You're bringing logic in an area where nuance holds more weight. Everything you've said is valid, however none of it is actually applicable.
The nuances:
This forum, along with team-bhp, are probably the oldest in India at around two decades old. The people that were here in the beginning are probably grandparents by now.
What this means is that it isn't a new place where things are still being established. Everything is already in place and has been in place for a long time.
The focus of the admins/mods now, at this point in their life, is to keep the forum active with the least amount of time spent and effort exerted.
There are military references throughout the forum, almost as if the owners/founders were ex-Army. An extension of this is the zero tolerance towards rule violations.
OT but related: Just the other day, I witnessed a zero tolerance policy being enforced in an another community. Cars 'n' Coffee Hyderabad organized a Vintage Car Show for the general public. However, members who revv'ed up their engines outside the venue (thereby disturbing the public on a Sunday morning) were expelled from the group without warning. A vendor/startup that setup a stall without prior permission were similarly expelled even after an unconditional apology (entry is free so expenses are paid by the sponsors/vendors).
Even more OT: Back in school, my classmate had to repeat an entire year of school because he was less than five minutes late to the exam center. An entire year! He's now earning 36LPA but laments that he's been robbed of 36L just because he was not disciplined in his younger years. Of course I take the opportunity to tell him basically that he robbed himself of 36L ("
you are your own enemy") and then he's in a sour mood for the rest of the day so I need to buy him an ice cream otherwise he carries that sour mood home to his wife and kids.
Many times, life doesn't give you second chances and ignorance of the rules isn't a valid excuse.
Anyway, it could be argued the 'Packed Brand New' doesn't implicitly imply it is sealed, just that everything is packed as if it's brand new.
But that's still a nuance superseded by the rules thread, which is titled:

I mean, if someone is admitting to not reading the rules, then yeah, they would probably end up being banned.

Irrelevant since the marketplace is closed for new members, so only those who are familiar with the rules have access. And if they forget or don't remember, they end up banned and/or have their thread deleted.
If we can implement the same in the thread Template itself, these mistakes can be avoided.
That is a good idea, but I don't even remember what I coded last week. It's likely whoever set up the template has completely forgotten how to do it. But it doesn't matter since you're supposed to read the rules.
Again the same issue.... does banning someone solves the issue??
If someone can't read the rules, the forum is better off without them, ha. On a more serious note, they're trying to minimize the administration overhead, so yes, a ban helps keep the forum running smoothly.
Maybe it's more easy to digest if you don't think of it as democracy, but more of a benevolent authoritarian regime. And think of a ban as a slap on the wrist — most bans are temporary anyway.
Note: I have no vested interest in this forum, I'm just happy to be a member here. I probably should spend more time looking after the cats that have adopted me though.
