Ebay USA, Made a Mistake. What can be done now?

See if the item was "relisted'' or a ''similar item was listed'. If it's the former case, leaving him a good feedback will tell ebay that the feedback was fraud and might find some fault in your side. If it's the latter and you leave him a feedback, means that you have received the item. Best would be to get in touch with ebay and let them know the truth.
 
look at your options..you are not going to agree to the contract and pay more money, AFAIK you are not even eligible to sign a contract since you are based in india and do not have SSN.

I will suggest that you wait for a while and file a dispute for item not received,

another option is that you talk to ebay and let them know everything..but however there is a risk that you might loose the money in case ebay asks you to complete the terms and conditions of sale.

leaving a positive feedback means you have received the item and are satisfied with the product..you will not be able to claim refund.
 
dont involve EBAY usa as you have not read item description and you are at fault.

Involve PAYPAL to dispute---claim----call them to close the case.

simple.
 
Are you sure that is going to work out?

This has been getting tense and i do not want to end loosing 10k :(
 
surest thing would be that the seller refunds..other than that the paypal dispute seems to be the viable option and there is a risk involved...however i have found paypal to be buyer friendly and they have initiated refunds whenever i did not receive items
 
Damn, you are in a big mess... :(

I would suggest that you be as polite as possible to the seller. Any anger or frustration can mean a monetary loss for you. And in any case, it seems like you cannot do anything until a week is gone.

Another way would be to suggest the seller to retain some percentage of the amount. Say 5-10% for the trouble caused to him. Ask him to refund the balance. Also promise him a positive rating upon refund. He might agree to this.

I am aware that it was a mistake and that you don't deserve to suffer the loss but then, sometimes it is just better to take a minor loss and settle the case rather than raise a dispute and risk everything. Believe me, I know what I am saying!!

Whatever you do, remember that recovering your money is your goal and not settling scores with the seller. Hope you don't end up losing a lot of money. All the Best.

But he was very rude throughout and told me that i should only message him when i go and talk to T-mobile. he doesnt care from where i'm from or anything. Now he has even stopped replying to him. he said that He will REFUND all my amount, but what he wants a positive feedback first, which i declined.

^^ You asked him to keep the seller fees. Something that he'll have to pay to ebay. Ask him to keep a small amount for himself over and above the seller fees. See if he agrees.

Ignore his rudeness... for the time being. Tell him that if he doesn't refund, you'll have no option but to raise a dispute with Paypal which you want to avoid. Tell him that if you don't receive the item, ebay and Paypal will in any case refund your full amount and would even take action against the seller (him). Reason it out with him that such an approach is neither favorable nor profitable for both of you.

Don't threaten him or try to be extra smart with your words... In fact, pretend to be an innocent fool... but not so innocent and foolish that he may consider you dumb enough to be easy to cheat on!
 
I don't think you can raise a dispute at Paypal, as it will redirect you to open up a case at eBay. I tried once but no luck at Paypal..
 
If both the seller and buyer mutually agree to cancel the transaction, the seller does NOT have to pay any fee or anything, so he doesn't really lose any money.

Well, in any case the listing does not mention that you have to do all this before receiving the product, what if the condition of the item is not as described? He can't force you to sign a contract before seeing the actual phone.

So IMO if he can't ship the phone first, you have the right to open a dispute on eBay saying Item Not Received.
 
According to me the money that the OP paid the seller he has already used it so he cannot refund the money back... So now he is waiting to sell the phone and may be later will forward the money to OP... Not replying to mails and avoiding is a standard technique used by people doing business, employ to stall a particular action/procedures that they have to do... This is my 2 cents but i could be wrong on the matter and you should not trust him at all....

OP Wait for a couple of days and just call customer care and inform them that he has not shipped the product and should refund the money...
 
Seller message me at ebay a few minutes back that i shouldnt talk about refund, i should just call T-mobile and do my part of agreement. I have replied to him warning that if he cannot refund then i am raising a dispute with paypal, and let them decide!

Another thing, initially my ebay account was an Ebay India one, before making this trasanction i changed my location to united states to use the Aramex account. The account logs in through ebay.com and goes to ebay.in. The Item reciept mail which i got says Payment method as PaisaPay? Is this something to worry about?

Also i have been in touch with the seller outside ebay at gmail regarding the phone and this issue, i sent him my mail id to him on ebay? is this considered illegal?

Just now when i logged in, i got a warning message from ebay that they have seen some suspicious activity with my ebay account. And i may not be able to list new items until that is sorted it. I believe this is because of the thing i've stated! I hope they do not block my account now. Otherwise i'll end up losing 10k for sure. :(
 
PAYPAL wont redirect you to ebay.

its two seprate entity.

open case in paypal and call them after 2 days or so.

they will do the rest.

they do accept your case and give you sane solution and they do favour buyers.

I tried to explain him as what you've said in the second line, but still he insists that according to the listing, i've to call t-mobile and accept my end of agreement. Once i do it he'll ship it. I'd warned him that i'll be raising a dispute with paypal, but he doenst seem to care. His each and every reply to me states the same thing.

Now to try smoothen the thing, i've asked him to keep 5% of the total and refund the rest (as Suggested by nehaladsul). I've tried to explain him in every suitable way that i dont want any of ours loss.

Keeping fingers crossed, lets hope that he replies in a positive manner. All this conversation was held at ebay. I've stopped mailing him thinking ebay has warned me because of that.

Now, how can this be rectified? when i log in to ebay, an interruption message is shown witha awarning, and says that i should head over to my messages to look for a message sent from ebay, so that i can let them verify. But i cant find any. I hope this doesnt become a hurdle in getting my money back.

call up ebay via skype.

fix your account first.

get it in good standing with ebay.

once you do that,

offer seller that whatever ebay charged for auction.

you will refund him.

if still not listening,then open a dispute in PAYPAL.
 
Why is it that the device cannot be shipped.

It could be that the seller is not liking your behavior, and complained about you not following eBay protocols, since they mention that no communication should happen outside eBay.
