can products at eBay be sold higher than official price?

eBay has listed (or has let someone to sell) iPad Air 2 at 44, 850 INR [0]. They are sending promotional email to all the eBay members, so eBay surely knows about this. However it was earlier announced that iPad Air will be launched at 35,900 INR [1]. I tweeted them asking this, usually they reply within a minute, but seems now they are quiet [2].

Then I checked iPhone 6, 16GB prices. The launch price was 53,500 and it's same at all the retailers. You can check FK, Snapdeal or Amazon. But on eBay, some people are selling it above that price [3], at 54,500 INR.

How can they do this? Is it because they follow marketplace model and where anyone can sell at any price? So, tomorrow anyone at Flipkart also sell above official pricing?

Ipad Air is US product which will be sent to Indian buyer. So official price doesnt apply.
For Iphone 6, you are right but it applies to authorized sellers only. I am not sure if the seller is one.
Ebay usually has 5 to 10 % discount coupon so maybe to recover that, there is an extra price.
You can always write to Apple India for a clarification.
 
This topic was discussed to death in another thread that Lord Nemesis had started and unless you are getting a proper invoice with vat id with the inflated amount written on it, you can't do anything legally. eBay is just a facilitator and it is actually it's USP that anyone can sell anything on it at whatever price he/she wants, same as on forum marketplaces.
As for your second point, no one on flipkart can sell like this, because Flipkart needs the sellers to have vat id and provide a proper invoice of the products they sell.

Well yes, some seller give you VAT bill and official Apple India warranty. The one I linked in OP, mentions the same.

The ebay thread you have given is for Ipad Air which will be imported to India. Product location is US.
 
@avi yes people on Flipkart and Snapdeal do sell products above MRP. I was looking to buy Fifa 15 for PS3 and it was listed for Rs.4,999 but it's MRP is Rs. 3,499. When I mailed Flipkart about the price they replied me with this sh*t!

I just saw the iPhone listing. I am pretty sure the invoice won't be for 54500. Because if it is, one can take them to court for selling over MRP.
