Friend got cheated from a CA advisory firm. Time for some action!!

When you design,
1) Take 50% or more advance. Convince them with your previous work.
2) NEVER give the design till final amount is payed. Watermark or use extremely small resolutions.
3) Walk out of any conversation that starts with "but its just a design". Also ask your friend to charge about 8-12k for Brochures, not lesser. The cheaper you offer the more idiots you attract. Work less but work for good money and on good projects.

If you want to hurt him, design posters, go outside his office, print and stick on the wall.

Better yet, find the building they have the office in, Write down the names of offices there and around. Write an anonymous letter to all of them showing their business practices and what a sleazebag he is. Teach the bastard a lesson.

Also send it to ICAI (Institute of Chartered Accountants of india.) Find the local branch on www.icai.org Write them a letter alleging "moral turpitude" and sleaziness. If you want I can help you with the document on ethics and you can cherry pic the cases underwhich you want to complain against him. He can actually be suspended for six months to a year.

Once their reputation is down the drain, you'll find him more willing to listen to you.

2) Here designs werent ever submitted and yes everything was watermarked and sent only on whatsapp and just the front page was exchanged via email that too copyrighted.
3) Nobody can go and charge anyhow for anything. There needs to be a fair price and all depends on design complexity.

Second plan in action is to print Pamphlets on his name with his number and mentioning thats its an Escort service for dirt cheap rates with hi-class babes. It will then be circulated in other states or in other cities. So anyways he will be to his complete shame & if somebody registers a police complaint then bhagwan bachaye...

ICAI plan will need to be thought upon but thanks for the advice.

stick to the lack of payment and cheap behaviour.
one thing your friend should realize, is not to waste too much time on this as it's not worth it and chances of getting payment is remote.
think of it as a just a way to mess with his happiness the same way he did you're friends.

You begin work without taking an advance = Amateur.
That's the way people think and will consider you. Lose a project or two, but never settle for less money or without advance, people will take you a lot more seriously. And in the design world, people taking you seriously is the difference between 2 iterations and 10 iterations. Just my 2cents.

Your friend can only take this as an experience, put this behind and move over. My sister is in designing and she had got duped many times, not small companies like this but bigger corporates. It is not the company but the people who manage in that place. If they are honest and have ethics there is no problem. As you have mentioned about your friend, my sister was also called out for dinner, parties and all but as she did not play along the payments usually stops after the advance payment the reason being the design is not good. In some instance they also ask to repay the advance. This happened with very big corporates, not one but several big corporates. Women are still seen as commodity by our male dominated Indian society. This is just a beginning for your friend and she has to go a long way. Hopefully she would get over this and come out strongly.

He is waiting for nothing. Who cares or values for a freelancers? At least not such jackass pathetics. And doing anything is simply a call of my friend nor me or anybody gonna force him/her for any actions. Nor I will be held responsible for anything. Then doesn't matter if its anyone neck, belly or a$$ on online. Its gonna hurt.

If a person stoops down in terms of character, it does not mean others should do too.
Along with skills, its better to set few ethical principles.

I can understand how one feels when they dont get payed for their hard work. But there is no use in creating issues to such clients. You will lose even the remote possibility of getting compensated.
One more important thing is, have they used any of the designs created by your friend? If they have, you have an option to approach the partner and make him aware of things.

I have had couple of such instances and can say that I have learnt from it.
1. Never start work without signing an SOW
2. Clearly mention the terms of payment in writing
3. Make sure you get the first payment initially or by first milestone
4. Always communicate using email (official one) - even if you talk over phone/whatsapp - make sure you mail the client the gist of discussion
5. If your initial discussions are with 2 people, keep them both informed. Even if just one person is usually responding
6. If a potential client is vague in terms of requirements & deadlines, you set the deadlines for them (This could be like - 'I have another project starting from June 8, when can I expect a nod from you so that I can schedule time for you'). And if they still dont bother, put them on lower priority or drop them.

It is better to focus on work than wasting time and peace of mind on such people.
