but yea he paid for a new one but ended up getting the same modem which was sent back by Varkey. Confirmed by the IMEI number.

Err...if OP wants the full money he should have ordered from dvdstoredelhi's online store and not from ebay. U can't dictate ur terms. The seller also has his say and will go in loss if all buys start dictating
I am thinking the OP used a discount coupon in ebay (for sure) as there is no other reason to go through ebay as he wants all deals now outside ebay
now he wants full refund outside ebay as he knows refund thru ebay would be minus the discount coupon amount. I think tis is completely wrong from the buyers end
no buyer is at his right to warrant a full refund after complaining for a product after 2 months...he gets a replacement and not a full refund. He should be happy to get a full refund thru ebay as of now

^^ ok buddy, now the issue is between DVDstoredelhi and you, and one of you have to initiate the process, and i think you should do that (as others have also suggested that). After that DVDstoredelhi will refund your money via ebay, and you don't have to worry about that as he had said that keeping the TEians as witness.

I am giving the rightinformation to the buyer .Why are you so concerned about a guy who has not even bought a modem and there are several others like funkykid,onlyravi,gigacore,freaky many others who are still waiting for modem or get a refund or stuck with a defective modem .
