:):) these government staff are the main culprits as i remember when FTV was banned some years ago, the then I&B minister said we watched FTV :clap::clap:and it contained lot of nude stuff (i guess it was Rio carnival time) and therefore not suitable for Indian viewers.. earlier the FTV was a direct link (relay) from Paris and therefore can't be controlled

If distribution is illegal then how come it can be consumed legally:huh::huh: if you cut all the sources i.e. distribution then how will it be brought or is it that one should take care of all these stuff on his own:p:p

Exactly and even if they have to file a case against me then they will have to file it against BSNL which is my ISP and also my distributor of porn :) and me a only a cosumer (this is where our Indian laws rock!!)
 
If it was illegal, then you couldn't open porn sites AT ALL. Which happens in the Muslim countries. But will happen now in India for the .xxx domains. But if you're smart you can still view them via proxies :p

The law also states that production and watching pornographic materials is legal but distribution of pornography is prohibited. The High Court order only stated that Section 292 was not applicable and the porn addicts interpreted that 'viewing of pornography is legal' in India.

The Indian Penal Code under Section 292 contains punishment for possession, circulation, exhibition or distribution of obscene materials whether it is in the form of a book, pamphlet, writing, drawing, painting or representation etc.

In any case, the matter is disputed and n number of petitions relating to porn are pending before the SC. I hope you know that precedents of the HC are subject to approval of the SC.

Now for the Information Technology Act:

Section 67 provides for punishment for a person, who transmits or publishes or causes to be published or transmitted any material, which is obscene in electronic form with both imprisonment and fine. Further section 80 bestows powers to any Police Officer not below the rank of Deputy Superintendent of Police or any other officer of the Central Government or State Government authorized by Central Government in this behalf, to enter any Public Place, search and arrest without warrant any person found there, who is suspected of committing any offence under this Act.

Section 67 considers the obscene material in electronic form by itself to find out whether it is so obscene that is likely to deprave and corrupt those, where minds are open to influences of this sort and into whose hands the obscene material in electronic form is likely to fall. Technically speaking, section 67 like section 292(1) of Indian Penal Code does not make knowledge of obscenity an ingredient of the offence.

In any case, had it not been for the new TE Rules (Keep TE Clean) by Renegade , my response would have been very different. So, please mind your tone when you 'try' to make a point.
