if you are buying new, desire is the best choice. although nexus one will have very quick updates as evidenced by froyo. milestone is slower than desire and legend is slower than milestone. xperia x10 despite having similar hardware lacks multitouch, runs android 1.6 , and is slower than nexus one/desire.
 
Yup am really blown away by the awesome form factor of the Desire, but don't really want to get something that expensive without a bill / warranty. :(

So will wait it out to see what else turns up for now.
