But in India as Soundmagic is not there , Think of them = US but not with the exact same policies and Terms and Conditions, we define our own terms and conditions and warranty policies as we give warranty not them

So we stopped and are not going to get new so its EOL for us and this is how we handle the warranty if it comes to this scenario

When the Manufacturer is not there in India , The distributor decides are Warranty Terms in the Country that he sells the same.

Tomm Sound magic may offer 10 Yrs Warranty or even now lets say they offer 10 Yrs but i am free to assign a different Warranty Period and Different terms and conditions all of which cannot be told at the time of sale.
 
In the end Rahul, you are losing one good customer and a 100 other prospective customers all for the sake of 2 magnets and wire. Customer satisfaction is what you should be thriving on.

What happens if I receive an email saying that the item I returned via RMA is no longer in stock?

If the RMA item is not in stock, TheITWares.com will contact the customer and discuss replacement with a different item or a mutually agreeable refund amount.

Mutually Agreeable = I should also agree to it right?

Who will pay the shipping charges for defective merchandise?

TheITWares.com does not pay the return shipping cost for defective merchandise.

All these are the way it was since the time it was created not a single word has been changed a Member (Punker) in this thread itself had posted the 1st question so he should be able to vouch for it

These are not Faltu posts when I or Anyone imports / distributes anything and if the parent company is not there in India then the importer Distributor is Free to set whatever terms and conditions he wants to work with coz here he will be providing the warranty for the same not the service center or the parent company.

Tomm i can import Soundmagic and sell the same with 1 Month warranty its my wish and this is not faltu this is correct

Do you agree that once a bill is made and the customer pays the amount, you are legally binded to provide him service for warranty/rma???

If yes, then,

1) kindly show us the customers signature and letter where you had written terms and condition as said by you now.

2) Kindly show us the license which assigns you to be a Distributor of SM, and the Authority that SM has given you to lay your own rules and regulation.

3) Kindly show us the proof that states that you have the "Rule of Daily depreciation" and was accepted by the customer.

4) If you are so stubborn about that you are right and wont bend, then kindly let us know the reason for switching your CN from Rs.400/- to Rs.600/-???? If you are right then any reason to settle by giving money for something which you think is "Wrong"???

5) Any proof that confirms that you have stoped being a distributor of SM, and contract termination letter to confirm the same???

Please help me with the above information.

and if you cant, then stop crying for your mistake and pay up. You cant cry when the time comes to stand up as a businessman, and accept that others are not your slave and will forget Rs.300/- just because you are a lousy businessman.

I see kids year after year from Indian origin winning the spelling Bee contest, those little guys get the meaning of each and every hard pronounce words But you after an explanation of 20+ pages couldn't get the meaning of "Warranty".

And Please don't even Spell PrimeABGB I have bought my entire rig Shipped from Mumbai to Andra and always been happy with.This business just happen on trust and you breached It

Note: i really wonder how you are understanding this? You call all TE members "Unreasonable" and you are a nice guy.If you are really nice at least then you would have definitely got Support , i just wonder how you are spoiling all your Rep just in one day pal,Hope you start revisiting your logical ability to make decisions
 
Soundmagic cannot authorize me to do anything they have no power on the way i work i can work in whatever way i wish and they cannot stop or have any authority here.

Check on the Soundmagic Site our Name is there in Where to buy section.

We too have many wishes after reading your replies... :) Think over it and please for gods sake, if 900 is small amount for you then replace those sets....

again everything is going around in circles, my brain is a bit dizzy after reading evrything again and again,
@others, don't post anything now, let the mods and OP decide, your efforts are wasted as Rahul doesn't seem to get your POV, he has no remorse of losing customers as he believes in his capabilities of marketing, i.e. go to hell,

it's about time we leave it here, nothing more can be done, Rahul is adamant, it's like force feeding a child.

Let OP get a return mail from the manufacturer, he may suggest some alternative path to which , HOPEFULLY, Rahul may agree to, or the case registered at consumer court may bear some fruit for the OP. we on other hand should be supportive of the party asking for justice, as socerrer said, don't pounce on Rahul, 22 pages and hardly any progress.

you CAN'T force Anyone to UNDERSTAND until he is ready to.

I was keeping track of this thread from yesterday....just refraining myself from posting here. Now it seems like rahul is very egoistic. Come on rahul, you know that you are wrong..you are a dealer and you know what warranty means, no use of justifying yourself here, this is not a children playground, this is TE and everybody is tech literate.
 
You had posted my T and C from my site right

It says Mutually agreed upon , what customer is asking for Rs. 900/- i do not agree plain and simple.

This has been said numerous time in this thread, you offered one year ITWares dealer warranty without any terms at the time of sale, which clearly means buyer is eligible for either equivalent or higher value replacement or CN according to current market price of new(not prorated) even on the last day of warranty period.
 
Manufacturer email or whatever he can give you can take from him but he cannot force anything on the way we work.

Our FAQ's are posted on our site and are same for everyone and is not something which i have invented new.

After reading all the dealer post i get a feeling that amarbir has hacked rahuls account and posting all his replies on his behalf. :rofl:
and about not having stock it is a lie white lie.
It is just that you do not want to stock them anymore since pristinenote is selling those same sm products at much cheaper prices.
 
Maybe rahul has them in stock and just doesnt want to give a replacement. How can he prove he doesnt have them? The OP believed him when rahul sold it with 1 year replacement warranty but that was a lie apparently.
