I agree with Sato1986. If the guy is wicked, which he surely is, he will not budge. Tell him to keep 1k or 2k as margin money and take the card back. Make use of the market section in TE to buy the best products but only from registered dealers/ senior members

PS: @Arun687 it would help if you type without "..." Makes the post totally illegible

@OP:

Atleast post here the details of the dealer so that others can be aware

As others suggested, ask him what his cutting (profit) in this card is

He would not say more than 200-300 . He would say the cost price it came to him was 13.5K max

So tell him to take it back 1K less and dont buy another card from him

Get the money back and buy from best place and for best price after researching on TE

Going to consumer court wont work i think, since the MRP is higher

for eg: my neighbourhood store sells AXE for 120, the same Spencers chain sells for the MRP price of 140

I cant just sue Spencers for overcharging, they are within limits

Its your ignorance which has costed you in this case

Exactly.. As long as the purchase price is less than or equal to MRP printed on the box, there is much much even the courts can do about it. At the same time you cannot skip paying him either as he can file a case against you.

I think its this mediator who took advantage of you, not the place where he bought it from. He must have bought it from the real market price and passed it off to you for 14k knowing you are not aware of the prices and that he can rip you off.

I would say that you just assume that you paid a fee of 7k to this guy to learn a very important lesson and just move on. :P

I actually bought from a guy from whom I bought the previous PC. I just have his number he buys the stuff and brings it to me. the main reason I buy it from him is that , he gives a little more time to pay him back. like my system upgrade costed me 20k . He said pay 10k one month and another 10k next month. Main reason I HAD to go to him.

The upgrade i did was a

ASUS M3A78-EM
Corsair 2 GB XMS2 800
XFX 4850 XXX 512mb
Seagate 160gb

All this costed me 20 k from him.
u say the total cost is rs.20,000 . lets assume board, ram and hdd - rs.8000approxmiately. so 14000+8000= 22000.

but he asks u only 20,000 - what a calculation is this ?

u already paid rs.10000, right ? . ask about his commision , and dont pay anything more than 1000 to the max , get back rs.1000 and return the card back.

And also see whether the board , memory , hdd are all new. He might have played fraud on any of these too, be careful

And why did u go for a 160gb hdd dude. Cud have taken a 500gb. Its Much priceworthy

Did he gave u bill ?

didnt u ask the price from other dealers in richie st., Its a big market, right ?. unbelievable....

and y r u very reluctant to mention the name of the shop where u met this guy ?. surely he will belong to a shop.

Expose it, so that others will be safe in future.....

Dude, its ur mistake yaar.
Its utter foolishness to buy a card worth 14k without enquiring from other shops.

I guess u can do nothing about it, coz the guy will never return ur money or reduce the profit he already has.
Enquire before u buy always anything. :cool2:

However, u can show him that from other dealers in Chennai it is available for so less and how can u charge 14k for this.
If he doesn't give u some consideration, call ur friends...:P

Tell him that you will do bad publicity. Better still get "written" quotes from other dealers @ correct price and threat him with legal action. That should help i hope.

Any lawyers in TE?? Please provide your inputs on what is the right action in this case?

People advising legal action are missing the point that the TS got the card from a middle man. The TS got ripped off because of his own negligence. I am not sure what kind of bill/invoice be was handed or whether he was given one at all. but...

He was charged less than the MRP printed on the box, so no legal action can be taken. Courts do not go by market prices. a price is legal as long as its less than the MRP. There are always price differences between dealers. You cannot drag a dealer in Mumbai to consumer court just because he charged 500~1000 bucks more than a dealer in Delhi, now can you? I am no lawyer, but from the TS perspective, I can see nothing on which to build a consumer case.

The fact that he offered the TS a MSI card without warranty means that this middleman may be selling used cards in which case even the one he got may be a used card. If the box you got was already opened then theres a good chance that its a used item.

Okay I just got the bill of the PC I got from my dad. And this is what it says .

Asus MOBO M3A78-EM

AMD Athlon x2 7750

XFX HD 4850

160 GB Seagate

2GB Corair xms 800mhz

He hasn't mentioned price for each item , instead he marked all with one line and wrote Rs. 18461 and then 4% tax 739 Rs which totals 19200 Rs.

The dealer name is MDL IT Service North usman Road , T.Nagar. I don't think any one would be dumb enough to get ripped off like that . Its just that I bought a new PC after 5 years and I just wanted it so badly that I didn't take notice of it the day i bought it.

There must be a good number of dealers who charge insanely. Even my previous dealer used to charge approximately double the cost of the actual thing.

But as long as they don't charge beyond the MRP they are doing what they are legally allowed to do. If the guy has enough customers who pay 14k for a 7k thing then he is wise in keeping a 7k margin.

He will not give you back the card even with a 5k margin and you can't force him because he has not done anything wrong. If you knew cheaper alternatives then you are free to buy from them in the first place.

All you can do is buy a good deal in future.
