1. You put up a sale thread and its available for everyone to see. The buyer did not get what any potential customer would infer from your thread. When you did not mention anything about the product being different from the retail version, were you expecting the buyer to have godly powers to deduce that the product you are selling is considerably different from the product you linked to? That is all people need to understand about the issue.

2. You were yourself responsible for your tainted reputation. If you are claiming ignorance about the product you were selling, then as a honest and fair person, you would not have allowed the buyer to suffer for it the moment you understood that what you sold is not the same as the product as what the sale thread indicates.

3. It is not too late for you to redeem yourself and I hope you do so.

@Uziel - Worst of all. You knew of this thread yet did nothing to defend yourself. You instead PMed the OP instead of posting here to clear your name. And as Lord Nemesis pointed out you are a computer expert and knew fully well of what the card could and could not do.

Anyways the damage to your reputation is not permanent. If the OP and you can mutually resolve the issue I am sure your reputation will be restored. :)

^ because the seller had posted that he will accept the product back ( [post=1485442]#198[/post] on 6th May )

and I have been waiting with a ray of hope ... :) . this is final appeal on this site to Mr Uziel ...
 
Mr Seshu ..... have some heart boss..... most of the time I am in Hospitals/clinics or with doctors ..... You have no idea what I am going through. Your money is not going anywhere. If I was a conman, you wld have never had a trace of me, believe me. I have done many trades here in TE and all are happy. I have asked you to keep the box ready. Please ship it back to me with what ever it had in it and make a list similar to what I gave you. In the mean time also give me yr bank account so that I can add it to the beneficiary list, it take time for approval.
 
here is the message he sent today :

Hello ..... I have already messeged that you need to Ship me back the Product in same condition .... my friend posted that messege but its not showing. Anyways in the mean time, u need to PM me yr account details, it takes 3-4 days for the addition so that I can credit back 2300/- from myside..

In the mean time please go ahead with the Court notice and Legal action, and please send me the copies. You an post one at my address. I live in Delhi so you can put one FIR under IPC 420

^^I have a feeling that Seshu fears that if he send the product back then Mr Uziel will keep the product as well as the money

and u will see some new trade opening up for the product:)
 
@ m-jeri, should I first send the product ... if it gets rejected then it will be another issue !

I first sent him money - after a week got product delivered (he had some reason for delay) !

@ vercetti , yes, I do have some suspicions ...

Mr Uziel already had my account number ; I was expecting (again I believe) that he returns money .

anyway sent again my account details . it actually takes 24 hours to add an account for third party

transfer and a few minutes for the amount to be transferred . it doesn't require 3 / 4 days ...
 
He agrees to refund ur money 100% after all this time provided u send him first. i dont want to think how much more time it will take to make him pay first and send second. :S.

Besides.. I kinda think he is being genuine. If he wants to swindle you, he could have just not even ask for it again. He knows court case is not strong. still he agreed to refund. so i think he is being nice. Take a leap of faith and send it.

In my opinion you should return the product.
Dont give him the excuse that you have not returned the product.

Just ask him to email you the confirmation to ship back the product & not via PM

Why not do it the same this time but vice versa. He sends the refund first, you dispatch back the product. Play it safe. Once burned twice shy.

Also regarding addition of TPT payee and activation, it is not always 24 hours. Depends on the banks mechanism. Though post 2 : 00 PM, the EFT is held back, till the next working day. Some logic that it goes to RBI for verification, if not same bank.

Stop giving him unnecessary fears. The guy agreed to do make things right. reciprocate and give him a chance.

Or now we all can go on making posts abt wether @OP should send or not and delay it further.
 
i think the seller has to earn his trust back. and he no longer enjoys a presumption of innocence.

I say the seller should refund the money before the buyer ships it back

Yes you will need to ship the product to him before be refunds. Thats how it usually works. Yeah I understand that you are apprehensive about sending it out to him, but the worst outcome of that is no worse than keeping an absolutely unusable product with you. I don't think you would even be able to sell such a restrictive product on forums if you give full details which is why the seller resorted to such tactics. So just send it back to him and see what happens.

LOL, he even knows the IPC code under which his actions would be charged in case buyer files a police case. I guess he has done his research well before hand.

no he will simply keep the product to doge all the allegations...and will then bring forward points like 'how fool could any one be to send back the product after lodging an FIR'

the deal shall take place in the same order as it was before, 1st money and then product...please do not fall for any tactics.. may not be tactics but it's better to play safe now.
 
TBH, I don't think a FIR and a court case would do much in this case. The time taken in these actions and the costs associated with them would make the amount in question seem too petty.

IMHO, seshu should return the product and hope for the best. In case the seller does not cough up the money after the return, we still have a legal case as the courts and the law of the land does recognize genuine efforts to reconcile the situation before approaching the higher authorities. Think of it as an arbitration process where the forum acting as an arbitrator. In any case, seshu I don't think you would have a dearth of witnesses even if you do take this to court :). By the looks of it, we are all with you in this dude.
