US opens probe against TCS, Infosys for H1-B visa violations

The US government has opened an investigation against two of the biggest Indian outsourcing companies for possible violations of H1-B visa rules, according to a media report.

The Department of Labour has opened the investigation against Tata Consultancy Services and Infosys for "possible violations of rules for visas for foreign technology workers under contracts they held with an electric utility Southern California Edison," the New York Times said.

The power company had recently laid off more than 500 technology workers amid claims that many of those laid off were made to train their replacements who were immigrants on the temporary work visas brought in by the Indian firms Senators Richard Durbin of Illinois and Jeff Sessions of Alabama announced the investigation after they were notified by the department, the report said.

Good move by US govt. These companies are responsible for a lot of visa fraud. I hope they will investigate outside the bounds of this particular incident as well.
 
Terrible living conditions for employees too. If anecdotes on Internet are to be believed, about 10 guys are crammed in a room.
 
I thought it's up to the employees choosing the mode/place of accommodation ? A lot of people intentionally do that to save most of their salary than live healthily.

I know for a fact that Infosys used to pay around 4000+ USD after tax, for TCS it was bit more or less. These numbers are from 3-4 years back and for people with around 5yrs experience. So I guess they might be a bit higher now and even higher for more senior people. This is good enough for any person to live comfortably by himself/herself in a decent locality (except NYC of course) and save more than $2k .
 
^^ if you've lived in the US on payroll of such companies then ofcourse, i can't argue with you :p

That situation won't change even if you pay them good. I have seen Indians with good companies earning great pay packages behave similarly. Majority of Indians are by nature miserly and greedy. They will take a sack of Maggi packets with them and live of it for months or years to save every bit they earn than spend their money and live like normal humans do. But give them free reign to spend somebody else's or companies money and they will not stop stuffing their face with food and drink till they choke to death.

Recently a guy at my company got fired. What did he do? He had spent about Rs 6000 on a physiotherapy session for his kid at some hospital. That amount is a days salary to him and he also has the option to claim it through the companies medical insurance policy. He got greedy and forged 3 more copies of the receipt issued by the hospital to look like it was for multiple sessions and put in a claim for 24k. A quick verification call by the insurance company to the hospital exposed his fraud and the insurance company promptly filed a case against him and notified the same to the company. He was fired and I don't think he will get a job in another company with a police record for fraud.

Yea, I remember back in 2001. There were a lot of people going for 3-4 months to the States. They would take...Maggi, flour, rice and spices. So outright weird. You know what the highlight of saving all this money was. Visiting a God-damn strip club..! They would boast about it, on return. LOL. That too, in a large group. Or stupid things like: buying a camera..using it, and then returning it via abusing the the stores return policy. They would live in their cultural silo and be non-adaptive to the surroundings and region. Indians have a hive mentality, and stick to it, till the end.

"Indians" living in their own misery is not the issue here. The company and the individual filing for a fraudulent visa is. I know many people here like judging "Indians" here but then what you guys are discussing is totally unrelated to the issue here.

Hyderabad, and yes, I know Income tax fraud is pretty common. 45k Rent receipts while residing in their own houses, fake medical bills and people setting up a charitable trusts, I have seen that all. Last year, there was some consultant company that advertised that they offer various services. One of them was "professionally" made medical bills for Income tax purposes. Seen all kinds of abuse. The finance manager at my office asked me once why I don't do that stuff to save tax and even declared that I am the only person who pays taxes honestly at my workplace comprising of close to a 1000 people .

But still, this guy went too far in thinking that he can dupe an insurance company in such an absurd manner. I know that insurance agents and doctors also help facilitate medical insurance frauds, but I don't know what made him think he would pull it off on his own.

Funnily enough most of these tax evaders and cheaters were self proclaimed Anti corruption activists and Anna Haraze and more importantly AAP supporters. They even participated in demonstrations and such in Hyderabad. They questioned me why I don't participate in those bogus protests. When I questioned their own actions and practices, they like to write it off as "tax saving" and that there is nothing wrong with it. It is apparently the politicians alone who are corrupt.

What is relevant is that often this inane greed and knack for fraudulent behavior is reflected in how these Indian services companies operate. When ever they get hold of a project, some managers will be out there coaxing and poisoning the people from the client company into replacing their employees with the people form the services company. The bait is not the savings for the company, but some incentives for the manager level people involved. So they are often not making these decisions for the sake of the company, but for their own benefits as well. The services companies are required to look for the requisite talent locally, so they announce openings, but shoo away anybody who answers those ads by stating that the vacancy is already filled or some other means of rejecting them. Then they show that no body was found locally and then use the H1B norms to get somebody from India or other such countries.

Show an Indian the honest way or a best practice, he will shrug it off. Show him an exploitation, loop hole, circumvention, he will embrace it with gusto and glee. Maybe even compound it further for illegal profit. I remember a guy at office bashed his head on the pavement from a bike. We took him to Apollo, for immediate neurosurgery. The company footed his total bill (not insurance enabled) for 12 lakhs, without a question. Later on he told me (after six months of paid leave), he fleeced the firm 2 lakhs, using doctored invoice manifestos. Imagine doing this to the entity which expedited one's second life......! What @Lord Nemesis , wrote about fake bills is prevalent. The logic people come up with: The tax money goes to the ministerial corruption coffers anyways. So am not surprised 500 participated en masse, it must have spread like wild fire.

^^ Thousands or lacs of rupees multiplied by 100 crore people doing it is always greater than the crores looted by a few hundred or thousand politicians. So it is not sound logic. If they are fine doing such stuff themselves, they shouldn't act like they are angels on earth with the right to condemn everybody else. At the core, there is nothing different between them and these politicians expect for their respective opportunities. I see it as nothing more than jealousy of the politicians that they are in position to earn crores while they have to be satisfied with thousands or lakhs.

You can't believe the level of messed up logic people come up with to justify such fraudulent activity. I have had people quite often justify such things with the line "Lakshmi at one's door step should not be turned away". Its funny how holy books and religious sayings sole purpose of existence is for people to justify their own wrongdoing.
