Leaving out times, how much noise is acceptable really ?

As to legal options, what do you do if he calls the cops.

They talk about a 5 dB limit for personal music system. IS your carpenter making more noise than that?? I do not think so. Tell them you are not running a carpentry shop and your work will be over in a few days. Noise rules say 10 to 6 but I do not know if that applies here.

The answer is in the Annex of

The Noise Pollution (Regulation and Control) Rules, 2000

So in this case its presumably a residential area and the ambient level is set to 55dB(A) for daytime and 45 dB(A) at night which is between 10pm - 6am. If in a silent zone which means an area comprising not less than 100 metres around hospitals, educational institutions, courts, religious places or any other area which is declared as such by the competent authority. Then its 5dB(A) lower.

A complaint can be made if the noise level exceeds the ambient noise standards by 10 dB (A) or more given in the corresponding columns against any area / zone.

SO if the sound by the carpenters exceeds 65dB(A) there are grounds for a complaint during the daytime.

Consider that a normal conversation is 50-60dB, heavy machinery & motors is around 70-90dB. I'd say carpentry is on the borderline here. A lot depends on how continous the noise is.
 
I stay in a residential area where there are 9 towers of 15 storeys each. Every now and then people are getting their furniture made. In my towers, the rules are strictly implemented as it becomes a nuisance for a person staying in the apartments.

One family sued another for nuisance. This was the outcome of the law suit (These are solely the facts of the court case outcome and not my opinions)

1. You may say, that your efficiency is getting hampered. But, who has asked you to construct furniture in an apartment. It should be ideally done in a warehouse or an industrial area. In an industrial area, workers use ear aides to protect their hearing.

2. There is a law book for housing socities and residential buildings. You building has to abide by that.

3. I am not sure what the law book states. But this is followed in my society after this legal suit.

Work can happen from 10 AM to 1 PM. Then from 4 PM to 6 PM. Thats all.

4. Before carrying out any work, the owner has to pay a deposit of 40,000 rupees.

I'm curious about this does each society make their own up and get the residents to sign when they join ?

No....its already made.........its a huge book yaar........Since we have so many towers and so many residents........there is bound to be conflict.........and thats how I know so much........lol.......

Besides your society can make their own rules too, which is passed by a majority.
 
Can be Booked for an offense under IPC* Sec 268 & CPC** Sec 133 for public nuisance

I dont think such people have any sense of gratitude or anything, even if we accommodate him now , he'l come shouting next time instead of returning the favour, and again the same story wil ensue..If you accommodate my request i'l have to adjust on some issues too, but here its one sided and its too much to expect him to be a good neighbor..

Rest assured we'l pay him back with the same coin if he continues the same attitude, tired of his shit..We want to avoid this situation but with someone like him its hard to tolerate..Secondly we really dont have the time to dwell into his motive of doing such things, some say jealousy and all, but really he's no kid, abt 40 yrs of age..:@

I think you should let a senior member of your family take such decisions.

Some neighbors co-operate and bear the nuisance of the noise. Some people are not ready to do that. That doesn't make then evil.

Your best bet is to negotiate and keep getting your work done. If he is a finicky person, he will sue you.

You will loose time, money and may even have to pay a penalty if your neighbor proves that you have been violating the laws.

and trust me, laws protect a resident very very well. Keep in mind that builders and other construction agencies also cause nuisance to residents. So laws are in place to keep a check on that and in turn also apply to you.
 
@ Party Monger..........you should ask the Carpenter to push in more man power so that more work can be finished in the allowed hours.
