Passport Renewal process

My current passport is going to expire in around 6 months.
I wanted to renew my passport, but I had two main questions before I go ahead.

1. Current passport has active B1/B2 US visa with 9.5years remaining. What will happen to it, do I get my old passport back when I renew it? I have read online that I will need to carry my old passport when I travel to US.
2. I currently involved in a court case (minor traffic accident, with no one injured), will that cause any issue with renewing my passport? Police verification happens everytime someone renew their passport?

I am planning to go tatkal route.

Yes. You get your old passport back with a seal saying passport no longer valid, but visa, if any, remains valid. You will need to carry both old and new passports during your travel.

No idea about the case. But police verification always happens.

yeah, I'm more concern about no.2
i don't want my passport to be seized/suspended because of this
 
If there is a pending criminal case in court, you need permission from the court. If it is nothing grave, I believe the courts do not object to granting of the passport. However, my knowledge is limited in this regard.

1st should not be problem u will still have the old passport with you .
2nd Think if you go for Tatkal normally you will get your passport first there are chances sometimes police might or might not verify but key thing is police will ask you money and leave unless your famously known at that PS
