Well Guys 
My brother wished to buy an preworshipped Iphone 4 and conveyed the same to me.
Thus the search started to find a good deal at TE, further making me land at the thread created by Mr.GuptaJi for the sale of his Iphone 4 + Gevey Ultra SIM + Otterbox cover at 23.5k (without gevey) http://www.techenclave.com/mobile-phone/iphone-4-16-gb-gevey-ultra-196468.html and the deal was fixed.
now i shall take you through the events in a prescribed daywise manner:
Day 1 (17/8/2011)
as i`d sent an pm to Guptaji for confirming the purchase, i recieve a call from his side that he is willing to sell his
iphone4 though without 'Gevey sim' at the price of 24k. Guptaji confirms that the phone is in top condition, scratchless and
will work with any of the gevey sim available in the market as he would not be selling his. I, OK the deal and ask him to inform me back; about at what time he will be able to meet on that very day itself, as we live in the same city and are at a distance of not more than 15kms from each other.
Guptaji calls again, informs me that the phone has to restored/formatted/wiped to clear his personal stats in the same and hence will be sold next day in evening around at 9pm @ chembur Mumbai. I accept, inform my brother of the same and revert back to dear Guptaji and confirm my affirmation on the same.
Day 2 (18/8/2011)
Me and my cousin are quite excited to buy an Iphone device for the first time, specially if it has to be an well renowned iphone 4.
around 5.30 pm, i call Guptaji to know where exactly he`ll be meeting me at chembur, he says he is at work now and will inform me shortly. i ask him where does he work, then he says in colaba, i say i am nearby at lamington road and come down at your office place to collect the cell. Guptaji says it wont be possible for him to come out now and it will be better we if meet at the predecided venue.
i go at my cousin`s place at chembur (which is 17kms away from my home), just for the sake of being there when the deal actually transacts. My brother now calls dear Guptaji to confirm his whererabouts at around 8.45pm as were suppose to reach at the 'deal venue' at 9.30pm. Guptaji says he is on the way and will call soon....
then the waiting game starts.. we wait.. we wait.. n we wait while Guptaji`s Mobile Number seizes to be swithced ON and hence connectable. i wait till 11.00pm, leave an sms towards guptaji mentioning "where is he and his cell is not reachable"...
at around 1am (night) recieve 2-3 sms from Guptaji, wherein he mentions that his cell battery just ran out and he had no means to his avail to contact me (though i`d pmd him my number on TE.. but may be he was telling the truth)
I again say.. no issues and let us get through the deal tomorrow morning.
Day 3 (19/8/2011)
i ask again to my brother to meet Guptaji at the predecided venue in the morning.. and eventually they both met.
my brother being a little apprehensive (while dealing with online stuff), requested Guptaji to come along with him at a resellers place wherein he can check if the GEVEY SIM thing actually works in the Iphone 4 being sold and there were no issues attached with the same, as Guptaji was not sellhig his GEVEY. they both reached at the shop, my brother got his sim cut from the shopkeeper and attached the same in the GEVEY ultra available with Guptaji, it worked properly.
my cousin just to be on a safer side, did inspection of the Iphone 4`s cosmetic condition and did find a few scratch and dents in the iphone4`s body. Cousin and Guptaji both came into consensus that these defects can be ignored for a discount of 500 rupees, thus reducing the price for the phone from 24k to 23.5k.
Guptaji informs my brother that he has a flight to catch as he has to go out of Mumbai and my cousin obliges.
As of now, my brother has the Iphone 4 with Otterbox Cover with No Gevey SIM installed.
after Guptaji left, my brother asked the reseller to install Gevey sim into the phone, but 2 of them failed. As a last resort, he then came to my house in evening requesting me to help him with the Gevey Sim that will work. we went at a Mobile reseller whom i know and asked him to install a GEVEY sim that will actually work. We bought Gevey SIM supreme for the price of 950 rupees and the shopkeeper who is quite know at vashi area, Navi Mumbai (Impression Shop Sec-17) started to install the same.
the Gevey requires you to dial 112 and then cut and then go at settings (which you can only do via pressing the back/menu button so as to get out of the calling interface and reach at settings page). the menu button just stops responding and when it does we are too late... this happens a few times, until it works for one time and we are set to use iphone (all these time we though this might be some thing that actually does happen when someone is trying to install GEVEY on his locked Iphone4.
reach my home along with my cousin.. try to use the phone but same menu/back button problem persists. we restart the cell for check and the problem is gone for now. around at 12am we connect the Iphone to the charger and withing a few minutes find that problem has started to surface again. we again restart the phone, attach it to the charger and wait for the problem to somehow GO away when the next morning arrives..
Day 4 (20/8/2011)
Phone is still at my house, as my brother had to go for work. Phone is properly charged and ready to use.
try to understand a few settings of Iphone4 while curiously thinking what actually set this Iphone4 apart from my Galaxy SII in terms of sales and fan following. while doing so, again the menu button problem occurs.
i again restart the phone, and again after a few hours (2-3hrs) the problem resurfaces. now i decide its time to notify the Seller about the same and ask him whether its a pre-existing issue. Guptaji picks up the phone and refutes that phone didn`t had such problem and he was amazed to hear that it suffers from it now.
he requested me to get it restored/reflashed from somewhere or by myself to confirm whether its a problem that has arisen due to bad flash (he did other nite to wipe his data off). i say to him, as i or my cousin are not apt in handling Iphone4 workarounds , would not like to risk flashing the same without Seller`s (Guptaji) presence.
I again request Guptaji to inform me when he comes back, and does the above by himself, as it is his responsibility as a seller.
Guptaji acknowledges and says he will.
Fast forward to Day 6 (22/8/2011)
i called Guptaji yesterday around 9.30pm to ask him when he will be reaching back in Mumbai, which to my surprise Guptaji told me has already arrived in Mumbai. i then request and ask him to get this issue sorted as soon as possible, as my cousin is not to happy with the purchase after putting in his one months salary in the purchase. Guptaji says to me stop saying again n again " ke brother is not happy with the transaction, and i`ll do the restoration thing as per my convinience". i say to him Boss,
u have sold stuff of 23.5k that isnt functioning well, dont u think that you have a little bit of responsibility involved here?
he again says.. aap baar baar paise ki baat mat karo.. mereko jab time milega i`ll do the restore. i get a little bit irritated now and say to him boss " this is not the way to deal, aapne 23.5k liye hai, thodi toh responsibility dikhaiye.. " Seller says " its a long process and it will take time and i as of now dont know when i can actually allot time for you to restore the phone that i sold you and confirm if its a software issue or the hardware one. also says y dont you (I) restore it myself.."
i say " Dear, i am not apt with iphones working and hence it would be great if your could the same." seller then says " when you dont know how to restore or flash iphone why you`d purchase one ?? further says as my cousin was checking Gevey sim compatibility with the Iphone 4, he lost his scheduled flight and blames us vehemently for the same.
the last few sentence above heated up the conversation a bit, wherein my voice got louder which the seller said he found offensive. he cut my call and said will not respond further. i decide to tone down, relax and calm. i send him an sms saying if you want help then help or just tell me you dont intend to... because this purchase has been a dwindling affair.
Seller responds, says doesnt want to cheat and says will help. I then sent one more apologizing for anything that i must have said and requested him to please please help.

called Guptaji in afternoon, he cuts and responds via sms (may be he is busy or does not want to talk to me)
says he will meet again at chembur area between 7.00pm-7.30pm and will collect the phone for restoration purpose.
also says, if even that doesnt work he will find a solution for the same.
Day 7 (23/8/2011) continuation......
my cousin left from his work place late in evening and decided to meet the seller at the predeclared location in chembur (Mumbai) around 9.00pm. the seller had specifically asked my cousin to get the phone along with all the accessories and the box attached, my cousin thought that good sense had prevailed and he shall be receiving a refund now...
but again the seller insisted on restoration process to confirm if the issue has happened due to bad flash or if at all it is a hardware issue. My cousin was OK with the sellers persistence of verification of the problem with the firmware restoration process, but made an argument in front of the seller that, he shall lend/give back the purchased Iphone only once GUPTAji tells him about his address of residence and shows some verification about the same.
now the most tacky thing happened. all these time (from start of the deal till today afternoon) while i was involved with talking to Guptaji, he mentioned to me again n again that he stays in Wadala area of Mumbai, but suddenly when my cousin persisted with the proof of residence before giving him the Iphone, he said he stays in Dadar and cannot give his residence address, as he is not binded to do the same in the case of this deal.
my cousin amazed was so freaking feeling helpless that he just remained there stranded in awe & shock !
Cousin then asked, Mr.Guptaji to help in some or the other manner and get him out of this situation, Guptaji again gave the best of the 'Lines' one could give to cheat someone. Guptaji tells my cousin he has to leave out of Mumbai tomorrow via flight and hence wont be able to help with the restoration process and verification. Guptaji also 'donates' a 500 Rs note in my cousins hand and asks him to restore the phone from outside, use it again for 2-3days and inform him if the home button issue remains, when he returns back in mumbai.
my cousin being a simple person with quite an mellowed down personality had no other option but to accept what Guptaji was saying with all his trust now stuck to one community to help tat is TE. now my cousin is again stuck with the phone in hand that doesnt work well, the seller who is very much persisting with the restoration process, but again does not do it by himself and a freaking 500Rs Note.
you guys might be thinking where i was ?
well i was busy attending to my office chores but was being updated my brother constantly on the issue. But again, the timing had to get wrong, when my brother (cousin) actually went to meet Guptaji, he forgot to take another phone with him thru which he can contact me while having conversation with the seller (for guidance) and I too was busy attending a client.
talked to him on phone around 11.15pm, and I/cousin both were dissapointed with the days happenings.
I have again strictly mentioned my brother to keep the phone as it is and not to get the firmware restored from any of the stores outside which claim to do so. i have also requested him to keep the 500 Rs note as it is, so as to return the phone + money back to the SELLER (guptaji) when he returns to mumbai.
as far as Guptaji is concerned, i cant really check whether he has actually gone out of mumbai or not. he simply cuts my calls and seizes to respond satisfactorily.
should i just wait for more 3 days ?
what other options should i try ?
i dont really know what the seller has in mind... just want our money back.

1: i dont mind giving back the phone to dear Guptaji for the restoration again, but would also like to know where
he stays and is located in Mumbai as now he shall posses my cousin`s money and the phone both.
2: if the menu/back button still doesnt work, i want a refund. see we dint invest 23.5k + 950rs in a phone to go through
such an expirience wherein our own expertise and knowledge of using an Iphone category phone is challenged by the seller when we ask for a resolution.
hence to conclude: Either the phone works as it should be or my cousin gets his money back. we will not keep on waiting till the
seller tries to fix the problem. Someone also told me the problem might be related to gevey sim (bigbyte Told), then i shall request dear Guptaji to sell his Gevey sim at the earlier price he proposed with the combined deal of 24.5k, but then again the phone had a few scratch and dents, hence a discount of 500 rupees was given by Guptaji, thus making it 24k with Gevey SIM that he possess.
So guys,
1: The restoratio works and everyones happy
2: Seller attaches his Gevey SIM (bigbyte says this may help and again has to be confirmed by usage)
3: Seller Refunds
