliberately sent me defective modem, Its a mistake for which I had to go through all this .And you need to refund me the charges. You have done the same for many member here and the truth is all over the threads .

Stop lying and Accept the truth ,which will save you some grace .

If this was DOA , I understand , but this sending a defective modem intentionally in first place which he is being doing till now to others also .Others are not complaining becos their refund is stuck with him and he might not refund the amount to him(if they complain) .

I am just putting all these to show how honest the dealer is .:D .Also check my date when I joined TE and how many like this threads I have .You will know whether I am just posting for the heck of it or wanting the truth .

Also when I posted my comments on E122 sale thread ,he called me and was shouting at me and asking why I am posting on TE for which he will be losing customers .

^^ I dont think he is doing this intentionally. If i am right (and read the mail commn posted by dvdstoredelhi) he accepted to refund 1915 rs. Did he refunded it to you?
 
I have been reading the thread,dvd store is a great seller and i have bought plenty of stuff for it, i think its just a bad lot of modems that has hit everyone and are being pushed around in all places. Also i have mentioned in many of my earlier posts, that if the current lot with dvd stores has some issues, users can buy from other sellers, in spite of this i still see, everyone buying from the same seller and complaining. Do we have any one who tried a different seller ? also i have seen few users who did buy from him and have not faced any issues so its a mixed response and lot which is out there.

As fas as BSNL speeds are concerned i am seeing time out and pages not loading properly from yesterday, so definitely there is some issue with bsnl 3g. if anyone buys a modem during this period he may feel there is an issue with a modem, which is not the fact but the service is poor these days.

Don't think, read from the first post ,you will understand . He refunded 1915 Rs . But why should I take the remaining loss(deductions,headaches,2 times sim corruption ,modem not working) due to his mistake/lying,sending a defective modem in the first place ?

I find some of the members extremely biased towards him and not asking the question why did he send a defective modem in first place ?

OP expecting alot from refund policy is one thing and dealer intentionally moving around returned and reported defective pieces is another. Let us not ignore the latter because of the former.

dvdstores imported them on his own and is offering his own warranty terms..that is fine. But selling a returned/reported defective product to people who have purchased and paid for new one is not acceptable unless agreed upon. Just because certain dealer is reputed does not mean we shall start discarding him being at fault.

@People, please stop deducting on the basis of previous experience and please start to focus on the current one, because it is not helping in solving the issue.

He used to shout on everyone, lacks manners to talk with the customer. Let me explain my past experience with this dealer--Last month I placed order through eBay for MB&RAM after confirming availability in stock on phone, being a local dealer I was expecting shipping details next day so called him up in the next evening of order day. He responded terribly rude and said he has policy not to ship order the day customer inquired? WTF was that. I kept telling him to behave politely but he did not listen and shouted, he is getting many calls from here n there whole day for small orders like 2GB DDR3 ram. If he has such irritation from customer calls, I guess he should remove mobile/contact number from sales.
I know he used to send Invoice without SN of the product so sent him a message through eBay to enclose proper invoice with the SN's. He deliberately ignored that message, may be because of that telephonic discussion? I received the order in next four-five working days with improper invoice (did not have SN of items). I requested by email twenty days ago to resend proper Invoice but all in vain, till date neither he replied nor he sent revised invoice. In the end only I have to say this---I will never never buy from this guy again, even if there's a thing that I desperately want and its not available on the entire planet and this guy has it, I still wont buy from him.

You Ordered on 8th Nov last Year and we shipped same on 11th Nov DTDC Tracking Number > Z24963942 Courier Services India, DTDC Tracking. and you wrote to us that it has a problem around 4th Jan this year so almost close to 2 months if not 2 months.

That is the time when only E122 was available and we in fact SOLD 22 modems during 8th Nov ~ Nov 10 and none of the users except you complained.

What makes you feel that we'd send you a defective piece intentionally ? Have we ever had any issue earlier ? None that I'm aware of..

What makes you feel that we sent you a Used modem in Nov when it was so much in demand and I did not even have one for myself

Read the thread pages from Oct 27th to Nov 10th and you'd know !

Please understand that we sent you Brand New Piece and not a used piece.

We have already confirmed that you please Refund the amount Rs 1915/- paid to you and we shall initiate your FULL Refund via Ebay or whatever you paid to Ebay... What more ??

You sent used piece which was barely working and I was new to 3G modems and never suspected you when I got it .PERIOD. Accept that ,don't beat around the bush.That is the root cause for all these problems. Did i contact you when the 1st SIM got corrupted , no, why ? I trusted you and thought it was SIM Mistake.

If you are honest enuff ,Why cant you refund to my acc details which you already have ,wouldn't that be simpler ?

or you could initiate a full refund on ebay .Once I get my refund ,I will refund you back 1915 rs , ok ?

Dude i think you should transfer Rs.1915 to his account first then he'll refund your amount through ebay.... One of you have to take first step....

I never shouted at you nor shout at any of my buyer's ...but explained you strongly that you that there is no need to reconfirm that your order is being shipped today ! Is there any need to re-confirm after you've placed via Ebay and confirmed with me over phone one day before ?
You ordered on Sunday 26th and item was shipped on 27th night and DTDC shows 28th and delivered to you on 29th.. How come you're saying 4 to 5 days ?

Well we receive several phone calls from buyers everyday saying that they just purchased a pen drive or micro Sd card and if we have received their Order ! They are so excited with their 1st purchase on ebay and they get Seller's Contact information on their email and they call.. Imagine receiving over 150 calls a day asking us when will we ship.. ? Will we ship today.. When will they get ? Is it Genuine piece coz available in market at Double price and so on..

Please understand that we have provided you with a Proper VAT paid bill and it is not so easy to daily prepare bills mentioning Product serial number. I as a Dealer buy several products daily and do not get serial number printed on Invoice.

I remember that day when you called and I (out of humor) informed that we do not ship to buyers who irritate us by reconfirming whether we are are shipping today and you took it otherwise and threatened me to face dire circumstances.. This surely reflects a lot about you when you write and the way you write ! You may not want to buy from us is fine and we do not want to Sell to many buyers.. but we gracefully block their ID without saying or posting in forums..

I bought from u few times without any issues. So please take this with a open mind.

When u start dealing with tech forum folk...most are just teenage..college kids using their pocket money/dad&mom CC. So there is a degree of "impatience".

But that shouldnt make u wary against genuine callers. In that case from being in the same city it was kinda obvious that he expected next day delivery.

U do deals via ebay doesnt have to mean that same city guy have to wait for days. Agreed that many more from outside cities also buy. But do entertain

all. You talking strongly is rude. Ur not entitled to speak strongly when the buyer is doing whatever in his rights. Ur not. If it was face to face things might

be different. u do understand that r8?.

There is nothing absurd and false in what I wrote. That call was not made to confirm eBay order in the first place, it was for the shipping details which I was expecting from you being a local dealer. Now you call it strong explanation but indeed you shouted at me and behaved out of humor, which was not expected by an old customer like me (More than two years).

Order was placed on 26th shipped by DTDC on 28th, received by me on 30th. That is flat four days. Find below the proof in screenshot.

Now let me explain you one more time. Invoice without SN is like no invoice for RMA centers. They can easily refuse such Invoice when submitted as a poof of purchase. Anyhow if they accept there will be loss of warranty period(2-3 months) because warranty then will be counted from the date of manufacturing.

I can understand the rush of customer inquires including from newbies but I would request you to be in humor during telephonic talks atleast with the old customers.

I have sent you a mail at ebay1@sunishkapoor.com, sales@theitbazaar.com twenty days ago with the SN of items, please send me revised Invoice.

Remember you are not alone seller in India selling IT products. I dealt with you only because of eBay coupons otherwise I have far better, cheaper options available at local Chandigarh and online like SMC, mediahome, theITwares.
