Market Feedback dvdstoredelhi conned me , I need the full refund along with 600rs BSNL recharge .

First things first .I got this from ebay .

Basically the modem was not available here and he listed on ebay at higher charge(2450 rs ) .

Now don't tell that this does not belong here .Lets leave that apart , many dealers do post there ebay listings here .

Now the issue .

1.My E122 modem was slow from day one , after few days it was getting very hot .It had only 40% signal strength .(even if you stand next to tower) .

2.One fine day my SIM got corrupted due to this .Thought this was SIM issue.

3.I had to wait few days before I got a new BSNL sim .

4.Again the SIM got corrupted .

5.He was not ready to accept this as a issue .

6.I sent back the modem.He says he needs 10 days to replace .(he said he want to test and send it back to distributor .........yes ,OK .....but......... 10days ?)

7.No news even after 10 days ,he first agrees for refund .calls back and says he cannot and will give replacement .

8.I ask for refund in evening .

9.After sending 5-6 mails after 3-4 days he agrees for 1915 rs refund .And the refund was done .

2months usage charges + 6% ebay charges deducted . For what ?

I lost 535 Rs + 100 Rs (to send back the modem) + 59+59 (2 SIM corrupted)+600Rs one month BSNL recharge I had done+ . = 1353 Rs total loss .

And the down time /frustration ....priceless ?

I had ordered a antenna for E122 ,which I cannot use now .

Basically he sent defective piece in the first place .

I had sent the modem with all the printouts,invoice and mail i sent him with problems. . He has sent the same modem to some one else now(TE member)(the entire package how i sent to him ) and that buyer calls me and asks me does the modem work ?:ohyeah:

Now what did he test in those 10 days testing period ? .Basically he has not even opened the package at all and he sent the same to the new TE buyer with his address changed.Had he opened the package he would have found all the details , problems and invoice I sent to him .

I need my refund and all the charges mentioned above .:@
 
If he indeed did sent the defective piece knowingly to someone else, that is not ethical.

Since he is also a TE member, let's hear his side of the story.. :)

You are getting very hyper ...you want even Rs 600 worth of BSNL recharge back !! I recharged for Rs 4200 and there almost 3 weeks when BSNL had disconnection issues...should I claim Rs 400 for BSNL as internet was totally unusable at that time after even giving some 20 complaints....even I thought it to be a modem issue at 1st but after seeing other Bangalore members confirm the same it was confirmed to be a BSNL side issue. There are lot of budding issues in the netowrk as well these Huawei 3G devices ! I have a Huawei E160G which died after 4 mnths after I bought from ebay India and the seller is nt even present nw ! Huawei modems as such are priced a fraction of modems by Nokia and other vendors but their QC is terrible and we are just facing the heat now

You are the only user who had a rough time with the E122 as most of them burned their hands with the UMG 1831. I got 2 X E122 + 4 X UMG 1831 and by the grace of God or sheer luck all of them are working like a charm. Even today afternoon I was getting 5 Mbps speeds . I urge all of the Huawei modem buyers to tinker as less as possible with the modems and the software and wait for dvdstoredelhi's latest batch to arrive. I hope dvdstoredelhi also gets these modems tested by a fellow senior TE member so as to testify his claim of all the modems are working fine.
 
Selling the defective product to someone else is certainly not acceptable.... More so when the second buyer is from TE as well!! :|

As for dvdstoredelhi, I purchased a 4GB Sandisk MicroSD HC card from his ebay store for 230/- rupees after using a 100/- off coupon. The class rating was not specified on the ebay link.

I had purchased it for a friend who wanted to use it in a Sansa. So, even Class 2 would have been sufficient. Knowing that this was a SD HC card, I thought it would be a Class 2 card and even that was a good deal for 230/- rupees.

I got the card in 3 days and surprisingly, it turned out to be a Class 4 Card!! I had a pleasant surprise!! :)

I obviously left him a + ve rating. :D

But after hearing your case, it seems like whatever he has done is not ethical. But I still need to hear his story as well as the story of the person who purchased the faulty modem.

But again, you cannot claim the recharge amount from him. That too is unacceptable.


You can hold him liable for the faulty device only to the extent of the devices performance. You cannot ask him to refund your recharge amount, the charge per hour for the time you spent trying to fix the modem, the lunch and dinner charges for the lunch and dinner you had while you were thinking about the modem issue, the coffee charges for the coffee you drank pondering with the modem issue and so on... :P
 
I think he should refund you full amount + shipping charges.....But still want to hear what dvdstoredelhi have to say about this......
 
No matter what all of us *think*, I doubt anything can be done for it here on TE.

The deal was done off TE i.e. on ebay and as such I doubt the TE mods/admins would be interested in getting nfsnfs his refund.

I am not saying that he doesn't deserve a full refund (in fact, he should get a full refund*) but nothing can be done about it here I guess.

* Full Refund means full refund of Item Price and does NOT include any Reimbursement for the BSNL Recharge!!! :rofl:
 
Its not a one off case, he sold a known defective modem which I had returned (UMG1831), to another TE member. I'm sure that he wouldn't even have opened the package and just sent it to the next buyer like this case and making huge claims everywhere saying he tested it for days continously and never faced a problem? Then how come everyone except him are facing the issues?

The BSNL claim part....Actually you can claim discount if it was a Post paid connection. I did it for my broadband once. Since you have given 20 complaints......... if you have an acknowledge copy with you than definetely you can claim for a refund by writing to the supervisor at the CSC.

I disagree with OP about the refund amount part (600 BSNL recharge). How do you expect DVDSTORE to refund that amount. Are u nuts....The other things you mentioned seem sane and acceptable.

These thing are part and parcel of online shopping but still sending a package which has been deemed defective by a fellow member to other member is least expected from a TE Dealer.

Let me remember ,lits of guys who got defective modems in first place . Varkey ,onlyravi,gigacore,funkykid,freaky ..... don't know how many more, ppl who still think its a BSNL issue .

Since he sent the defective piece in the FIRST place , it is his mistake (or rather deliberate attempt to cheat) . So he need to pay for this act .Due to his mistake or cheating I have lost/was not able to use that 600 Rs recharge.

You can clearly see its not NEW Modem going DOA . But sending a defective modem deliberately to NEW customer , which was returned defective from some one else .

Guys who are saying 600 rs refund is not acceptable ,could one of you guys send your working modem to me free of charge for 1 month usage .You will understand the frustration and anger and feeling of being cheated . I am not even asking that part of payment .

Its like asking the thief to return the money , but since he has given the money back ,lets no punish him .

Also I have bought from all the TE dealers till date except Prashant. Leave being biased....I am rather used to bashing the dealers when they are at fault

I tested the modem and neither did it corrupt my SIM + gave me Speed of 2mbps plus and I tried downloading a few movies and did without any disconnection problem

I still offered another E122 as replacement confirming it works fine but you still insisted on Payment Refund and I probably felt he may want to buy some other model from elsewhere.

I opened the Package and took out only the modem to check..did not check the manual etc and you probably enclosed your note within or around user manual so it got skipped..

and the BSNL 3G plan charges.

Even manufacturer warranty cant cover sim corruption as it is difficult to prove it.

The 2 problems I see here are that
* The dealer took more time than promised to replace the product. But it does take time to replace IT products especially for something that is imported.
* A defective modem sent to another buyer untested.
Probably the dealer didn't have stock to provide replacements/new orders and tried to do his best which I am not saying is right but not something to be treated like a crime

Please remember there are happy users of UMG1831 as well and he is the only seller to sell @ 2.8K when all other outside dealers were selling @ 3.8K. But this is no excuse for poor QOS

I agree with Sunish..... after 2 months of usuage if there is fault found in the product then u get a replacement and not a refund.

The above applies to the best shops and showrooms in india where they ask u to bring back the product within 2 days id u find any fault.

Also, i think its very tricky to determine if the modem has a problem or if its the BSNL that's giving the frequesnt disconnection issue. I remember when I got the U1831 from SunishJi I also faced disconnections for 2 weeks but I somehow figured it was a BSNL issue. I am using the same modem now 24/7 and no issues whatsoever.
