Legal or not, it's surely unethical to sell something that you received for free. The company (Canonical) sent you so many (bearing all costs) in the hope that you will share it freely. There are other packaged distribution CDs I have seen in book-shops that are for sale, to cover for distribution and media costs, probably making small profits in the process.
But selling the official Ubuntu shippit CDs? Shame Shame! The seller(?) better give it free+shipping!
