we didnt mean it like that. Just that when you refused to refund him the 19xx some of us felt that you are trying to back down from your word. All is good as long as you keep your word and return him the amount once you get a refund.

I think the matter is resolved for now. It will be best if we didnt post here. All we are doing here is adding salt to an open wound.

Are u a joker ...or trying to be too smart. Dont u get the simple fact that if he refunds to your account he cant refund the ebay fees of 6% or so of rs 2450 which will come to around Rs 150 or so...so u will be at a loss and he also. If he refunds u fully via ebay there is no loss of ebay fees and you get back the full amount. I dunno but you are being stubborn here !

Supra is telling true, take refund through eBay, otherwise either one of the seller or buyer will have to accommodate eBay charges. After initiating refund eBay transaction will get canceled automatically.

OP expecting alot from refund policy is one thing and dealer intentionally moving around returned and reported defective pieces is another. Let us not ignore the latter because of the former.

dvdstores imported them on his own and is offering his own warranty terms..that is fine. But selling a returned/reported defective product to people who have purchased and paid for new one is not acceptable unless agreed upon. Just because certain dealer is reputed does not mean we shall start discarding him being at fault.

Selling a used/faulty item as a new piece is unacceptable, but If you read the sellers explanation, the item in question was not sold as a brand new item. It was given as a replacement for a different model upon request of the customer and was done in good will. There are two points to be considered.

1. The seller as no obligation to give a different model as replacement. If an item is faulty, it would be replaced with another item of same make.

2. In 99% of the cases, the replacement given even for the same model would be a refurbished piece.

The forum works on 1st come 1st get basis, we came early and posted before dvdstoresdelhi.

The issue existed on ebay, you should bring it up as a dispute over ebay. You are creating topic here for getting things resolved and then you can not digest others being considerate about both the ends. You clearly have no idea about your rights as a customers.

well old time member freaky got a defective modem which was returned by member varkey.
Varkey reported the modem had major problems and returned it. The same modem was ""supposedly tested"" and then shipped to Freaky AFAIK.

@nfs I think lots of TE members already advised why the 1915 needs to be transferred and why Sunish cannot transfer u the difference amount directly.

I guess its fair that u transfer the 1915 first and then initiate a refund through paisa pay.

This will keep both the buyer and seller happy.

I suggest u do it ASAP before the matter cools down and all members lose focus from it

Dude....that's a lame statement...An honest man would certainly not part with his hard earned money. also, remember Sunish is not entitled to pay u anything. As per the warranty terms its a refund within 7 days. U can ask for a replacement which u did not want.

I would not be surprised if Sunish does pay the difference amount as its his discretion and I think any shop would do the same.

go through ebay .....its much safer....remember if he has agreed to refund through ebay he will as he does not do 1 deal but 100's in a day. he will not SOIL his reputation made in 3 years just for one deal

I am not really sure what the OP wants....he is being promised a full refund through ebay and even then he is not satisfied.

Now this is really unfortunate. One bad deal is spoiling all the reputation build by dealer. And dealer doesn't seems to be at much fault either. These modems are unlocked, imported from chinese sellers i guess, and don't come with any warranty to dealer(due to unlocking).
I don't think that other dealers on ebay will honour the warranty to this extent for imported product.

^ AFAIK he purchased the modem from eBay as new and the IMEI number of the device he received turned out to be the same as that of the one I had returned. He had also mentioned that it came with the latest firmware pre installed. (I had installed the latest firmware to see if it could solve the issue)
