Ebay USA, Made a Mistake. What can be done now?

Hey folks,

I bidded for this Samsung Vibrant Galaxy S phone & Blackberry (T-mobile)* | eBay
and as i was the only bidder, i won the item. Paid using paypal with a fellow TE member's help.

But in the excitation of winning something for very low. I made a mistake. I didnt go through the seller's listing properly. The phone he was selling was on contract. The phone has to be used with T-mobile continuing seller's contact. Neither did i tell the seller earlier that i'll unlock it nor did he asked me that i'll have to use it for T-mobile. Though he says it is mentioned clearly in the listing. Well, i know am at fault here. I didnt go through his listing properly. But now he wont listen to me.
The seller wants me to get the phone to my name with T-mobile and end the contract with them because it would cost him USD200 as early termnation fee (this was the reaon he was selling this phone).
I have asked him to refund the amount but he doesnt want to. I asked him several times, but instead he started yelling on me stating it is my mistake and i should get an end to this.

Now i think i am stuck. I dont want to lose around 10k because of my this mistake. Can anything be done now? I'm screwed. :(

Any help/suggestions in any form would be appreciated.
 
You can always write to ebay about this, see if they can help.

Or you can list it again on ebay with the sellers help.

PS: Bidding won by mistake, reminds of the episode in which leonard wins a time machine as hes the only bidder (The big bang theory).
 
The account here involved is Ebay India account. Can Ebay india be of any help to me? Though i have Permanent Address as Shipping Address changed to USA but still it shows on ebay.in.

UPDATE: Just got a message from the seller.

I'm trying to re-post the listing right now. Leave me some positive feedback and I'll refund your money.

Should i leave him the feedback now? or after getting the refund?
 
if after the positive feedback he does not refund you wont be able to rise a issue with ebay as you would have accepted the item.

Speak to customer care at ebay to find a way out.

UPDATE: I can see, the seller has relisted the item and clearly understand that i cant buy this. But I dont why he is too stubborn about all this, and wants me to leave a positive feedback to him first. I just cant get why is he not refunding!? Refunding shouldnt be a problem i guess. Dont know what does he want! :(
 
Wait for 7 days if he doesn't update shipping details , ebay will refund your money.
If it is GEB then time limit is perhaps 14 days to update shipping details.

Don't give any feedback until you get your money.

Its worth a try. Its a genuine mistake (no way to use t-mobile in India) and pretty hefty one so I think they WILL side with OP.
 
you have got two ways out.

one raise the dispute on paypal after 7 days of payment.

as he has not updated shippping details,you will get your money back.

now talking of feedback,DONT entertain till you get refund.

second way out is to get the phone shipped and then unlock it off.
 
Thank you all for replying. The thing is:

1. He can't ship the phone in any case. Even if he wants to, he cant. So Is it for sure that i will be getting refund after 7 days??

2. He has relisted the item and stopped replying to my refund requests now.

So should i make sure that i'll be getting a refund because of non-shipment of item within 7 days?
 
why he cant ship the phone?

if you have a aramex account.you can ask him to ship it if you want it.

if he has stopped responding,

you can get all his details on ebay .no customer care involved.you can get it on site itself.

now 7days after you paid,open a dispute in paypal.

rightaway.

wait for 2 days to see if he responds to paypal dispute,

if no response,escalate it to claim and again after 2 working days,

call paypal customer care.

it should close your deal with refund and leave him negative feedback as the case is.

is he asking you to give him your tmobile account details--no.

then why the hell you waiting?
 
Do not make an account with t-mobile, the terms and conditions of original listing does not mention that you need to have an T-mobile account, you are not obligated to open an account. Listing only mentions that the buyer needs to call the service provider after buying the phone (which you will after receiving the phone:P, cause without seeing the original condition of phone you cannot agree to service providers contract )

and do not leave positive feedback until he ships you the item (which obviously,, he is not going to)

You can open a dispute later with paypal for non-received item and you should be able to recover your money. when you open a dispute just mention non-received item and nothing else.

In the meantime let him sell his stuff...

This phone is only 9 months old and was kept in a case it's entire life. No scratches on it whatsoever, it looks and works like brand new. Made the payment yesterday itself. around 11 PM. So it is around 14hours from then.
