Note: I might have missed something from the events and the sequence might not be perfect for some but have put forth my case as briefly as I could

@The Knight


Instead of contacting you prior to opening this thread, I am directly posting the issue here. I want the communication to be seen by everyone.

Below is the sequence of events that happened:

1. Had purchased a Nexus 4 16GB Black around 15th June for my best friend from The Knight.

2. Device was promptly shipped by him on 16th June using DTDC.

3. Received the parcel at my office location sometime in the afternoon. Confirmed that the device is there in the parcel and signed of the POD.

4. I open up the package and check the phone. Things which I notice are as below:

-front screen film was heavily scratched.

-markings in white color( +, - and power circle on the film seemed way different than what actually is there on a colleague's nexus 4 who sits next to me at my work place.

-The notification LED at the bottom of the screen was a huge circle which didn't merge with the screen and was looking more like a secondary camera at the bottom. It was a big eyesore. I immediately compared it with 2 Nexus 4s bought from flipkart and the notification LED was not visible in them as if it was totally hidden. Note: Picture attached below to the thread.

-The lettering on the box of nexus 4 was again not original

5. All of the above was immediately highlighted to The Knight. Over the call, I stated that the phone seems refurbished to me. The front glass seems a cheap OEM to me. The box lettering shows the box is also not original. Scratches on the front factory plastic (they were like the ones that appear when the phone is used by someone for a few weeks. All of the above was communicated to him within 1 hour of receiving the phone.

6. Initially, he suggested me to sell off the phone locally and get back the value I paid for it. I disagreed to that and stuck to the point that I want a refund. He explained to me that his dealer would only replace the phone and not give back the amount paid for it so I agreed and shipped back the phone (it took me 3 days to ship since local dtdc franchisee refused to ship a mobile phone). Later after agreement with The Knight phone was shipped back using Speed post.

7. After receiving the phone, he initially informed me that he personally checked all the devices with his vendor and almost all of them had that big brown hole for the notification light apart from 2 Black phones which looked like were nothing having that.

8. Next day he went to collect the phone and one of them was sold and the other did not boot up :S.

9. Again on his next visit, he told me that black ones left with his vendor, all have that kind of notification light brown holes and only one white one was remaining. I had to convince my friend that white one also looks good and anyways she was going to put a case on the phone so black or white the front part is all the same for both of them and she agreed.

10. I strongly told him that I need a BRAND NEW phone for which I have paid with original box, without any scratches on the factory plastic put on the phone by Google and all original accessories. He told me that phones are imported individually/separately by his vendor and accessories are imported separately but all are original and just the box might not arrive as the original one. At that point it was already almost a week past after I had paid and had to give the phone to my friend by that weekend, so I made a choice and agreed to him.

11. He shipped the phone and I received it the next day evening and checked it to confirm if all was fine. The front plastic was having scratches but not to the extent of previous one and was acceptable. Accessories seemed original and the most important thing the display did not have the eye sore like brown hole around the notification light. I confirmed it to him over the phone that I was fine with the device and all was ok.


After 4 months down the line during which my friend was using the phone, phone was lying on a desk overnight and in the morning suddenly she noticed a big crack from going wide from left to the right side of the phone and was shocked to see that. I get a call immediately and we are clueless of how that might have happened. I got cursed so much by her. Man I have no words to explain that.


I took me so much time to convince her to get the display and digitizer replaced from LG service center. Immediately next day the phone was taken by me to LG service center in thane which is 10 mins away from where I live.


Things which happened there were again shocking:

1. Since the touch screen had stopped responding at 90% of the areas, it was not possible to see the IMEI by going to settings>about phone option.

2. The girl attending us picks up the phone to remove the sim tray and even before taking it out, she with her eyes wide open told me that the tray doesn't seem to be genuine. I keep mum and wait for her to remove the tray.

3. She took the tray out and told me there is no IMEI on the tray. She asks me for a bill where she can find the IMEI which needs to be entered in their system for accepting a device for repair. I told her that it was bought of ebay so no bill there with me.

4. She took the phone with her inside to their technician and came out after 5 minutes showing me the back white panel/cover's inside portion that there is no IMEI here also. There is a sticker placed there with the device IMEI number it seems which was also missing making us think that the back panel is also a replacement OEM one. May be his vendor converted a black phone to a white one.

All the while this was happening, my friend who owns the phone was with me standing behind and just furiously staring at me and I had nothing to tell her. Leaving all that drama apart. I had to leave the service center with the phone.

I come home and remember that the IMEI is captured by google when an account is linked to an android phone. Found it out on Google dashboard and was successfully able to submit the phone the next day with that IMEI number.


As of today when I am posting this thread, it’s a week past and I am waiting for the service center to call me back confirming the phone is repaired. Charges communicated at the time of submitting the phone were INR 5233/-.


I am unclear of what actually can be done by posting this thread but I wanted to bring all of this to everyone's attention. The display getting cracked without any physical damage makes me think that the white Nexus 4s Display was also OEM and not original.

If the screen was cracked, that most definitely has to be your friend's fault. There's no question in that.

Also, I guess that's why I don't help friend's with their purchases. If we do, then its like we are their repair man guy... who have to fix everything for them on their phone and even say them like we are guaranteeing(even OEM's provide warranty :P ) that everything with the phone/gadget will be okay.
 
We are drifting from the topic here. We have a member here who is selling refurbished/repaired products in the name of Brand New imported units. Buying an out of warranty/imported product does not really mean that's its definitely not going to be brand new.

People have even received refurbished products from sites like Flipkart so there is no limit to "spend some extra amount for piece of mind"

I think there were couple of guys who bought Nexus 4 from TheKnight. Whats their response been? Secondly, I think it is better to get some screenies from the seller even if he is getting from a dealer. This avoids any shock on receiving the product. If the seller claims it is a packed product, you can look up/show him unboxing videos in case there is a structural difference.
All in all, while dealing online its better to check not once but as many times as possible.

(even then she would have to bear charges if she cracked the screen) she needs insurance .. and a otterbox defender

Yeah they were couple who faced the similar problem with him they to got a refurb used phones from him one of them was @bking.

Sorry i don't agree with you. Nothing personal but you might be used to getting refurb/repaired products under so called imported/out of warranty tags but i am sure many of us haven't had an experience similar to yours.

May i know how you concluded that? Brand new units (without LG warranty) were being sold on eBay for 500 to 700 more. If that value saved made you conclude that i got it for very cheap then i have nothing more to say.

One thing is for sure, she didn't drop the phone whether you believe it or not. That's not the point. As @karankapoor highlighted, there have been other instances as well. Whether it was dropped or not, the phone paid for was a Brand new unit and not refurb/repaired. Things pointing out to a refurb/repaired unit:
Sim tray was duplicate(no IMEI)
Back panel didn't have the IMEI sticker (confirmed by LG)
and the first phone which was sent definitely did have a replaced display.

Do we really ask for pics when the unit being sold is claimed to be brand new? From the outer looks it seemed new so i accepted it(second phone which was sent) but later when it was taken for LCD-digitizer replacement, the service center guys clearly pointed out the differences which clearly points out that the unit wasn't brand new.
 
Sad to see this happen to you. You were conned. Maybe even the person @The Knight got the phone from is the root fraudster here. Though once you had shipped it back, and had a bad experience with @The Knight, you should have pushed for a refund and stopped all transactions with him. And not continued the deal.
 
4 months is beyond late... lol and sorry to say if the difference was just 700 rs.. then its totally your fault .... the knight sold me a note 3... i didnt like the piece.. i sent it back he did the refund within a week.. i dont have any issues with him..i got it round 8/10k cheaper.. which i thought was a good price for a refurb/imported piece ..... but since i wasnt happy cuz the phone refused to update via kies (ran fine otherwise) me and bking both got our refunds... the knight was always in touch and helped with the refund.. so i wouldnt exactly call him a fraud here.. .. now after 6 months of using the phone he comes down and says fake this fake that... i dont see the sellers fault ... he should have pushed for a refund back when he had the chance or got another phone/make all together .. anyway... whats done is done... . we all learn our own lessons.. now u will know what exactly to do the next time ur looking for a phone.

I agree on your point that its late. At the same time you are again coming to a wrong conclusion. I asked for a refund many times and i really mean MANYYYYY times. All the time he said he will only be providing replacement and not refund as per the details mentioned in his thread this communication was over call. Whatever was communicated on call, i immediately had sent him a PM. Refer to the screenshot of the same. At the same time i had checked his thread for the terms and condition and he had not mentioned that NO REFUND clause that time.

Over the initial calls he didn't agree for a refund(telling that he will have to refund from his pocket) but later also told that his friend takes long to refund approx a week. So he insisted on me accepting a replacement.

After this we had some communications related to DTDC franchisee not accepting a mobile phone else they were charging exorbitantly but then even after 2 weeks(counting from the day i paid to him) he failed to provide a Brand new phone, i PMed him this:

Between the time he received the the return shipment and was arranging for the Brand NEW nexus 4, he happened to communicate things like most of the phones have that notification light brown module visible/ phone did not boot, no black color available etc etc over the call. He even agreed to a refund:

Then suddenly i get a call (After he agrees for refund) that white one is available(brand new phone) and his friend is not agreeing for a refund (mere pocket se jayega, i will have to bear the loss, i am not earning any profit in that plus i have spent so much time in going 2 and fro to his friend's shop, etc etc. this happened over call). Since he requested so much i agreed to it.

Phone was received after 2 days i think(don't remember exactly) physical condition was new, i had no complains about that. Notification light module was not visible at all, the factory screen guard with Google written on it hardly had any marks. Externally seemed like a new phone so as we had agreed, i accepted the phone.

@toxicdrift, you were able to return the phone(Note 3) in time since its update failed in KIES. My case is different. The phone updated correctly and no issues faced further until one fine day the display developed a crack all of a sudden and the service center guys couldn't find the IMEI inside the back panel nor on the sim tray. Now please don't say that i should have opened up the phone the day i got it and verified whether all parts are genuine or not :p ( just kidding)

There is a chance that The knight himself may not know about the switch his dealer may have done. We can give him benefit of doubt. But I would now exercise even more caution when buying high value items and would avoid being penny wise pound foolish.

It's The knight problem to check the stuff he selling as I'm sure he us not doing this for free he buying adding a margin and selling to the members for easy money.

Exactly. I don't know until came to this thread. If a guy who is importing such mobiles from past two years said that its brand new then what should I do? DO you think that I made huge (10-15%) profit? Its not. I took only 500 as my convenience fee for packing,shipping and going there. When I doubted then there after I withdraw all Nexus 4 and Samsung devices from my thread. I know everyone is blaming me but I also shocked. But one thing I want to be clear here. I sold many pcs of Xperia/HTC/G2 specially after vriship incident and bking, I checked each of them and came to know that all sim tray has their IMEI, and I found the imei sticker on the back of G2.
 
Whether you know it or not! You are the one selling the phones here under the pretext of purchasing it from a friend who owns a shop and deals in phones. So its your responsibility to be aware of what type of goods you are providing.
AFAIK the incident with @bking happened much later than my purchase from you. Correct me if i am wrong. You while providing me the white Nexus 4 had told me over the call that you will be pulling off the nexus 4 from the deal thread due to majority of the phones having that kind of notification light module visible which you didnt and later the incident of a used phone being sent to bking happened.
Didn't you tell me over the phone initially when i complained of the issues in the black nexus 4 that "kisi ko bhi bech do locally. People will not be able to make out the difference about the display notification LED module and will buy it considering new device" to which i strongly disagreed.
 
Its so evident that the phone sold was refurb.
The onus of checking the genuinety of a product lies with the buyer and its important to check the product of its condition and ask for more pics when in doubt before purchasing the product so that things are clear on both sides.

Also, if someone is selling a product here, its his whole and sole responsibility to make sure that any complaints related to the product and the sale is on him and do not try to make excuses like "my frnds phone", "im not the actual dealer and am just a middleman" etc here. Specially with imported and products with no official bill or warranty. If a bad deal cause a loss to you, bear it because its you from whom the buyer is buying and not from an online site or shop that he can hold accountable for issues like this.
